RESOLUTION NO. 2002-13
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF GILROY
AUTHORIZlNG THE FILING OF AN APPLICATION FOR FEDERAL SURFACE
TRANSPORTATION FUNDS THROUGH THE METROPOLITAN TRANSPORTATION
COMMISSION'S TRANSPORTATION FOR LIVABLE COMMUNITIES PROGRAM
FOR THE MONTEREY STREETSCAPE IMPROVEMENT PROJECT AND
COMMITTING THE NECESSARY WCAL MATCH FOR THE PROJECT AND
STATING THE ASSURANCE OF THE CITY OF GILROY TO COMPLETE THE
PROJECT
Whereas, the Trnnsportation Equity Act for the 21" Century (TEA 21) (Public Law 105-178, June 9, 1998)
and the TEA 21 Restoration Act (Public Law 105-2006, July 22,1998) continne the Snrface Trnnsportation
Program, the Congestion IvIitigation and Air Quality Improvement Program, and the Enhancements Activities
Program; and
Whereas, pnrsnant to TEA 21 and the regulations promulgated therennder, eligible project sjXlnsors
wishing to receive federal trnnsportation grnnts for a project sball snbmit an application first with the appropriate
metrojXllitan trnnsportation planning organization (MPO) for review and considerntion in the MPO's Trnnsportation
Improvement Program (ITP); and
Whereas, the MetrOjXllitan Trnnsportation Commission (MfC) is the San Francisco Bay Area's MPO; and
Whereas, the City of Gilroy is an eligible project sponsor for federal trnnsjXlrtation funds; and
Whereas, the City of Gilroy wishes to receive federal trnnsportation funds throngh MTC's Trnnsportation
for Livable Commnnities (TLC) Program's capital grnnts or honsing incentive program (HIP) funds for the
following project:
Monterey Streetscape Improvements: Monterey Street between 6th and 7th Streets; and
Whereas, MfC requires a resolntion stating the following:
I) the commitment of necessaIy local matching funds of at least II. 50/0; and
2) that the sponsor nnderstands that the federal funding throngh the TLC program is fixed at the programmed
amonnt, and therefore any cost increase cannot be expected to be funded through the TLC program; and
3) the assnrance of the sponsor to complete the project as described in the application, and if approved, as
programmed in MfC's TIP; and
4) that the SjXlRSOr nnderstands that funds must be obligated by September 30. 2003 for TLC capital projects
and September 30, 2004 for HIP projects, or the project may be removed from the program.
NOW, THERFORE, BE IT RESOLVED by the City Conncil of the City of Gilroy that the City of
Gilroy is authorized to proceed with the federal-aid process with Caltrnns for TLC funding in tbe amonnt of
$1,474,000 for the Monterey Streetscape Improvements: Monterey Street between 6th and 7th Streets; and
BE IT FURTHER RESOLVED that the City Conncil of the City of Gilroy by adopting this resolution
hereby states that:
I) the City of Gilroy will provide $192,000 in local matching funds; and
2) the City of Gilroy nnderstands that the TLC Program funding for the project is fixed at $1,474,000, and
that any cost increases must be funded by the City of Gilroy from local matching funds, and that
the City of Gilroy does not expect any cost increases to be funded through the TLC program; and

3) the Monterey Streetscape Improvement Project will be bnilt as described in this resolntion and snbmitted
application and, if approved, for the amonnt shown in the MetrojXllitan TrnnsjXlrtation Commission
(MTC) TrnnsjXlrtation Improvement Program (TIP) with obligation occnrring within the timeltame
established below; and
4) the program funds will be obligated by September 30, 2003 for TLC capital projects and
September 30, 2004 for HIP projects.
BE IT FURTHER RESOLVED that a copy oflhis resolntion will be transmitted to MTC.
