A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
GILROY APPROVING AlS 02-05, AN APPLICATION FOR
ARCHITECTURAL AND SITE APPROVAL OF A PLANNED
UNIT DEVELOPMENT (PUD) ON APPROXIMATELY 53,231
SQUARE FEET, APN 799-17-066.
WHEREAS, the City of Gilroy, the applicant, submitted AlS 02-05, an application for
architectural and site approval of a Planned Unit Development ("PUD") for construction of a new
public library on approximately 53,231 square feet, located on the area between Hanna and Rosanna
Streets fronting on Sixth Street; and
WHEREAS, pursuant to the California Environmental Quality Act (CEQA), a Negative
Declaration was prepared and circulated for public comment; and
WHEREAS, the Planning Commission held a duly noticed public hearing on May 23, 2002,
at which time the Planning Commission considered the public testimony, the Staff Report dated
May 17, 2002 and all other documentation related to application AlS 02-05, and recommended that
the City Council adopt the negative declaration and approve said application; and
WHEREAS, the City Council held a duly noticed public hearing on June 3, 2002, at which
time the City Council considered the public testimony, the Staff Report dated May 28, 2002 and all
other documentation related to application AlS 02-05; and
WHEREAS, pursuant to CEQA, the City Council adopted the Mitigated Negative
Declaration on June 3, 2002, finding that it was completed in compliance with CEQA, that it reflects
the independent judgement of the City and that there is no substantial evidence that the project will
have a significant effect on the environment; and

SECTION I
WHEREAS, the location and custodian of the documents or other materials which constitute
the record of proceedings upon which this project approval is based is the office of the City Clerk.
NOW, THEREFORE, BE IT RESOLVED THAT:
A. The City Council hereby adopts the findings as required by Zoning Ordinance section
50.55 based upon substantial evidence in the record.
1. The project conforms to the Gilroy General Plan in terms of general location
and standards of development.
2. The proposed development fulfills a specific need of the surrounding area.
3. The project does not require urban services beyond those which are available
at this project site.
4. The project plan is harmonious and integrated.
5. The project reflects an economical and efficient use of this property.
6. The project includes landscaping provisions which will meet the intent of the
Planned Unit Development ordinance.
7. The proposed building is both appropriate for a public library and will
harmonize with the existing Civic Center structures.
8. All impacts from traffic congestion, noise or other adverse effects will be
mitigated to the extent feasible.
9. The project provides adequate access, landscaping, trash areas and storage, as
necessary.

SECTION II
This Resolution shall not become effective unless and until Z 01-09, Ordinance No. 2002-10
takes effect, and AlS 02-05 is not approved unless and until Ordinance No. 2002-10 takes
effect.

ENVIRONMENTAL IMPACTS:
NEGATIVE DECLARATION
An Initial Study was prepared for the project by Denise Duffy and Associates, an independent consultant,
on May 15, 2002. The study was completed in compliance with CEQA Guidelines and reflects the
independent judgment ofthe City. The Initial Study recommended 26 mitigation measures. A
Negative Declaration, dated April 18, 2002, was prepared and was posted for a 20-day period. There is no
substantial evidence that the proposed project would have an effect on the environment.

