Resolution 2003-17 Resolution No. 2003-17 RESOLUTION 2003-17 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF GILROY REPEALING RESOLUTION NO. 2002-15 WHICH WOULD HAVE ESTABLISHED UNDERGROUND UTILITY DISTRICT NO.6 WHEREAS, on March 4, 2002, the City Council of the City of Gilroy held a noticed public hearing and thereafter approved Resolution No. 2002-15; and WHEREAS, Resolution No. 2002-15 would have established Underground Utility District No.6 and ordered the removal of all poles, overhead wires, and associated overhead structures, and the underground installation of wires and facilities for supplying electric, communication, or similar or associated service within Underground Utility District No.6 on or before December 2004; and WHEREAS, Underground Utility District No.6 was to require such undergrounding of poles, overhead wires, and associated overhead structures in the area ("Area") described as: That portion of Santa Teresa Boulevard beginning at a point 900 feet north of the intersection of Santa Teresa Boulevard and Longmeadow Drive and continuing north to Day Road west and this Area being shown on Exhibit A hereto; and WHEREAS, Resolution No. 2002-15 stated that the City intended to utilize PG&E Rule 20A funding for the electric service panel conversation pursuant to which program each service connection would be allotted up to One Thousand Five Hundred Dollars ($1,500.00) toward the cost of an underground service panel, and the property owner would have been responsible for the installation costs for the electric panel conversion to the extent that it exceeds $1,500,000, and also would be responsible for the cost of telephone service panel conversion if required, and maintenance of the conduit and termination box located on, under, or within any structure on the premises, as well as certain other costs; and INVH\577255.2 01.020503.04706002 -1- Resolution No. 2003-17 WHEREAS, it has been determined that certain properties included within Underground Utility District No.6 are not within the City of Gilroy and thus the City is not eligible to receive Rule 20A funding for underground conversion for those properties; and WHEREAS, it is not feasible to pursue the undergrounding of utilities within the Area described as Underground Utility District No.6 if all properties not within the City of Gilroy were excluded from the undergrounding program; and WHEREAS, pursuant to Gilroy City Code Section 26A.2, a public hearing was held on March 3, 2003, at the hour of 7:00 p.m. in the City Council chambers in City Hall, Gilroy, California, to consider the repeal of Resolution No. 2002-15, and all affected property owners were duly noticed in the manner described in Section 26A.2. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Gilroy that: RESOLUTION NO. 2002-15 is hereby repealed and Underground Utility District No.6 is not created.
