A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
GILROY APPROVING AN ADJUSTMENT OF THE TRAFFIC
IMPACT FEE BASED ON REVIEW OF THE COSTS OF THE
TRAFFIC PROJECTS BASED UPON ACTUAL AND /OR
FORESEEABLE COSTS BEING EXPERIENCED BY THE
BUILDING INDUSTRY
WHEREAS, on October 18, 2004, the City Council adjusted the Traffic Impact Fee pursuant
to Resolution No. 2004 -90; and
WHEREAS, on November 1, 2004, the City Council adopted Resolution 2004 -95, which sets
forth the City's policy in relation to annual adjustments of the Traffic Impact Fee ( "the TIF'); and
WHEREAS, pursuant to resolution 2004 -95, the TIF shall be adjusted by resolution of the
City Council annually effective January 1 of each calendar year based upon a review of the overall
budgets and unit costs for each project scheduled for funding from the TIF; and
WHEREAS, pursuant to Resolution No. 2004 -95, the City hired independent engineering
f= to conduct project review and unit cost analysis based on actual and/or foreseeable costs being
experienced by the building industry; and
WHEREAS, the project review and unit cost analysis was completed and the resulting fee
adjustment corresponds to the overall change in the TIF budget caused by the updated unit costs and
project review; and
WHEREAS, the City now wishes to adjust the TIF in accordance with the results of that
review and analysis.

NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Gilroy
approves the TIF as set forth in Exhibit "A" hereto and incorporated herein by this reference, to be
effective January 6, 2006.
PASSED AND ADOPTED this 7th day of November, 2005 by the following vote:

VALIQUETTE, VELASCO, and PINHEIRO
