RESOLUT~ON NO. 2004-78
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF GILROY INITIATING
PROCEEDINGS AND SETTING A !PUBLIC HEARING REGARDING V ACA TION
OF A PUBLIC TRAIL EASEMENT
WHEREAS, an easement ("Easement~') for a 35 foot wide pedestrian trail was dedicated
to the City of Gilroy ("City") along the nortl.11easterly boundary of the property along the Uvas
Creek corridor, APN 810-20-03, ("Property~') and as described in the Easement Agreement
recorded on November 7, 1991, Book L923 of Maps at page 1163; and
WHEREAS, the City has received a re~uest from the owners of the Property to vacate the
Easement; and
WHEREAS, the Planning Commissiqn will review said Easement vacation pursuant to
California Government Code section 65402 ~t the Planning Commission hearing on October 7,
2004, to consider whether the proposed vacat~on of the Easement would conform with the City's
General Plan;, and
WHEREAS, the City Council wishes ,to set a public hearing to consider vacation of the
Easement.
NOW, THEREFORE, the City Coun~il does resolve that pursuant to California Streets
and Highways Code, section 8320, et seq., the City hereby sets a public hearing for October 18,
2004, at the hour of7:00 p.m. in the City COlQ1cil Chambers, 7350 Rosanna Street, Gilroy, CA to
consider the vacation of the Easement shown <l>n Exhibit A hereto.