CONFORMANCE WITH THE GENERAL PLAN
This request is in general conformance with the existing General Plan which recognizes the Civic Center uses.
This request is in conformance with the newly completed Civic Center Master Plan, which identifies the
expansion of the Civic Center uses, and it is in conformance with the Draft 2020 General Plan.
ANALYSIS OF REQUEST:
This is an Architectural & Site Review (PUD) request for approval ofthe construction of a new 53,231
square foot Public Library. The Gilroy Library Service area extends beyond city limits. In 2000, the
population of the service area was approximately 42,500. The Santa Clara County Library has projected
the service area population through 2015 at approximately 65,800. By extrapolation, the service area
population in 2020 would be approximately 70,000. Prior to the start of construction the existing library
building will be demolished and the new construction will take its place.
Architectural & Site Review issues are:
y Bnilding Architecture
The building is designed to complement existing Civic Center structures. It will be a two story facility
specifically designed so that the second story is set back from the fayade of the first story. The building
height to the peak of the roof is 48 feet maximum. This is 13 feet higher than allowed in the more
restrictive Single Family Residential (Rl) district across Sixth Street. Although the PUD district allows
this variance in height, the Library's second story was setback so that the structure fayade would not
have the full impact of a typical two-story building. The building proposal shows various trellis
structures around the outside of the building. These structures will compliment the existing trellises at
the entrances to City Hall.
y Bnilding Materials
The building's exterior materials are intended to complement the existing City Hall structure. The
Library will have stucco walls, a more expansive use of windows and glass and a roof material that is
consistent in texture to the adjacent City Hall.
y Building Colors
Colors may vary from existing structures but they will be complimentary. The stucco walls will be in
the brown to beige pallet consistent with the Senior Center and City Hall and there will be accent
coloring in the glass and the other building detailing. Roofing will be a reddish color consistent in tone
to the adjacent City Hall.
y Parking
Fifty-six parking spaces are being constructed with this project. The spaces will exist between the
building and Sixth Street. There are additional spaces for Library patrons on both Rosanna and Hanna
Streets, which when the phasing in the Civic Center Master Plan is implemented, will close those
streets to through traffic. The parking spaces on Hanna will be upgraded with the proposed Police
Facility development and the Rosanna Street spaces are upgraded as part of the Master Plan phasing.
The Lihrary will meet the Civic Center shared parking standard on.3 spaces per 1000 SF as detailed in
the Initial Study Parking Report and the Civic Center Master Plan. This standard is compatible with
the Zoning Ordinance parking standards.

~ Landscaping
The PUD requires superior landscaping and other design amenities in exchange for variance from the
Zoning Ordinance. The landscape concept plan submitted with this application shows tree sizes greater
than the minimum size required by the ordinance. Staff has been working with the Architect to meet
minimum parking landscape requirements and this discussion is still ongoing. There are also
discrepancies between site plan planting areas and the conceptual landscape design. Staffhas requested
that there be tree planters shown next to the building and these are shown on the landscape concept but
still need to be shown on the site plan. All of the mature trees along Sixth Street frontage will be
maintained as will the existing earth berm which will help screen the parking.
Additionally, there still needs to be discussion with the Architect concerning the landscape at the rear of
the Library building as it does not appear to be in compliance with the newly completed Civic Center
Master Plan.
RECOMMENDATION
The Planning Commission forwards a recommendation of APPROVAL with no changes (5-0-2,
Commissioners Tucker and ADen absent) to the City Council for this Architectnral and Site Review
(PUD) request, subject to the following 19 conditions:

1. The applicant will implement the Mitigation Measures of the Initial Study, subject to the
review and approval of the responsible City Divisions.
2. At the time of Building Permit submittal all of the Conditions of the Staff Report will be listed on
the construction drawings in a prominent place at the front of the drawing set.
3. The ordinance for parking lot landscaping requires that 50SF oflandscaped area be provided for
each 12 spaces. This requirement will be reviewed and the site plan and landscape plan will be
coordinated to meet this requirement.
4. The Sixth Street building favade must provide room for the growth oflarge species trees to help
maintain the character ofthe existing Civic Center Complex.
5. Landscape design construction documents will be reviewed to insure that there is continuity with
surrounding existing plant species.
6. The area between the rear of this building and the existing City Hall will be reviewed to insure
compatibility with the Civic Center Master plan.
7. This project shall comply with the Zoning Ordinance Section 41, Performance Standards.
8. Mechanical Appurtenances: Mechanical equipment to be located on the roof of a building shall be
screened by an architectural feature ofthe building, such that it cannot be seen from ground level at
the far side ofthe adjacent public right-of-way, whenever possible.
9. Exterior Lighting: freestanding poles will match either ofthe two existing styles, wall mounted
lighting will be focused so that light does not radiate outward.

10. Landscaping plans including specifications for an irrigation system shall be approved by the
Planning Division in accordance with the adopted Consolidated Landscaping Policy, prior to
issuance of a building permit. The landscaping shall be continuously maintained in an orderly, live,
healthy, and relatively weed-free condition, in accordance with the adopted Consolidated
Landscaping Policy and the approved specific landscape plan.

