" RESOLUTION NO. 99-70 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF GILROY APPROVING TM 99-03, A TENTATIVE MAP WITH TWELVE RESIDENTIAL LOTS AND ONE COMMON AREA LOT ON APPROXIMATELY 2.79 ACRES LOCATED AT THE WESTERLY TERMINUS OF VIOLET WAY, EAST OF SANTA TERESA BOULEVARD, APN 790-54-008 WHEREAS, Syncon Homes of California ("Applicant") submitted TM 99-03, requesting a Tentative Map to subdivide a 2.79-acre lot into twelve (12) residential lots and one (1) common area lot; and WHEREAS, the property affected by TM 99-03 is . located at the westerly terminus of Violet Way, east of Santa Teresa Boulevard, as described in Exhibit A attached hereto; and WHEREAS, pursuant to the California Environmental Quality Act ("CEQA"), a Negative Declaration, along with a Mitigation/Monitoring program was adopted by the City Council on September 3, 1996, which included this project in connection with tentative map application TM 96-03; and WHEREAS, the Planning Commission held a duly noticed public hearing on July 29, 1999, at which it considered this project and voted to recommend approval of TM 99-03 to the City Council; and WHEREAS, the City Council held a duly noticed public hearing on August 2, 1999, at which time the City Council considered the public testimony, the Staff Report dated July 15, 1999, and all other documentation related to application TM 99-03; and \KHM\453106.01 914-081004706002 -1- RESOLUTION NO. 99-70 . . WHEREAS, the location and custodian of the documents or other materials which constitute the record of proceedings upon which this project approval is based is the office of the City Clerk. NOW, THEREFORE, BE IT RESOLVED THAT A. The City Council finds as follows: 1. The project is consistent with the site's land use designation on the General Plan map, and with the intent of the General Plan text. 2. The project is consistent with the Zoning Ordinance, the City's Subdivision and Land Development Code, and the State Subdivision Map Act. 3. There are no facts to support findings requITIng denial of the proposed tentative map pursuant to California Government Code section 66474. 4. There is no substantial evidence in the record that this project will have a significant effect on the environment. B. Tentative Map TM 99-03 should be and hereby is approved subject to: 1. This project also conforms to the policies of Gilroy's General Plan. The followin.g examples demonstrate this compliance: Urban Development and Community Design (Section ll): Policy 3: "Urban Development will only occur within the incorporatedportion of the Planning Area. Land will therefore be annexed to the City before final development approval is given. " The proposed project is in conformance with this policy, because this land has been within City limits for many years. Policy 4: "The City will phase development in an orderly, contiguous manner in order to maintain a compact development pattern to avoid premature investment for the extension of public facilities and services. New urban development will occur in areas where municipal services are available and capacity exists prior to the approval of development in areas which would require major new facility expansion. I' The proposed project is in conformance with this policy, because this property is adjacent to developed residential property to the south, east, and west. Municipal services are currently available at this site. . ENVIRONMENTAL IMPACTS: NEGATIVE DECLARATION An expanded Initial Study was prepared for this project under Tentative Map application TM 96-03. The study identified potentially significant effects on the environment, however, the applicant agreed to implement 11 mitigation measures that will avoid or mitigate the effects to a point where no significant impacts will occur. A Negative Declaration was adopted for this project on September 3, 1996. . RDO BACKGROUND: This project consists of the development of 12 homes, which will be constructed in two phases over a three-year period. Zoning Ordinance section 50.62 (b) (1) allows projects that produce 12 residential units or fewer within a three-year period to be exempt from the requirements of the Residential Development Ordinance. The City Council approved a previous 12-lot residential development for this site on October 30, 1996 [Ref: TM 96-03]. The applicant therefore will not be eligible to receive Final Map approval for this proj~ct until October 30, 1999, as required by Zoning Ordinance section 50.62 (b) (1). TM 99-03 3 07/15/99 . . ANALYSIS OF REOUEST: This proposed Tentative Map will subdivide a 2.8-acre site into 13 lots; 12 of these lots will be developed residentially, and one lot will remain undeveloped. The remainder lot will be subdivided into 3 residential lots in the future. This site has a zoning designation of Rl (Single Family Residential), and will be subdivided into lots ranging in size from 6,000 square feet to 7,529 square feet. The Tentative Map shows the first phase of this development adjacent to the existing homes on Violet Way, with the second phase to the west. The remainder parcel is located adjacent to Santa Teresa Boulevard. A sound wall will be required along Santa Teresa Boulevard and a portion of Mantelli Drive. This sound wall will not be required to be constructed until the remainder