RESOLUTION NO. 2004-87
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
GILROY AMENDING THE CITY OF GILROY CONFLICT OF
INTEREST CODE TO ADD POSITIONS AND CHANGE THE
TITLES OF CERTAIN PERSONS SUBJECT TO THE CODE
WHEREAS, the Political Reform Act, Government Code section 81000 et seq., requires
state and local agencies to adopt and promulgate conflict of interest codes, and the City of Gilroy
("City") is an agency subject to said statute; and
WHEREAS, the City has adopted the terms of2 Cal. Code of Regs. section 18730, and any
amendments thereto, taken with appendices prepared and adopted by the City, as the Conflict of
Interest Code of the City; and
WHEREAS, the City has reorganized, causmg the title of the Building Official as
designated by the City's current Conflict of Interest Code to be changed; and
WHEREAS, this reorganization caused the Building Official to be renamed the Building
Field Services Manager; and
WHEREAS, the changed City title supersedes the one designated in the City's Conflict of
Interest Code and it is the intent of the City that this renamed position remains subject to the City's
Conflict of Interest Code; and
WHEREAS, it is the intent of the City to modify Appendix I of Res. 95-88 to reflect these
changes;
NOW, THEREFORE, BE IT RESOLVED THAT:
Appendix I to Res. 95-88 regarding the City's Conflict of Interest Code, designating the
employees who shall be subject to the City's Conflict of Interest Code, shall be deleted in its

entirety and replaced with Appendix I as set forth in Exhibit 1, attached hereto and incorporated
herein by this reference:

Only those interests which are relevant to the consultant's engagement are required to be disclosed. The
appropriate interest to be disclosed shall be determined by the City Administrator in conjunction with the City
Attorney. Such determination shall include a description of the duties of the consultant and, based upon that
description, a statement of the extent of disclosure requirements. The City Administrators determination shall be in
writing, is a public record, and shall be retained for public inspection in the same manner and location as this conflict
of interest code.
All agreements with a consultant, whether or not such consultant is required to file a disclosure statement in
accordance with this resolution, shall contain a certification by the consultant that no conflict of interest exists in
connection with the contract being entered into between the consultant and the city,

I, RHONDA PELLIN, City Clerk of the City of Gilroy, do hereby certify that the attached
Resolution No. 2004-87 is an original resolution, or true and correct copy of a city resolution,
duly adopted by the Council of the City of Gilroy at a regular meeting of said Council held on the
4th day of October, 2004, at which meeting a quorum was present.
