RESOLUTION NO. 2003-27
A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF GILROY APPOINTING MICHAEL K.
COOPER, A PROFESSIONAL ENGINEER, AS ACTING
CITY LAND SURVEYOR PURSUANT TO
GOVERNMENT CODE SECTION 66416.5.
WHEREAS, the California Subdivision Map Act, Government Code, Sections 66410 et
seq., ("the Map Act"), Section 66442(b) requires that all parcel and final maps have a statement
that the map is technically correct, signed by a registered civil engineer or licensed land surveyor
that meets certain license qualifications; and
WHEREAS, Section 66416.5 of the Map Act provides that the city engineer may
delegate the land surveying functions to an authorized land surveyor or contract with such a
person if no such person is employed by the city; and
WHEREAS, Harris & Associates is currently under contract with the City of Gilroy
("City"), to provide civil engineering staff support; and
WHEREAS, Michael K. Cooper, a professional engineer, as a representative of Harris &
Associates, meets the land surveyor license qualifications specified in Section 66442(b) of the
Map Act.
THEREFORE, BE IT RESOLVED THAT:
1. The City Council hereby accepts the staff report, attached hereto as Exhibit "A" and
incorporated by this reference, and based upon the staff report and all other evidence submitted,
makes the following findings:
A. Harris & Associates is currently under contract with the City to provide civil
engineering and land surveying support and has Michael K. Cooper on its staff,
who is qualified to certify and sign maps as an Acting City Land Surveyor; and
B. Under the provisions of the Map Act, the City Council may delegate
responsibility for the technical review of all parcel and final maps submitted to
the City Council for approval.

3. Based upon the above stated facts, conclusion and findings, the City Council hereby
resolves to:
A. Approve the appointment of Michael K. Cooper, a professional engineer, as Acting
City Land Surveyor.
PASSED AND ADOPTED this 21 st day of April, 2003, by the following vote:

MEMORANDUM

RE: APPOINT MICHAEL COOPER AS ACTING CITY SURVEYOR
PURPOSE
To satisfy the requirements of the Subdivision Map Act for approval of Parcel and Final Maps by a
qualified Professional Civil Engineer or Land Surveyor. .
BACKGROUND
The Subdivision Map Act of the State of California requires that parcel and final maps that must be
approved by the legislative body; must be certified by the City Engineer to be in conformance with the
approved tentative map and any local ordinances applicable at the time of the approval of the tentative
map; and must be technically correct. The Map Act further requires that the official who finds the
map to be technically correct must be licensed in the State of California as a Licensed Land Surveyor,
or a Registered Civil Engineer who was registered prior to January 1, 1982, who also can function as
a Land Surveyor.
To satisfy the requirement for the map to be found technically correct, a surveyor or engineer who
meets those qualifications must be engaged. The City of Gilroy, is currently under contract with
Harris & Associates to provide staff augmentation for engineering and plan check functions. One of
the members of the Harris & Associates staff is Michael Cooper, whose engineering registration
qualifies him to sign parcel and final maps. However, he must be appointed as Acting City Surveyor
to act in that capacity. .
FISCAL IMPACT
There is no direct fiscal impact to the City from the appointment of an Acting City Surveyor.
RECOMMENDA TION
Staff recommends the City Council adopt a resolution which approves the appointment of
Michael Cooper, Professional Engineer, as Acting City Surveyor.
