RESOLUTION NO. 2000-57
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
GILROY AMENDING THE CITY OF GILROY CONFLICT OF
INTEREST CODE TO ADD POSITIONS AND CHANGE THE
TITLES OF CERTAIN PERSONS SUBJECT TO THE CODE
WHEREAS, the Political Reform Act, Government Code section 81000 et seq., requires
state and local agencies to adopt and promulgate conflict of interest codes, and the City of Gilroy
("City") is an agency subject to said statute; and
WHEREAS, the City has adopted the terms of2 Cal. Code of Regs. section 18730, and any
amendments thereto, taken with appendices prepared and adopted by the City, as the Conflict of
Interest Code of the City; and
WHEREAS, the City has reorganized, causing the titles of persons designated by the City's
Conflict of Interest Code to be changed; and
WHEREAS, this reorganization created the position of Deputy Director of Community
Development; caused the Planning Division Manager to added as a designated employee; caused
the Purchasing Technician and/or Purchasing Agent to be the newly named Purchasing
Coordinator; and caused the Building Official to be the newly named Chief Building Official; and
WHEREAS, the changed City titles supersede those designated in the City's Conflict of
Interest Code and it is the intent of the City that the newly named positions remain subject to the
City's Conflict of Interest Code; and
WHEREAS, it is the intent of the City to modifY Appendix I of Res. 95-88 to reflect these
changes;
NOW, THEREFORE, BE IT RESOLVED THAT:

Appendix I to Res. 95-88 regarding the City's Conflict of Interest Code, designating the
employees who shall be subject to the City's Conflict of Interest Code, shall be deleted in its
entirety and replaced with Appendix I as set forth in Exhibit I, attached hereto and incorporated
herein by this reference:

Only those interests which are relevant to the consultant's engagement are required to be disclosed. The
appropriate interest to be discloscd shall be determincd by thc City Administrator in conjunction with the City
Attorney. Such determination shall include a description of the duties of the consultant and, based upon that
description, a statement of thc extent of disclosure requircments. The City Administrators determination shall be in
writing, is a public record, and shall be retained for public inspection in the same manncr and location as this conflict
of interest code.
All agreements with a consultant, whether or not such consultant is required to file a disclosure statement in
accordancc with this rcsolution, shall contain a certification by the consultant that no conflict of interest exists in
connection with the contract bcing entered into betwcen thc consultant and the city.

Resolution No. 2000-57 is an original resolution, duly adopted by the Council of the City of
Gilroy at a regular meeting of said Council held on the 5th day of September, 2000, at which
