Resolution 1999-81 .~ . . RESOLUTION NO. 99-81 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF GILROY APPROVING TM 99-09, A TENTATIVE MAP TO CREATE SIX RESIDENTIAL LOTS ON APPROXIMATELY 1.11 ACRES LOCATED AT THE SOUTHEAST CORNER OF WREN A VENUE AND F ARRELL AVENUE, APN 790-12-021. WHEREAS, Greg Mussallem ("Applicant") submitted TM 99-09, requesting a Tentative Map to subdivide a 1. II-acre lot into six (6) residential lots; and WHEREAS, the property affected by TM 99-09 is located at the southeast comer of Wren Avenue and Farrell Avenue, as described in Exhibit A attached hereto; and WHEREAS, the Planning Commission held a duly noticed public hearing on October 7, 1999, following which it considered the record before it on this project and voted to recommend adoption of the Negative Declaration and approval ofTM 99-09 to the City Council; and WHEREAS, the City Council held a duly noticed public hearing on October 18, 1999, at which time the City Council considered the public testimony, the Staff Report dated September 22, 1999, and all other documentation related to application TM 99-09; and WHEREAS, following the public hearing, the City Council, pursuant to the California Environmental Quality Act ("CEQA"), adopted the mitigated Negative Declaration for this project, along with a MitigationIMonitoring program, finding that the environmental impacts study was completed in compliance with CEQA, the Negative Declaration reflects the independent judgment ofthe City, and there is no substantial evidence that the project will have a significant effect on the environment; and \#460724 vi - gilroyfTM 99- 09/RESOL .1. -1- RESOLUTION NO. 99-81 "'- . . WHEREAS, the City Council, in its deliberations, determined that certain conditions not identified in the Staff Report were required to approve this project; and WHEREAS, the location and custodian of the documents or other materials which constitute the record of proceedings upon which this project approval is based is the office of the City Clerk. NOW, THEREFORE, BE IT RESOLVED THAT A. The City Council finds as follows: 1. The project is consistent with the site's land use designation on the General Plan map, and with the intent of the General Plan text. 2. The project is consistent with the Zoning Ordinance, the City's Subdivision and Land Development Code, and the State Subdivision Map Act. 3. There are no facts to support findings requmng denial of the proposed tentative map pursuant to California Govermnent Code section 66474. 4. There is no substantial evidence in the record that this project will have a significant effect on the environment. B. MITIGATION MEASURES #1 THROUGH #5, contained within the Negative Declaration, dated 7-21-99 shall be applied to the approval of the project in order to reduce and/or mitigate all potential significant impacts to a level of insignificance, as required under the California Environmental Quality Act (CEQA). 2. The developer shall obtain Architectural & Site Review approval for the project site prior to development of the project site. Plansfora minimum of three (3) models shall be submitted, subject to review and approval by the Planning Division 3. Prior to City Council approval of the Tract Map and Improvement Plans, the following items shall be completed by the applicant and/or developer: a) A signed original composite plan by the electrical design engineer shall be a part of the improvement plans; b) A letter from the subdivision design civil engineer shall be prepared which states that the composite plan complies with City Codes and Standards and that no underground utility conflict exists; c) "Will Serve Letters" from each utility company for the subdivision shall be supplied to the City; and d) The plan check and inspection fee for the utility underground work will be collected by the City. The above items shall be subject to review and approval by the Engineering Division. 4. Prior to any construction of the utilities in the field, the applicant and/or developer shall submit the following items to the City Engineering Division for review and approval: a) A signed and PG&E-approved original electric plan; and b) A letter from the design Civil Engineer which states that electrical plans conform with City Codes and Standards, and with the approved subdivision improvement plans. S. All grading operations and soil compaction activities shall be per the approved soils report, subject to review and approval by the Engineering Division. 6. All existing water wells shall be sealed to meet the approval of the City Engineer and the Santa Clara Valley Water District (SCVWD). 7. The developer shall implement and follow the Santa Clara Valley Urban Runoff Pollution Prevention Program's recomrnended Best Management Practices (BMP) for construction activities, as contained in the California Storm Water Construction BMP Handbook, subject to review and approval by the Engineering Division. 8. 9. 13. Street improvements and the design of all storm drainage, sewer and water lines, and all street sections and widths shall be subject to the review and approval of Engineering Division. All utilities to, through, and on the site shall be constructed underground, in accordance with Municipal Code Section 21.120, subject to the review and approval of Engineering Division. 11. Subdivider shall defend, indemnifY, and hold harmless the City, its City Council, Planning Commission, agents, officers, and employees from any claim,' action, or proceeding against the City or its City Council, Planning Commission, agents, officers, and employees to attack, set aside, void, or annul an approval of the City, City CounciL Planning Commission, or other board, advisory agency, or legislative body concerning this subdivision. City will promptly notifY the subdivider of any claim, action, or proceeding against it, and will cooperate fully in the defense. This condition is imposed pursuant to California Government Code Section 66474.9. 12. An all-weather access road, not less than 20 feet in width, for fire apparatus shall be provided before commencing any combustible construction. Fire hydrants shall also be installed and maintained before combustible construction begins, subject to review and approval by the Building, Life, and Environmental Safety Division. Hydrant locations and water main sizing shall be approved by the Building, Life, & Environmental Safety Division, prior to building permit issuance. 14. Dead-end access roads, in excess of one hundred fifty (ISO) feet in length, shall enable fire engines to turn around. Turning radii shall not be less than thirty-nine (39) feet, subject to the review and approval of the Building, Life, & Environmental Safety Division. The developer shall provide street trees in accordance with the City's COllsolidated Landscapillg Policy, subject to review and approval by the Community Services Department.
