Resolution 2005-35RESOLUTION NO. 2005-35 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF GILROY APPROVING GPA 05 -01, AN AMENDMENT TO SECTION 6 OF THE COMMUNITY DESIGN AND DEVELOPMENT ELEMENT OF THE GENERAL PLAN, AND TO ESTABLISH THE SCENIC CORRIDOR GUIDELINES PERTAINING TO LOCALLY DESIGNATED SCENIC ROADWAYS WHEREAS, in June 2002 the City Council approved a comprehensive General Plan establishing the goals and policies for development in the City of Gilroy, including Section 6 of the Community Design and Development Element ( "Section 6 ") relating to scenic highways; and WHEREAS, the General Plan in Section 6, Policy 6.01 calls for Santa Teresa Boulevard to be established as an official State Scenic Highway; and WHEREAS, because Santa Teresa Boulevard is not a State highway, it cannot be designated as an official State Scenic Highway corridor, and therefore the City Council intends to delete all references and actions to accomplish State Scenic Highway status for it from the General Plan; such as deleting Santa Teresa from Policy 6.01, and deleting Santa Teresa from Action 6.A of Section 6 which calls for the City to apply to the State to obtain Scenic Highway status for Santa Teresa Boulevard; and WHEREAS, the City Council intends to add Santa Teresa Boulevard to Section 6, Policy 6.02, which calls for the recognition and protection of scenic roadways other than State highways; and WHEREAS, the City Council hereby intends to establish Scenic Corridor Guidelines to preserve the scenic qualities of the locally designated scenic corridors, pursuant to Section 6, Action 6.13 of the General Plan; and WHEREAS, the California Environmental Quality Act provides a categorical exemption for "Minor Alterations in Land Use Limitations" pursuant to CEQA guidelines § 15305, which applies to this project; and 1CTA1659189.2 052305 - 04706089 Resolution No. 2005 -35 WHEREAS, the Planning Commission held a duly noticed public hearing on May 5, 2005, at which time the Planning Commission considered the public testimony and the Staff Report dated April 25, 2005 and all other documentation related to application GPA 05 -01, and recommended that the City Council approve said application; and WHEREAS, the City Council held a duly noticed public hearing on May 16, 2005, at which time the City Council considered the public testimony, the Staff Report, a follow -up staff report dated May 9, 2005, and all other documentation related to application GPA 05 -01; and WHEREAS, the location and custodian of the documents or other materials which constitute the record of proceedings upon which this project approval is based is the office of the City Clerk. SECTION I NOW, THEREFORE, THE CITY COUNCIL FINDS THAT: The General Plan amendment proposed by GPA 05 -01 is in the public interest because it corrects an error in designation of Santa Teresa Boulevard as a candidate for State Scenic Highway status, and adds it for protection under the policies relating to scenic roadways that are not State highways. SECTION II Based on the above finding, General Plan amendment application GPA 05 -01 is hereby approved, and the City of Gilroy General Plan is hereby amended as set forth on Exhibit A. SECTION III Pursuant to Action 6.B of the General Plan, the City Council of the City of Gilroy hereby approves and adopts the "Scenic Corridor Guidelines, Local Gilroy Roadways," set forth in and attached hereto as Exhibit B. ICTM659189.2 052305 - 04706089 Resolution No. 2005-35 SECTION IV Due to State law requiring a thirty (30) day period prior to the effective date for general plan amendments following their adoption, this Resolution shall not be in full force and effect until thirty (30) days after the date of its adoption. Support the designation of Hecker Pass Highway and Pacheco Pass Highway as official State Scenic Highways, and establish appropriate development controls to ensure Ion g -term protection of their scenic qualities. Controls should establish appropriate setbacks, sign controls, and other development regulations in keeping with State guidelines for the protection of scenic highway corridors. Policy 6.02 Other Scenic Roadways. Kecogni .Ze and protect important scenic qualities and natural features on other roadways in the Planning Area, including Uvas Park Drive, Santa Teresa Boulevard, and Miller Avenue from First Street to Mesa Road. Action 6.A Scenic Highway Designations. Coordinate with Santa Clara County, Callrans and other agencies to support the application for Scenic Highway status for Hecker Pass Highway and Pacheco Pass Highway. ICTk6591892 052305 - 04706089 -4- Resolution No. 2005 -35 EXHIBIT -13" SCENIC CORRIDOR GUIDELINES Local Gilroy Roadways INTENT It is the intention of this policy to provide guidelines for the protection of scenic qualities along locally designated scenic roadways. APPLICABILITY This policy applies to those scenic roadways as designated in the General Plan: A. Santa Teresa Boulevard; B. Uvas Park Drive; and C. Miller Avenue from First Street to Mesa Road. DEVELOPMENT GUIDELINES • Development along scenic corridors should ensure that the natural landscape dominates view. • Grading should blend with adjacent landforms and topography. Extensive cut and fill should be minimized. • Provide landscape and topographic screening of fences, buildings and structures whenever feasible. • Project site design should ensure that existing visual intrusions do not significantly impact the scenic corridor. • All projects along scenic corridors should incorporate wide setbacks that utilize landscaping to screen buildings from the roadway as much as possible. • Wide setbacks may be used for recreational purposes, such as including bicycle and pedestrian trailways consistent with the Trails Master Plan. 1CTA1659189 2 052305 - 04706089 -5- Resolution No. 2005 -35 • When possible incorporate linear parks along scenic roadway corridors. • Landscaping must be consistent with the City's existing Consolidated Landscaping Policy. • Buildings should be complementary to the landscape and when adjacent to a scenic corridor, should be single -story or utilize a stepped design where the second floor is set back further to reduce building mass. • Exterior building colors and materials must be compatible with the natural environment. • Use non - reflective materials for buildings and roofs. • All roof - mounted equipment must be screened from public view. • All sound attenuation measures must meet the criteria of the Sound Attenuation Policy. • Any commercial development along scenic corridors should be single -story and oriented so that the rear loading areas are not visible. They should be neatly maintained, well landscaped and blend with the surroundings. • Any parking lots along scenic roadways must be screened from view so that vehicles and pavement are not visible from a scenic roadway. They should be neatly maintained, well landscaped and blend with the surroundings. • Billboard signs will not be allowed along scenic roadways within the City of Gilroy. Any on -site signs for nearby commercial development shall be consistent with Gilroy's Sign Ordinance and must not be oriented towards a scenic roadway. • Outdoor storage must be minimized along a scenic roadway and screened with landscaping to minimize impacts to the natural landscape and scenic qualities of the surrounding view.
