RESOLUTION NO. 2004-90
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
GILROY REVISING THE DEVELOPMENT IMP ACT FEES
CHARGED BY THE COMMUNITY DEVELOPMENT
DEPARTMENT
WHEREAS, after extensive study and consultation with interested parties and the City
Council of the City of Gilroy, Staff have prepared and recommended revisions to the rates of the
City of Gilroy Development Impact Fees (including the combined Public Facilities Fee that will
supplant the five existing individual development impact fees for fire, police, library, parks and
recreation and general public facilities), as authorized by the various Sections of the City Code and
State law, and good cause appearing thereafter.
WHEREAS, the following exceptions shall be recognized:
1. Commercial and industrial projects for which complete building and off-site plans
have been submitted and deemed complete by the City and for which fees are paid
prior to January 1, 2005.
2. Residential projects for which complete off-site plans and a final map have been
submitted and deemed complete by the City and which fees are paid prior to January
1,2005.
NOW, THEREFORE, BE IT RESOLVED that the Council of the City of Gilroy approves
the City of Gilroy Development Impact Fee Schedule, attached hereto as Exhibit "A" and
incorporated herein by this reference, to be effective January 1, 2005.

All former fees collected for Park Development Impact, Police Impact, Fire Impact, Public
Facilities and Library Impact have been consolidated and are to be collected as a single Public
Facilities Impact Fee at the rates immediately above. However, projects that have a vested right

that would preclude application of the consolidated Public Facilities Impact Fee shall pay the
existing impact fees at the rates given below.