11. Sidewalks will require replacement.

13. Occupant Load exceeds 50 in most areas, therefore this is an A3 occupancy not a B.
14. Building is over area for an A3 occupancy, therefore sprinklers may not be used for fire resistive
substitution.
15. Exiting through intervening rooms is not permitted in some areas and shall comply with CBC
Chapter 10.
16. Provide fire hydrants to within 150' ofall exterior building points to provide the required fire flow.
17. Separate plan and permits are required for the following: underground fire main, fire sprinklers, and
fire alarm.

18. Street trees shall be required according to the City's Consolidated Landscape Policy. Contact the

The Building Division has performed a cursory review of preliminary plans submitted to the
Planning Division for the application noted above. The plans will require compliance with the
following informational items and conditions of approval at the time of building permit
submittal:
CONDITIONS:
I. DESIGN PROFESSIONAL -This project will require a State of California registered design
professional to design, stamp and wet sign the construction plans.
2. BUILDING CODES - All construction shall comply with Building, Mechanical, Plumbing,
Electrical, T-24 Energy and Accessibility, and City codes in effect at the time of issuance of
the building permits resulting in actual construction.

3. SOILS REPORT - A soils report shall be submitted containing design recommendations for

4. FOUNDATIONS - All mitigation measures and design recommendations identified in the
soils report approved by the Building Official, MUST be reviewed by the soils engineer of
record for conformance. Structural foundation design plans must also be reviewed by the
soils Engineer of record for conformance to recommendations contained within the soils
report.
5. FOUNDATION INSPECTIONS - Prior to requesting a Building Department foundation
inspection, the soils engineer shall inspect and approve the mitigation measures and the
foundation excavations. The soils engineer shall submit documentation to the Building
Division which verifies compliance with the recommendations specified in the soils report.

6. SPECIAL INSPECTIG - In addition to the inspections by CE Jec. 108, the owner or
the engineer or architect of record acting as the owners agent shall employ one or more
special inspectors who shall provide special inspections when required by CBC section 1701.
Please contact the Building Division at the time of plan submittal to obtain an application for
special inspections.
7. STRUCTURAL CALCULATIONS - Provide Structural Calculations verifYing compliance
with all applicable provisions of the Uniform Building code Chapter 16. Prior to request for
final inspection, written verification by the engineer of record indicating conformance with
the structural design shall be submitted to the Gilroy Building Division.
8. DEMOLITION - Demolition permits will be issued in accordance with City Ordinance.
Prior to permit issuance: Submit a plot clearly showing the location and the portion of
building or the building to be demolished, a completed application for Demolition, a Bay
Area Air Quality Management District ".r' number, and obtain approval from the Building
Official for the scope of work. The forms necessary are available at the Building Counter.
Any Building over 50 years old may also require Historic Heritage Committee approval prior
to demolition. Check with the Planning Division for any additional requirements.
9. GRADING AND SHORING - A site development permit shall be required for all grading
and shoring work. Shoring plans, calculations, etc., must be reviewed and approved by
Building Division.
10. NOTICE OF EXCAVATION - Prior to excavation, adjoining landowners shall be given
notice of the date, location, and extent of excavation in conformity with Section 832 ofthe
Civil Code and copies shall be provided to the Building Official prior to issuance of grading
permit.
11. Bathroom facilities must meet the number of fixtures required by State and Federal
regulations. Assembly facilities and buildings are required to provide higher number of
fixtures in women's bathrooms.
12. T-24 ACCESSIBILITY/COMMERCIAL - The developer shall comply with all applicable
provisions of Chapter 11 of the California Building Code (Title 24) for Disabled Access.

15. PRE-CONSTRUCTION CONFERENCE - A pre-construction conference shall be held at a
time and location agreed upon by the City and applicant for the purpose of review and
approval of construction procedures. The building owner/developer shall be represented by
his designer and construction staff. The City will be represented by departments having
conditions of approval on the project.