lot is developed, since the first two phases of this development are not proximate enough to Santa Teresa Boulevard to be affected by noise generated from that Expressway. An acoustical analysis has been prepared to determine the necessary height and location of the soundwall (REF: Brown-Buntin Associates, Inc. report, April 1999). This analysis has determined that the wall height will need to be 7.5 feet high along Santa Teresa Boulevard, and that a 6-foot flanking wall will need to be constructed along the northerly-most lot in the 'remainder parcel. In addition, Staff recommends that the soundwall (or a wall that appears identical) be continued along the rear oflot 10, so that the rear yard barriers that will be visible from Mantelli Drive are of a uniform design. Proposed house designs have not been submitted for this project. Since this development consists of standard size lots, and is not in a Planned Unit Development overlay district, the designs of the homes will be reviewed and approved at a staff level. Primary access to this development will be provided by Violet Way, which is a local street. The proposed street alignment is consistent with minimum City development standards. As submitted, this project is consistent with the intent of the City's General Plan text and Land Use Map, Zoning Ordinance, Subdivision and Land Development code, and the Residential Development Ordinance. STAFF RECOMMENDATION Staff recommends that the Planninl!' Commission forward a recommendation of APPROVAL of this request to the City Council for the followinl!' reasons: A. This project is consistent with the exemption from the Residential Development Ordinance permitted under Zoning Ordinance section 50.62 (b) (1); B. The proposed Tentative Map is consistent with the intent of the goals and policies of the City's General Plan document; . . 1M 99-03 4 07/15/99 C. The proposed development is consistent with the Zoning Ordinance and the City's Subdivision and Land Development Code; D. Public utilities and infrastructure improvements needed in order to serve the proposed project are adjacent to the project site; and E. There will be no significant environmental impacts as a result of this project due to the required mitigation measures to be applied. In addition. Staff recommends the followinl: conditions be placed on the approval of this reauest: 1. Mitigation Measures 1 through 11 contained within the Negative Declaration for this project shall be applied to the approval of the project in order to reduce and/or eliminate all potential significant impacts to a level of insignificance, as required under the California Environmental Quality Act (CEQA), subject to the review and approval of the Planning Division. 2. Hydrant locations and water main sizing shall be subject to approval by the Building, Life and Environmental Safety Division, prior to the issuance of any building permits. The minimum fire flow shall be 1000 gallons per minute. 3. Fire hydrants shall be installed and able to be opened prior to the start of combustible construction, subject to approval by the Building, Life and Environmental Safety Division. 4. An all weather fIre access road shall be provided and maintained prior to commencement of combustible construction (minimum 20-foot width), subject to approval by the Deputy Fire Marshall. 5.' Street improvements and the design of all storm drainage, sewer and water lines, and all street sections and widths shall be subject to the review and approval of the Engineering Division. 6. Full, ultimate dedication of Mantelli Drive (within the property) and Santa Teresa Boulevard will be required with this project. This will include any additional right-of-way needed for the Mantelli Drive/Santa Teresa intersection fmal design, subject to the review and approval of the Engineering Division. 7. All utilities to, through, and on the site shall be constructed underground, in accordance with Municipal Code Section 21.120, subject to the review and approval of the Engineering Division. 8. All improvements are to be doneper City of Gilroy Standards, subject to the approval of the City Engineer. 9. All retaining walls must be constructed of permanent materials such as concrete or masonry, and shall be of a modular design. Wood shall not be permitted. This shall be subject to the review and approval of the Engineering Division. . . 1M 99-03 5 07115/99 10. All grading operations and soil compaction activities shall be per the approved soils report and shall meet with the approval of the City Engineer. Grading plans shall show grades of all adjacent properties, and shall be subject to the approval of the Engineering Division. 11. All lots shall drain to the street for storm drainage, subject to the review and approval of the Engineering Division. 12. The developer shall negotiate rights-of-way with Pacific Gas and Electric and other utilities, subject to review and approval by the Engineering Division and the utility companies. 13. All existing water wells shall be sealed to meet the approval of the City Engineer and the Santa Clara Valley Water District (SCVWD). 