RESOLUTION NO. 99-22
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
GILROY REGARDING THE IMPOSITION OF A SPECIAL
ASSESSMENT LIEN FOR THE COSTS OF THE PUBLIC
NUISANCE ABATEMENT REGARDING ALFRED AND
LYDIA MONTANOS' PROPERTY LOCATED AT 8605
MURRAY AVENUE, GILROY, CALIFORNIA,
APNNO.835-01-003.
WHEREAS, a duly noticed public hearing was held May 15, 1995, before the City
Council of the City of Gilroy ("City Council") wherein the City Council found and determined
that the condition of the property located at 8605 Murray Avenue was a public nuisance pursuant
to the Municipal Code of the City of Gilroy (Gilroy Code) Chapter 15 Article IX, as fully
described in Resolution No. 95-35, attached hereto as Exhibit "A" and incorporated by this
reference; and
WHEREAS, the City Council found and determined that the owners of said property
contributing to the nuisance conditions were to be responsible for all costs involved in the
vehicle removal and abatement of said nuisance, and, in the event that the owners failed to
reimburse the City for its expenses, the City shall have the right to place a lien against the
property to recover the cost of the vehicle removal and nuisance abatement pursuant to Gilroy
Code Chapter 15, section 15.119 and California Government Code section 38773.5; and
WHEREAS, on May 15, 1995, the City Council passed and adopted Resolution No. 95-
35 attached hereto as Exhibit A; and
WHEREAS, on or about June 24, 1998, and March 1, 1999, notice was sent to the
property owners that if the owners did not reimburse the City for the vehicle removal and
nuisance abatement costs, the City would file a special assessment against the property located at
8605 Murray Avenue, Gilroy, California; and
WHEREAS, on or about August 18, 1998, November 9, 1998, November 21, 1998, and
March 1, 1999, notice was sent to the property owners' attorney that if the owners did not
reimburse the City for the vehicle removal and nuisance abatement costs, the City would file a
special assessment against the property located at 8605 Murray Avenue, Gilroy, California; and

WHEREAS, the City has not been reimbursed by the property owners of 8605 Murray
A venue, Gilroy, California, for all costs involved in the removal of vehicles and the nuisance
abatement costs.
NOW, THEREFORE, BE IT RESOLVED THAT:
1. That a special assessment lien be recorded in the amount of Eleven Thousand Six
Hundred Fifty-Five Dollars and Forty-Three Cents ($11,655.43) for the costs incurred by the
City for the removal of vehicles and the nuisance abatement costs for the property located at
8605 Murray Avenue, Gilroy, California, APN No. 835-01-003, said amount shall include the
one percent (1 %) collection fee charged by the Santa Clara County Tax Collector's Office.
