RESOLUTION NO. 2001-27
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF GILROY
DECLARING RESULTS OF SPECIAL ELECTION
AND DIRECTING RECORDING OF NOTICE OF ABANDONMENT

RESOLVED, by the City Council (the "Council") of the City of Gilroy (the "City"),
County of Santa Clara, State of California that
WHEREAS, in proceedings heretofore conducted by this Council pursuant to Mello-
Roos Community Facilities Act of 1982, Chapter 2.5 of Part 1 of Division 2 of Title 5,
commencing with Section 53311, of the California Government Code (the" Act"), this Council
adopted on September 7, 1999, its Resolution No. 99-76, being a resolution of intention (the
"Resolution of Intention") to establish the City's Community Facilities District No. 1 (the
HCFDIf);
WHEREAS, under the Act and subsequent proceedings under the Resolution of
Intention, this Council conducted a special election in and for the CFD among the resident
registered voters of the CFD on March 7, 2000 on the of the levy of a special tax within the CFD
to pay for fire protection services;
WHEREAS, at the election, the issue presented failed to receive the approval of at least
2j3rds of the qualified voters voting at the election
NOW, THEREFORE, IT IS HEREBY ORDERED as follows:

1. Measure Not Approved. This Council hereby formally determines that the issue of
the levy of the special tax for the CFD failed to receive the approval of 2j3rds of the qualified
electors voting at the special CFD election as required by the Act.
2. Proceedin~s Abandoned. Based upon the result of the election" this Council hereby
orders that all proceedings for the CFD be abandoned and that the City Oerk shall cause to be
prepared and recorded a suitable notice of abandonment of proceedings pursuant to Section
3117 of the California Street and Highways Code.
3. Resolution Effective. This Resolution shall take effect upon its adoption.
