RESOLUTION NO. 99-82
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
GILROY APPROVING TM 99-10, A TENTATIVE MAP TO
CREATE TWELVE SINGLE-FAMILY LOTS AND THREE
REMAINDER PARCELS ON APPROXIMATELY 9.78 ACRES
LOCATED AT THE NORTHEAST CORNER OF SANTA
TERESA BOULEVARD AND MANTELLI DRIVE, APN 790-
04-070.
WHEREAS, Dividend Homes, Inc. ("Applicant") submitted TM 99-10, requesting a
Tentative Map to subdivide a 9.78-acre lot into twelve (12) single-family lots and three (3)
remainder parcels; and
WHEREAS, the property affected by TM 99-10 is located at the northeast comer Santa
Teresa Boulevard and Mantelli Drive, as described in Exhibit A attached hereto; and
WHEREAS, the Planning Commission held a duly noticed public hearing on October 7,
1999, following which it considered the record before it on this project and voted to recommend
adoption of the mitigated Negative Declaration and approval of TM 99-10 to the City
Council; and
WHEREAS, the City Council held a duly noticed public hearing on October 18, 1999, at
which time the City Council considered the public testimony, the Staff Report dated September
20, 1999, and all other documentation related to application TM 99-10; and
WHEREAS, following the public hearing, the City Council, pursuant to the California
Environmental Quality Act ("CEQA"), adopted the mitigated Negative Declaration for this
project, along with a Mitigation/Monitoring program, fmding that the environmental impacts
study was completed in compliance with CEQA, the Negative Declaration reflects the

independent judgment of the City, and there is no substantial evidence that the project will have a
significant effect on the environment; and
WHEREAS, the location and custodian of the documents or other materials which
constitute the record of proceedings upon which this project approval is based is the office of the
City Clerk.
NOW, THEREFORE, BE IT RESOLVED THAT
A. The City Council finds as follows:
1. The project is consistent with the site's land use designation on the
General Plan map, and with the intent ofthe General Plan text.
2. The project is consistent with the Zoning Ordinance, the City's
Subdivision and Land Development Code, and the State Subdivision
Map Act.
3. There are no facts to support findings requITIng denial of the
proposed tentative map pursuant to California Government Code
section 66474.
4. There is no substantial evidence in the record that this project will
have a significant effect on the environment.

B. Tentative Map TM 99-10 should be and hereby is approved, subject to:
1. The fifteen (15) conditions identified in the Staff Report for the
project dated September 20, 1999, attached hereto as Exhibit B, and
2. The seven (7) mitigation measures set forth in the Negative
Declaration, attached hereto as Exhibit C, and the MitigationIMonitoring
Program, attached hereto as Exhibit D, all above-described exhibits
incorporated herein by this reference.

NEGATIVE DECLARATION
An Initial Study was prepared for the proposed project by the City'S independent environmental
consultant (Denise DullY lIDd Associates) in August 1999. The study was completed in comp1iance with
CEQA and reflects the independentjudgctnent of the City. The study identified potentially significant
elfects on the environment, however, the applicant has agreed to individual mitigation measures whic:h
will avoid or mitigate tbe effects to a point where no significant impacts will 0=.
The Initial Study was circulated for a 21-day period ending 9-01-99. There is no substantial cvidenc;c
that the proposed project may have a significant effi:c:t on the environment. Therefore. a Negative
Declaration ("Exhibit An) with seven (7) mitigation measures and Mitigation Monitoring ProgtmD
("Exhibit Bn) have been prepared.
BJlO'RArKG1l0TIND:
The Residential Development Ordinance (ROO) contains an exemption within Section 50.62 (b) (1).
under which the applicant proposes to develop. This exemption allows up to 6 units to be constrUcted
per year (not exceedin.g 12 units in 3 years) withOllt competing in the ROO process. In addition, the
applicant bas submitted an application (RO 99-01) to obtain 33 units through the 1999 Residential
Development Ordinance (lIDO) allocation process.

The applicant requests Tentative Map approval in order to subdivide a 9.7s,1: acre parcel into 12 single-
family Iou and three remainder parcels. The applicam plans to ultimately develop the site's remainder
parcels with J 3 additional dwellings (23 single-family and 10 duplex units) once eligible to do so. The
undeve10ped project site is located in the northwest portion of the City, at the planned northeast comer
of Santa T c:resa Boulevan:l and MantelIi Drive. Existing residential dwelliDgs arc located to the east and
west of the site. A water district cbllDlle1 is located immediately north of the site. New residential
developments are underway further to the north. as well as to the south.
This Tentative Map will create 12 r=idmtiallots, ranging from 6,022;1: to 7,644=" square feet. The site's
RI (Single Family ResidClltial) zolliDg designation allows . maximum build-aut density of7.2S units per
net acre. Buildout of the 12 lots on the 1.72 net-acre site will establish a density of6.98 units pernel
acre. Ultimate bui1dout of tbe entire propertY will establish a density of 7.05 units per net acre.
Therefore, development of the project site will not eltCeed the maximum allowable density with
development of either the initial 12 units or the additional 33 units.
Mantelli Drive lmprovemenla
Signalization improvements for the Mantelli Drive/Santa Teresa Boulevard intersection are currently
being desigl1ec1 and plllDlled for constIuction in fiscal years 200112002, acccrdiug to the City's Capital
Improvement Budget (CIB). The ManteUi Drive "gap closure" portion of this capital iInprovement
project is scheduled to immediately follow the signaliza.tion improvements.
Access to the project site will be provided through the construction of II new local street via Mantelli
Drive. As. condition of project approval, the applicant is required to construct street, sidewalk, curb,

2. A letter from the 1lUbdivision design civil engineer shall be prepared which states that the
composite p1al\ cl.>mplies with City Codes and Standards and that no underground utility
conflict exists;
3. "Will SeTVe Leners" from each utility company for the subdivision shall be supplied to the
City; and
4. The plan check and inspection fee for the utility underground work will be collected by the
City.
The above items shall be subject to review and approval by the Engineering Division.
5. Priarto any constrUCtion of the utilities in the field. the applicant iUldfor developer sball submit the
following items to the City Engineering Division for review and approval:
a) A signed and PG&E.approved onpw electric plan; and
b) A letter from the design Civil Engineer which states that electriQ) plans confonn with City
Codes and Standards, and with the approved subdivision improvement plans.
