A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
GILROY APPROVING GPA 05 -07, AN AMENDMENT TO THE
GENERAL PLAN TO INCLUDE SPECIFIED PARCELS IN AND
REMOVE SPECIFIED OTHERS FROM THE NEIGHBORHOOD
DISTRICT GENERAL PLAN DESIGNATION.
WHEREAS, the City of Gilroy submitted application GPA 05 -07, an amendment to the
General Plan to include specified parcels in and remove specified others from the Neighborhood
District General Plan designation ( "Project "); and
WHEREAS, pursuant to the California Environmental Quality Act ( "CEQA "), the City
Council on June 13, 2002, by Resolution No. 2002 -41 certified an Final Environmental Impact
Report (Final EIR) in connection with General Plan update application GPA 99 -01 that applies to
this Project; and
WHEREAS, the updated General Plan identified six Neighborhood Districts: "Southwest
Quadrant: Glen Loma Ranch Specific Plan," "Luchessa Avenue and Thomas Road," "South of
Santa Teresa Boulevard, northwest of Dawn Way," "North - central Gilroy, south of the Buena
Vista Avenue Extension," "Rancho 101," and "Northwest Quadrant, west of Santa Teresa
Boulevard "; and
WHEREAS, the City Council, after a public process lasting more than two years, adopted
a Neighborhood District Policy on June 13, 2005, whose implementation required the addition of
specified parcels to and removal of certain others from the Neighborhood District General Plan
designation; and
WHEREAS, the Planning Commission held a duly noticed public hearing on October 7,
2005, at which time the Planning Commission considered the public testimony, a staff report
dated September 29, 2005 ( "Staff Report"), and all other documentation related to application
GPA 05 -07, and recommended that the City Council approve said General Plan
amendments; and

WHEREAS, the City Council held a duly noticed public hearing on October 17, 2005, at
which time the City Council considered the public testimony, the Staff Report, a follow -up staff
report dated October 7, 2005, and all other documentation related to application GPA 05 -07; and
WHEREAS, the location and custodian of the documents or other materials which
constitute the record of proceedings upon which the Project approval is based is the office of the
City Clerk.
SECTION I
NOW, THEREFORE, THE CITY COUNCIL FINDS THAT:
1. The proposed amendments are generally consistent with surrounding land use
designations, and with the policies of the General Plan.
2. The Project is in the public interest because it removes certain flood -plain areas from
the Neighborhood District land use designation and refines district boundaries to
more accurately reflect the character of the Neighborhood District and its land use
designations.
3. There is no substantial evidence in the entire record that the Project as mitigated will
cause any significant environmental impacts beyond those already described in the
General Plan update Final EIR.
4. The proposed changes are consistent with the approved Neighborhood District
Policy.
SECTION II
A. Based on the above findings, General Plan amendment application GPA 05 -07 is
hereby approved, subject to the mitigation measures set forth in the Final EIR and the Mitigation
Monitoring Program.
B. The Gilroy General Plan map is amended as follows:

1. Re- designate specified parcels west of Thomas Road from Neighborhood
District to Low Density Residential, and other specified parcels east of Thomas Road
from Neighborhood District to Open Space, both areas shown on the attached map of the
"Luchessa Avenue and Thomas Road Neighborhood District," attached hereto as Exhibit
"A" and incorporated herein by this reference.
2. Re- designate the entire 56 -acre "South of Santa Teresa Boulevard,
Northwest of Dawn Way Neighborhood District" from Neighborhood District to Low
Density Residential, as shown on the attached Exhibit `B," incorporated herein by this
reference.
3. Re- designate specified parcels east of Santa Teresa Boulevard, north of
the drainage channel; and additional parcels west of Monterey Road, north of Farrell
Avenue from Neighborhood District to Low, Medium, and High density Residential, as
shown on the map of the "North- central Gilroy, south of Day Road Neighborhood
District" attached hereto as Exhibit "C," and incorporated herein by this reference.
4. Re- designate specified parcels north of Vickery Avenue, south of Tatum
Avenue, and east of Monterey Road from Low and Medium Density Residential to
Neighborhood District, as shown on the map described above and incorporated herein as
Exhibit "C."
5. Re- designate specified parcels west of Santa Teresa Boulevard from
Neighborhood District to Low Density Residential, as shown on the attached map of the
"Northwest Quadrant, west of Santa Teresa Boulevard Neighborhood District" attached
hereto as Exhibit "D" and incorporated herein by this reference.

SECTION III
Due to State law requiring a thirty (30) day period prior to the effective date of a General
Plan amendment, this Resolution shall not take effect until thirty (30) days after the date of its
adoption.