Findings & Reasons:
The Initial Study identified potentially significant effects on the environment. However, this
project has been mitigated (see Mitigation Measures below which avoid or mitigate the
effects) to a point where no significant effects will occur. There is no substantial evidence the
project may have a significant effect on the environment. The following reasons will support
these findings:
y The proposal is a logical component of the existing land use of this area and a logical and
necessary expansion of Civic Center functions.

y Identified adverse impacts are proposed to be mitigated through preparation of special
studies and construction of on-site improvements.
y The proposed project is consistent with the adopted goals and policies of the General Plan
of the City of Gilroy.
y City staff independently reviewed the Initial Study, and this Negative Declaration reflects
the independent judgment of the City of Gilroy.
y With the application of the following Mitigation Measures the proposed project will not
have any significant impacts on the environment.
Mitigation Measures:
1. The following dust control measures shall be incorporated into all permits for any phase of
proposed construction on the project site, The measures shall be implemented as
necessary to adequately control dust, subject to the review and approval of the Gilroy
Engineering Division.
. The following measures shall be implemented at all construction sites:
. Water all active construction areas at least twice daily;
. Cover all trucks hauling soil, sand, and other loose materials or require all trucks
to maintain at least two feet of freeboard;
. Pave, apply water three times daily, or apply (non-toxic) soil stabilizers on all
unpaved access roads, parking areas and staging areas at construction sites;
. Sweep daily (with water sweepers) all paved access roads, parking areas and
staging areas at construction sites;
Subject to determination by the Gilroy Engineering Division, the following measures
may be implemented at construction sites that are very large or are located near
sensitive receptors:
. Install wheel washers for all existing trucks, or wash off the tires of all tucks and
equipment leaving the site;
. Suspend excavation and grading activity when winds (instantaneous gusts) exceed
25 miles per hour;
. Limit the area subject to excavation, grading and other construction activity at any
one time.

2. If archaeological or paleontological resources or human remains are accidentally
discovered during construction, work shall be halted within 200 feet of the find until it can
be evaluated by a qualified professional archaeologist. If the find is determined to be
significant, appropriate mitigation measures shall be formulated and implemented based on
CEQA Guidelines Section 15064,5. This mitigation measure shall be subject to Gilroy
Planning Division review and approval.
3. If human remains are accidentally discovered during construction, there shall be no further
excavation or disturbance of the site or any nearby area reasonably suspected to overlie
adjacent human remains until the coroner of Santa Clara County is contacted to determine
that no investigation of the cause of death is required. If the coroner determines the
remains to be Native American the coroner shall contact the Native American Heritage
Commission within 24 hours. The Native American Heritage Commission shall identify
the person or persons it believes to be them most likely descendent (MLD) from the
deceased Native American. The MLD may then make recommendations to the landowner
or the person responsible for the excavation work, for means of treating or disposing of,
with appropriate dignity, the human remains and associated grave goods as provided in
Public Resources Code Section 5097.98. The landowner or his authorized representative
shall re-bury the Native American human remains and associated grave goods with
appropriate dignity on the property in a location not subject to further disturbance if: a)
the Native American Heritage Commission is unable to identify a MLD or the MLD failed
to make a recommendation within 24 hours after being notified by the commission; b) the
descendent identified fails to make a recommendation; or c) the landowner or his
authorized representative rejects the recommendation of the descendent, and the
mediation by the Native American Heritage Commission fails to provide measures
acceptable to the landowner. This mitigation measure shall be subject to Gilroy Planning
Division review and approval.
4. All potentially friable asbestos-containing material shall be removed prior to building
removal in accordance with National Emissions Standards for Hazardous Air Pollutants
guidelines. This mitigation shall be subject to Gilroy Building Division review and
approval,
5. The contractor, in a manner and method acceptable under applicable standards and laws,
shall abate all hazardous materials in compliance with a report of survey and abatement
plan, supplied by the contractor. This mitigation shall be subject to Gilroy Building
Division review and approval.
6. The building removal will involve the legal transportation and disposal of asbestos-
containing materials and lead-based paint. The project shall adhere to the applicable
regulations governing transportation and disposal of these materials. This mitigation shall
be subject to Gilroy Building Division review and approval.
7. The project shall follow the regulations outlined by CalIOSHA Lead in Construction
Standard, Title 8, California Code of Regulations (CCR) 1532.1 during building removal
activities. These regulations include employee training, air monitoring, and dust control.
This mitigation shall be subject to Gilroy Building Division review and approval.

