RESOLUTION NO, 98-66
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
GILROY AUTHORIZING EXAMINATION OF STATE AND
USE TAX RECORDS OF THE STATE BOARD OF
EQUALIZATION BY CERTAIN DESIGNATED OFFICERS
AND EMPLOYEES
WHEREAS, the City Council of the City of Gilroy (hereinafter referred to as the
"City") deems it desirable and necessary for authorized representatives of the City to examine
confidential sales and use tax records of the State Board of Equalization (hereinafter referred to as
the "Board") pertaining to sales and use taxes collected by the Board pursuant to the contract
entered into between the City and the Board under the Bradley-Burns Uniform Local Sales and Use
Tax Law; and
WHEREAS, Section 7056 of the California Revenue and Taxation Code sets forth
who may examine said records, imposes certain requirements and conditions for the disclosure of
Board records, and makes unlawful certain disclosures of information contained in, or derived
from, the sales and use tax records of the Board.
NOW, THEREFORE, BE IT RESOLVED THAT:
1. The City Administrator, or other officer or employee of the City designated in
writing by the City Administrator to the Board, is hereby appointed to represent the City with
authority to examine sales and use tax records of the Board pertaining to sales and use taxes
collected for the City by the Board pursuant to the contract entered into between the City and the
Board under the above-described Sales and Use Tax Law. The information obtained in
examination of Board records shall be used only for purposes related to the collection of City sales
and use taxes by the Board pursuant to the contract entered into between the City and

the Board under the Sales and Use Tax Law,
2. Resolution No. 994 adopted by the City Council of the City of Gilroy on
February 7, 1966, is hereby repealed.
PASSED AND ADOPTED this 7th day of December, 1998 by the following vote:
