RESOLUTION NO. 2004-01
RESOLUTION OF THE CITY COUNCIL OF THE CITY OF GILROY
AUTHORIZING THE SUBMITTAL OF AN APPLICATION TO THE
CALIFORNIA STATE LffiRARY BOND ACT OF 2000 FOR A LOCAL
LffiRARY CONSTRUCTION GRANT.
WHEREAS, the voters of California on March 7, 2000, passed Proposition 14:
Californian Reading and Literacy Improvement and Public Library Construction and
Renovation Bond Act of 2000. This act authorized the California State Library to
establish a grant program of $350 million of state grants are currently available on a 65%
state to 35% local matching fund basis to cities, counties and library districts authorized
to own and maintain a public library facility.
WHEREAS, the California Office of Library Construction (OLC) is a division of
the California State Library and has been delegated the responsibility for the
administration of the program within the State, setting up necessary procedures governing
program applications; and
WHEREAS, said procedures established by the California OLC require the
applicant to certify by resolution the following commitments by the City of Gilroy
conditioned upon award of a State Library Bond Act of 2000 grant;
(A) The City's commitment to providing the local matching fund amount
identified in the Library Project Budget, as required by Education Code
section 19995 (a), induding and identifying any amounts to be credited to
local matching funds pursuant to section 19995 (c) and (d).
(B) The City's commitment to providing supplemental funds necessary to
complete the project at the level stated in the project budget [See section
20436 (e)].

(C) The City's commitment to the availability of the local matching and
supplemental funds specified in the project budget when they are needed to
meet cash flow requirements for the project.
(D) The project budget contained in the Library Project Budget section of the
Application Form.
(E) The accuracy and truthfulness of all information submitted in the Application
Form and the required supporting documents.
(F) A commitment to operate the completed facility and provide public library
direct service under agreement with the Santa Clara County Library Joint
Powers Authority.
(G)A commitment that the facility shall be dedicated to public library direct
service use for a period of 40 years following completion ofthe project,
regardless of any operating agreements the applicant may have with other
jurisdictions or parties.
(H)A commitment it will abide by all requirements of the Final (Codified) Title
5 Library Dond Act Resmlations: Effective Date: January 4. 2002
WHEREAS, said procedures established by the California OLC requires the
applicant to certify by resolution approval of the application before submission of said
application to the State; and
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of
Gilroy certifies the above commitments and authorizes the submittal of an application to
the California Office of Library Construction for a California Library Bond Act of 2000
Grant. The City Administrator or his authorized designee of the City of Gilroy is hereby
authorized and empowered to execute in the name of the City of Gilroy all necessary
applications, contracts, agreements, amendments and payment requests hereto for the
purposes of securing grant funds and to implement and carry out the purposes specified in
the grant application.