8, Once plans are developed showing the placement of roof-top mechanical equipment, and
the number and type of the equipment are known, the project plans shall be reviewed by
an acoustical specialist to calculate if the limits established in the noise performance
standards would be met. Noise attenuating measures would be required if the noise
performance standards are exceeded. This mitigation shall be subject to Gilroy Building
Division review and approval,
9. The emergency diesel generator shall be located in an area on the project site to minimize
the noise received at residential receivers. Packaged diesel units are available with noise
attenuating enclosures that would help maintain maximum noise levels below the 75 dBA
maximum noise level limit depending on the placement of the unit. Diesel generators can
also be screened by noise barriers to reduce noise levels to acceptable levels. The final
design of the diesel generator shall be reviewed by an acoustical specialist once the
location and type of equipment is selected. This mitigation shall be subject to Gilroy
Building Division review and approval.
10. The emergency diesel generator shall be tested regularly during a daytime hour (e,g"
Wednesdays at 12:00 p.m.) to reduce the potential for annoyance at the adjacent
residential land uses, Testing the emergency diesel generator shall be prohibited during
noise-sensitive early morning, evening, or nighttime hours. This mitigation shall be subject
to Gilroy Police Department review and approval.

II, Noise-generating activities outdoors at the construction site or in areas adjacent to the
construction site associated with the project in any way shall be restricted to the hours of
7:00 am to ~ 7:00 p.m., Monday through Friday, and 9:00 am to 7:00 pm on
Saturdays and City holidays. No construction activities shall occur on Sundays. This

12. Construct temporary plywood noise barriers to shield adjacent noise-sensitive land uses
from construction noise prior to the demolition phase of the project. The temporary noise

16. Route all construction traffic to and from the project site via designated truck routes
where possible. Prohibit construction related heavy truck traffic in residential areas where
feasible. This mitigation measure shall be subject to Gilroy Engineering Division
enforcement.
17. Control noise from construction workers' radios to the point where they are not audible at
existing residences bordering the project site. This mitigation measure shall be subject to
Gilroy Building Division enforcement.
18. Notify adjacent residents to the project site of the construction schedule in writing. This
mitigation measure shall be subject to Gilroy Building Division enforcement.
19. Designate a "noise disturbance committee" that is responsible for responding to any local
complaints about construction noise. The committee will be comprised of the Chief of
Police and the Chief Building Official, or their designees, and a neighborhood
representative. The committee will be chaired by the Chief Building Official or designee.
The disturbance committee would determine the cause of the noise complaint (e.g.,
starting too early, bad muffler, etc.) and would require that reasonable measures
warranted to correct the problem be implemented. Conspicuously post a telephone
number for the disturbance committee contact at the construction site and include it in the
notice sent to neighbors regarding the construction schedule. This mitigation measure
shall be subject to Gilroy Building Division enforcement.
20. The Church Street I Sixth Street intersection shall be signalized as the result of the
background plus project phase I traffic conditions, to maintain the City of Gilroy's
required LOS C standards. This mitigation measure shall be subject to Gilroy Engineering
Division review and approval,
21. A formal parking policy shall be developed and implemented for the Civic Center. A
standing Civic Center Use and Impacts Committee will meet a minimum of once per year
(more if necessary) during discussion of the Capital Improvements Budget. The
committee will be comprised of the Chief of Police as chair, the City Engineer, the
Operations Services Manager, the Planning Division Manager, or their designees, and a
member of the Planning Commission. This committee will meet to resolve neighborhood
complaints, develop parking policy, and discuss and resolve impacts on both the Civic
Center and the surrounding neighborhood, This mitigation measure shall be subject to
Gilroy Planning Division review and approval.

22. To ensure that an on-site parking supply ratio of at least 3.3 parking spaces per 1000
square feet can be maintained throughout all the phases of the Gilroy Civic Center Master
Plan, one of the following measures shall be applied; this mitigation shall be subject to
Gilroy Engineering Division review and approval:
>- The implementation of the modifications to the Rosanna Street parking in front of
the Library, planned for Phase IId, should be brought forward to Phase IIa.
>- The implementation of Phase IIa and IIb should be swapped, i.e. Phase IIb should
be implemented prior to Phase IIa,
>- 'The implementation of Phase IIa and IIb should happen simultaneously.
23. The traffic consultant shall develop, with the assistance of the Traffic Engineer, an
assigned City Department parking plan for distributing displaced parking from
construction activities onto neighborhood streets. The displaced parking plan will be
adjusted as necessary to reestablish parking on-site as soon as construction activities
allow. This mitigation measure shall be subject to Gilroy Engineering Division review and
approval.
