Resolution 2001-34 RESOLUTION NO. 2001-34 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF GILROY PROPOSING AN AMENDMENT TO THE CITY CHARTER AND DIRECTING SAID AMENDMENT TO BE SUBMITTED TO THE ELECTORS OF THE CITY WHEREAS, pursuant to the Charter of the City of Gilroy Section 1505 and Government Code section 34458, the City Council is authorized to propose amendments to the Charter and submit said amendments to the electors of this City for ratification; and WHEREAS, the California Government Code section 36934 provides that after the reading of the title of a proposed ordinance, further reading may be waived by regular motion adopted by a majority vote ofthe local legislative body; and WHEREAS, the City Council desires to propose an amendment to the Charter relating to the necessary vote required to waive the reading of an ordinance in full at the time it is introduced; and WHEREAS, the existing Charter provision proposed for amendment is Section 60 I. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF GILROY as follows: Section I. Pursuant to law, this City Council proposes the herein described amendment to the Charter of the City of Gilroy and directs that the herein described amendment shall be duly submitted to the electors of said City for ratification at a special municipal election, said election to be consolidated with the general municipal election to be held on November 6, 2001. Section 2. To modify one provision of the Charter, the Charter proposed to be amended as follows: UH\518883.1 01-060604706002 -1- RESOLUTION NO. 2001-34 By amending Section 601 so that Section 601 of the Charter shall read in its entirety as follows: Section 601. Adoption of Ordinances. Each ordinance shall be introduced in writing. With the sole exception of ordinances which take effect upon adoption, referred to in this Article, no ordinance shall be adopted by the Council on the day of its introduction, nor within six (6) days thereafter, nor at any time other than a regular or adjourned regular meeting, nor until such ordinance shall have been published as required by this Charter. At the time of the introduction of an ordinance, it shall be read in full, unless after the reading of the title thereof, the further reading thereof is waived by a majority vote of the Councilmembers present. In the event that any ordinance is altered after its introduction, the same shall not be finally adopted except at a regular or adjourned regular meeting held not less than six (6) days after the date upon which such ordinance was so altered. The correction of typographical or clerical errors shall not constitute the making of an alteration within the meaning of the foregoing sentence. Section 60 I currently reads as follows: Section 601.