14. The subdivider shall defend, indemnify, and hold hannless the City, its City Council, Planning Commission, agents, officers, and employees from any claim, action, or proceeding against the City or its City Council, Planning Commission, agents, officers, or employees to attack, set aside, void, or annul an approval of the City, City Council, Planning Commission, or other board, advisory agency, or legislative body concerning this subdivision. City will promptly notify the subdivider of any claim, action, or proceeding against it, and will cooperate fully in the defense. This condition is imposed pursuant to California Government Code Section 66474.9. 15. Provisions shall be made by the developer for a funding mechanism for the maintenance of the sound wall and landscaping in the public right-of-way, subject to review and approval by the Community Services Department and the Engineering Division. 16. Prior to Council approval of the Tract Map and Improvement Plans, the following items will need to be completed: a. A signed original composite plan by the electrical design engineer shall be a part of the improvement plans; b. A letter from the subdivision design civil engineer shall be prepared which states that the composite plan agrees with City Codes and Standards and that no underground utility conflict exists; c. "Will Serve Letters" from each utility company for the subdivision shall be supplied to the City; and d. The plan check and inspection fee for the utility underground work will be collected by the City. This shall be subject to review and approval by the Engineering Division. 17. Final Map approval of the first phase of this development shall be on or after October 30, 1999. Final Map approval of the second phase of this development may be given no earlier than one year from the date of Final Map approval for the first phase. The project shall be designed in accordance with earthquake design regula- tions of the Uniform Building Code, subject to review and approval by the City Building. ProvIsions for periodic sweeping for roadways, driveways. and parking areas on the project site; o. A design to reflect the City's Storm Water Master Plan; d. Paved areas shall be designed to minimize drainage. that is channeled to one location. Pathway paving shall be kept to a minimum and shall be porous in nature, wherever feasible; and e. Drainage facilities shall be designed and installed to collect and transport the natural flows away from the streets and buildings and into approved drainage structures. The developer shall apply for and obtain a General Permit for Storm Watsr Discharges AssQciated with Construction Activity by sUbmitting a completed Notice of Intent tonn and appropriate payment to the State Water Resources Control Board prior to the issuance of a building permit. Installing structural storm water treatment controls such as wet ponds, swales, vegetated filter strips, extended detention basins, and sand filters. b. Perlormance of routine visual monitoring of these controls; and c. Submittal of an annual report, documenting all surface water drainage information to the State Water Resources Control Board. 4.4 Air Quality 5. Contractor specifications for the proposed project shall be submitted to the building division for approval prior to issuance of a building permit for the pro- posed project. The contractor specifications shall include the following par- ticulate emission measures. a. Exposed earth surfaces shall be watered during clearing, excavations, grading, and construction activities. Watering of exposed earth surfaces could reduce particulate emissions as much as 50 percent. All construc- tion contracts should require watering in late moming and at the end of the day. Throughout excavation activity, haul trucks should use tarpaulins or other effective cover'S at all tImes. . c. Upon completion of construction, measures shall be taken to reduce wind erosion. To satisfy the city's current 58 dB Ldn exterior standard, the proposed prop- erty line noise barrier shall be 10 feet in height, with an extension along the north property line as identified in Figure 2 of Appendix B. To satisfy the 60 dB Ldn that the city is considering, the property-line barrier must be 8 feet hIgh with no extension along the north property-line as identified in Figure 3 of Appendix B. In order for the noise barriers to provide' the attenuation described herein, they must be of substantial construction and without gaps or openings. The most effective materials for barrier construction are 'concrete blocks, tilt-up concrele panels, stucco on both sides of a wooden frame or an earthen berrn. A combination of berm and wall may also be used to achieve the total required height of the noise barrier. If the project grade will be altered from that identified in the provided tentative development plan, sound wall perfor- mance may be effected an a new barrier analysis may be required to ensure compliance with the clty standards. . TIle design of the noise barrier shall be provided by the developer with the final improvement plans for Phase III. The design will be subject to review and approval by the Gilroy Planning Division, prior to approval of the final map for Phase 111. 6a. * See below. 7. Final improvement plans shall include a vegetation plan. The vegetation plan shall be prepared with the intent of shielding t.he barrier. Electrical service and a two-inoh water service shall be provided to the landscaped area.
