A RESOLUTION OF THE CtTY COUNCIL OF THE CITY OF GILROY APPROVING TM 104-06, A TENT A TIVE MAP TO SUBDIVIDE AN EXISTING INDUSTRIAL BUILDING ON AN APPROXIMATELY 3-ACRE SITE INTO TWO AIR SPACE PARCELS TO CREATE! A TWO-UNIT INDUSTRIAL CONDOMINIUM LOCATED AT 5900 OBATA WAY, APN 841-76-021 WHEREAS, Sterigenics International; the applicant, submitted TM 04-06, requesting a tentative map to subdivide an existing industrial building on an approximately 3-acre site into two (2) air space parcels to create a two-unit itJ.dustrial condominium located at 5900 Obata Way, APN 841-76-021; and WHEREAS, the California Environm~ntal Quality Act ("CEQA") provides a categorical exemption for existing facilities pursuant to CEQA Guidelines Section 15301, which applies to this project; and WHEREAS, the Planning Commissiqn held a duly noticed public hearing on July 29, 2004, at which time the Planning CommissiotJ. considered the public testimony, the Staff Report dated July 21,2004 ("Staff Report"), and all bther documentation related to application TM 04- 06, and unanimously recommended that the Cjty Council approve said application; and WHEREAS, the City Council held a ~uly noticed public hearing on September 7, 2004, at which time the City Council considered tije public testimony, the Staff Report, and all other documentation related to application TM 04-0K5; and WHEREAS, the location and custo<jlian of the documents or other materials which constitute the record of proceedings upon whi~h this project approval is based is the office of the City Clerk. The proposed Tentativ, Map is consistent with the land use designation for the property on the General Plan m~p (General Industrial). 2. The project is consistent with the intent of the goals and policies of the City's General Plan. 3. The proposed development is consistent with the Zoning Ordinance and the City's Subdivision ~d Land Development Code, and the Subdivision Map Act. 4. Public utilities and iTIifrastructure improvements needed to serve the proposed project alreadt exist on the site. 5. The proposed project is Iconsistent with surrounding development. 6. The proposed project is generally consistent with the City's Commercial and Industrial Condomij:Iium Policy. 7. There is no substantiallevidence in the record as a whole that the project will cause a significant ~ffect on the environment. 8. There are no facts to support the findings requiring denial of the proposed tentative map pursuant ~o California Government Code section 66474. B. The Applicant will be required to meet the 4>nditions of the Commercial and Industrial Condominium Policy prior to Final Map, except as noted ~n the analysis section above. 2. Each business shall have Model 3201 KNOX boxes installed at each tenant's main entry. All Locked gates shall be provided with KNOX access. 3. All Buildings and uses shall comply with I the California Building Code, California Fire Code, as amended by the City of Gilroy, and the IUniform Mechanical, Electrical, and Plumbing Codes. Each Condo is responsible for the proper stdrage and use of hazardous materials in each condo. If one condo is required to have audible or visuallalarms for occupant notification then such alarm devices shall be placed in both condos for notification of both units. Each condo shall have a valid Hazardous Materials Business Plan and permit prior tOlbuilding permit issuance or final map. 8. Any change in waste water discharges by qtch condo shall be reviewed by Chemical Control. New discharges could result in additional sewer ,est manholes and/or discharge permits. I 9.
