RESOLUTION NO. 2003-69
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
GILROY APPROVING GP A 03-04, A GENERAL PLAN
AMENDMENT TO CHANGE THE GENERAL PLAN LAND
USE DESIGNATION FROM GENERAL SERVICES
COMMERCIAL TO LOW DENSITY RESIDENTIAL ON AN
APPROXIMATELY 2.5 ACRE SITE LOCATED AT 6555
MONTEREY ROAD, APN 799-46-007
WHEREAS, James Suner, the applicant, submitted GPA 03-04, requesting a General
Plan Amendment to change the General Plan Land Use Designation from General Services
Commercial to Low Density Residential on approximately 2.5 acres at 6555 Monterey Road,
APN 799-46-007; and
WHEREAS, pursuant to the California Environmental Quality Act ("CEQA"), a Final
Environmental Impact Report ("EIR") was prepared for the City of Gilroy General Plan Update
and certified by the City Council on June 13,2002 in compliance with CEQA; and the Council
adopted CEQA findings and a Statement of Overriding Considerations in Resolution No. 2002-
41, and adopted a mitigation/monitoring program; and
WHEREAS, pursuant to CEQA Guidelines section 21093, the City has determined that
General Plan Amendment GP A 03-04 is a lesser intensification of use than that evaluated for
environmental effects under the General Plan Update; and
WHEREAS, the Planning Commission held a duly noticed public hearing on October 2,
2003, at which time the Planning Commission considered the public testimony, the Staff Report
dated September 26, 2003 ("Staff Report"), and all other documentation related to application
GP A 03-04, and recommended that the City Council approve said application; and
WHEREAS, the City Council held a duly noticed public hearing on October 6,2003, at
which time the City Council considered the public testimony, the Staff Report, and all other
documentation related to application GP A 03-04; and

WHEREAS, the location and custodian of the documents or other materials which
constitute the record of proceedings upon which this project approval is based is the office of the
City Clerk.
SECTION I
NOW, THEREFORE, BE IT RESOLVED THAT:
A. The City Council finds as follows:
The project is in the public interest because the site is surrounded with residential
uses to the north, south, and west and is considered an "infill" development, making use of
existing infrastructure.
B. General Plan Amendment 03-04 should be and hereby is approved, subject to
relevant mitigation measures in the General Plan Update EIR.
