RESOLUTION NO. 2000-11 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF GILROY INITIATING PROCEEDINGS FOR THE ANNUAL LEVY OF ASSESSMENTS FOR MAINTENANCE DISTRICT NO. I, EXCEPT FOR TERRITORY WITIllN ANNEXATION No. 3, FOR FISCAL YEAR 2000/2001. WHEREAS, the City Council has, by previous resolutions, formed Maintenance District No. I ("the District") and provided for the annexation of territory into the District; and WHEREAS, the City Council on February 22, 2000 by Resolution No. 2000- 9 annexed that certain territory described in said Resolution and known as Annexation No.3, and also levied the assessments on the property in Annexation No.3 for Fiscal Year 2000/2001; and WHEREAS, the City Council now intends to initiate proceedings for fiscal year 2000/2001 pursuant to the provisions of the City of Gilroy Maintenance District Act, Article N of Chapter 12A of the Gilroy City Code ("Code") to provide for the levy and collection of assessments by the County of Santa Clara on behalf of the City of Gilroy to pay the maintenance and service costs of all improvements and facilities related to the remaining territory included in Maintenance District No. I, hereinafter referred to as "the Remainder District"; and WHEREAS, the City Council has retained NBS Govemment Finance Group ("NBS") for the purpose of assisting with the annual levy on the Remainder District, and to assist in preparing and filing a report known as the "Annual Engineer's Report" on behalf of the Community Development Director in accordance with the Code. NOW, THEREFORE, BE IT RESOLVED THAT: A. The City Council hereby orders NBS on behalf of the Community Development Director to prepare the Annual Engineer's Report concerning the levy of assessments for the \KHM\436201.2 01-022804706030 -1- Resolution 2000-11 . . Remainder District in accordance with Section 12A.203 of the Code. B. The City Council hereby finds that the improvements within the Remainder District shall include special maintenance of improvements related to the streets, sewer systems, storm drain systems, water systems and all related appurtenant facilities that may be the result of higher elevations, steep terrain, and narrow streets within the Gilroy Country Club Estates, the Forest, and Carriage Hills tracts. The Annual Engineer's Report will describe all new improvements or substantial changes in existing improvements.
