RESOLUTION NO. 2003-68
RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
GILROY REVISING THE COMPREHENSIVE FEE
SCHEDULE 2003-2004 TO ELIMINATE CERTAIN FEES ON
DEVELOPMENT PROJECTS IN THE C-2 CENTRAL
BUSINESS DISTRICT
WHEREAS, the City Council adopted Resolution No. 2002-75 on October 21, 2002,
setting forth the City of Gilroy Comprehensive Fee Schedule 2002-2003 ("Comprehensive Fee
Schedule"); and
WHEREAS, the City Council on October 20, 2003 adopted Ordinance No. 2003-19,
which amends the Gilroy City Code to eliminate certain charges to development projects in the
C-2 Central Business District zone until the earlier of the date of adoption of a Specific Plan for
the Downtown or until December 31,2005; and
WHEREAS, the fees and charges to be eliminated are set forth in the Comprehensive Fee
Schedule, including charges to applicants for processing of development applications and
building permits, and development impact fees for development projects.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Gilroy
amends the Comprehensive Fee Schedule to add a statement as follows:
"Pursuant to Ordinance No. 2003 -19 and Resolution No. 2003-68, certain fees and
charges set forth in this schedule affecting development projects in the C-2 central business
district zone have been eliminated as described below.
(a) Fees and charges to be eliminated include those charged to applicants for processing
development applications and building permits, and development impact fees, except
that direct costs shall be charged to applicants for all costs, fees and charges incurred
in city review and processing that must be paid to outside consultants, city-contracted
entities, and other agencies.

(b) For purposes of this section, "development project" shall mean any project that
requires a permit granting approval for construction from the City of Gilroy.
(c) This section shall be effective only until the earlier of the date of adoption of a
Specific Plan for the Downtown by the City Council, or on December 31,2005."
This resolution shall take effect only if, and upon the same date, that Ordinance No.
2003-19 takes effect.
