Resolution 2006-08RESOLUTION NO. 2006 -8 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF GILROY DESIGNATING CERTAIN PRIVATE LANDS AS PUBLIC OFF - STREET PARKING LOTS AND PROVIDING FOR THE REGULATION OF PARKING THEREON AND THE RESTRICTION OF PARKING TO TWO HOURS, AND CONVERTING EXISTING PUBLIC PARKING SPACES IN CERTAIN AREAS OF THE DOWNTOWN TO TWO -HOUR PUBLIC PARKING SPACES. WHEREAS, Cal. Vehicle Code section 22507 authorizes local authorities by resolution to prohibit or restrict the stopping, parking, or standing of vehicles on certain streets, or portions thereof, during all or certain hours of the day; and WHEREAS, Cal. Vehicle Code section 22519 authorizes local authorities by resolution to prohibit, restrict or regulate the parking, stopping or standing of vehicles on any offstreet parking facility which it owns or operates, provided that the local authority posts signs giving notice thereof; and WHEREAS, Gilroy City Code section 15.72 establishes public off - street parking lots in the City, and provides that such off - street parking lots are those areas so designated by resolution of the City Council; and WHEREAS, Gilroy City Code section 15.75 provides that the limitations on parking time and the days and hours during which parking time limits shall apply on public off - street parking lots shall be established by resolution of the City Council; and WHEREAS, Gilroy City Code section 15.75 also provides that when "appropriate signs or markings designating such parking time limits are in place giving notice thereof, it shall be unlawful for the operator of any vehicle to stop, stand or park such vehicle on any public off- street parking lot for longer than the permitted time "; and MHI681855.3 01- 013106 - 04706084 -I- Resolution No. 2006 -8 WHEREAS, the City desires to establish public parking spaces in private parking lots within the City to provide additional off - street parking on a temporary basis to offset the displacement of parking spaces that will occur during the City's Monterey Streetscape Phase III Project; and WHEREAS, the City desires to designate parking time limits of two (2) hours in said parking lots and to install appropriate signage giving notice of such restrictions, and to authorize law enforcement personnel to issue citations to motorists who leave their cars parked longer than the allowed parking time limits and to tow vehicles as permitted under the Cal. Vehicle Code and the Gilroy City Code; and WHEREAS, the City has established three -hour parking limits in some areas, and the City desires to limit to two (2) hours all public parking in those certain areas of the downtown shown on the attached Exhibit "A" so that public parking in those areas uniformly is restricted to two (2) hours; and WHEREAS, this project is exempt from environmental review under the California Environmental Quality Act ( "CEQA ") pursuant to section 15301 of the CEQA Guidelines (14 Cal. Code of Regs. section 15000 et seq.) because the parking lots that the City desires to use for public parking purposes and the parking spaces that will be converted to two -hour parking spaces are existing facilities used for parking purposes. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Gilroy that: (1) The City Council hereby designates the privately owned land within the City identified on the attached Exhibit "A," which is incorporated herein by this reference, as off- street parking lots pursuant to Cal. Vehicle Code section 22519 and Gilroy City Code section 15.72. 1NVH1681855.3 01 -013106- 04706084 Resolution No. 2006 -8 (2) A parking time limit of two (2) hours is hereby established in said off - street parking lots, which time limitation shall apply from 7:00 a.m. to 6:00 p.m., Monday through Saturdays exclusive of holidays. (3) Parking hereby is restricted to two (2) hours from 7:00 a.m. to 6:00 p.m., Monday through Saturdays exclusive of holidays, in all public parking spaces in that certain area shown on the map attached hereto as Exhibit "A." (4) City staff is directed to install appropriate signage designating the two -hour parking limit as notice to the public of the time limit, and upon the installation of said signage, the City's law enforcement personnel are authorized to enforce the two -hour parking limit as provided under the Cal. Vehicle Code and the Gilroy City Code.
