RESOLUTION NO. 98-69
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
GILROY AMENDING THE CITY OF GILROY CONFLICT OF
INTEREST CODE TO ADD POSITIONS AND CHANGE THE
TITLES OF CERTAIN PERSONS SUBJECT TO THE CODE
WHEREAS, the City of Gilroy has reorganized certain functions in its
organization; and
WHEREAS, m pertinent part, this reorganization deleted the positions of
Accounting and Finance Manager and Purchasing and Property Manager, created the positions of
Finance Director and Revenue Officer and Accounting Supervisor, and has a position for either a
Purchasing Technician or Purchasing Agent, and caused the Chief Building Official to be newly
named the Building Official, and caused the City Clerk, the Deputy City Clerk, and the HCD
Coordinator to be given the authority to make governmental decisions potentially affecting the
City's financial interests, and
WHEREAS, these changes require revision to the list of the positions identified in
Appendix "I" of Resolution 95-88 which listed positions under the City of Gilroy Conflict of
Interest Code as designated positions under that Code; and
WHEREAS, it is the intent of the City Council of the City of Gilroy that the
newly named and created positions become subject to or remain subject to the City of Gilroy
Conflict ofInterest Code.
NOW, THEREFORE, BE IT RESOLVED THAT:
Appendix I to Resolution 95-88 of the City of Gilroy Conflict of Interest Code
shall be deleted in its entirety and replaced with an amended Appendix I as follows:

Only those interests which are relevant to the consultant's engagement are required to be disclosed. The
appropriate interest to be disclosed shall be determined by the City Administrator in conjunction with the City
Attorney. Such determination shall include a description of the duties of the consultant and, based upon that
description, a statement of the extent of disclosure requirements. The City Administrators determination shall be in
writing, is a public record, and shall be retained for public inspection in the same manner and location as this
conflict of interest code.
All agreements with a consultant, whether or not such consultant is required to file a disclosure statement
in accordance with this resolution, shall contain a certification by the consultant that no conflict of interest exists in
connection with the contract being entered into between the consultant and the city.
