A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
GILROY APPROVING MODIFIED RIGHT -OF -WAY
STANDARDS FOR PUBLIC AND PRIVATE STREETS
WHEREAS, the City Council in 2005 directed staff to research the feasibility of modifying
the existing right -of -way standards to exclude sidewalks, planting strips, and landscaping from the
public right -of -way; and
WHEREAS, a Right -of -Way Task Force was formed, comprising members of all City
Divisions, the development community, the Parks and Recreation Commission, and citizens -at- large;
and
WHEREAS, the Right -of -Way Task Force recommended new Right -of -Way standards that
require new residential, industrial, and commercial lots to retain ownership of an approximate
sixteen (16) foot strip of land that incorporates sidewalks, planting strips, and street trees, which
standards are set forth in the Task Force Handbook as Exhibits B and C respectively; and
WHEREAS, the Right -of -Way Task Force also developed "Traffic Calming Guidelines,"
"Median Landscape/Hardscape Guidelines," and "Engineered Vegetated Swale Guidelines," to assist
in implementation of the new Right -of -Way standards, which guidelines are set forth in the Task
Force's Handbook as Exhibits H, I and J respectively; and
WHEREAS, existing street standards prior to the effective date of this resolution are referred
to as "Classic Street Standards," and the new street standards will be known as "Liveable
Community Street Standards "; and
WHEREAS, the California Environmental Quality Act ( "CEQA ") provides a categorical
exemption for minor alterations in land use limitations pursuant to CEQA Guidelines Section 15305,
which applies to this project; and

WHEREAS, the Planning Commission held a duly noticed public hearing on July 7, 2005, at
which time the Planning Commission considered the public testimony, the staff report dated June 30,
2005 ( "Staff Report"), and all other documentation related to the proposed Right -of -Way standards,
and recommended that the City Council approve said standards; and
WHEREAS, the City Council held a duly noticed public hearing on January 23, 2006, at
which time the City Council considered the public testimony, the Staff Report, a follow -up staff
report dated September 12, 2005, and all other documentation related to the proposed Right -of -Way
standards; and
WHEREAS, the location and custodian of the documents or other materials which constitute
the record of proceedings upon which this project approval is based is the office of the City Clerk.
NOW, THEREFORE, BE IT RESOLVED THAT:
A. The proposed Right -of -Way standards, which include "Public and Private Street
Section Standards and Specifications," attached hereto as Exhibit "A "; "Traffic Calming,"
Meandering Sidewalk," and "Cul -de -sac Standard" Details, attached hereto as Exhibit `B "; and "Use
of Liveable Community Street Standards vs. Classic Street Standards" regarding new streets
adjoining existing streets and infill projects along existing streets, attached hereto as Exhibit "C ",
should be and hereby are approved.

B. The proposed guidelines entitled "Traffic Calming Guidelines," "Median
Landscape/Hardscape Guidelines," and "Engineered Vegetated Swale Guidelines," attached hereto
as Exhibit D, shall be used in conjunction with the adopted Right -of -Way standards.

a. Meandering
i. Sidewalks shall be required to meander on collectors, both public and private, and on
arterial and Industrial roadways.
ii. Sidewalks are not required to meander on local roadways.
b. Monolithic
i. Monolithic sidewalks shall not be allowed In residential, commercial, or industrial
areas with the exception of the cul -de -sac bulb or through a specific plan.
2. Grassy Swales
a. Grassy swales shall be allowed on private streets only, as appropriate for the area and as
approved by City Staff. Grassy Swales shall comply with Engineering Division Policy on
"Engineered Vegetated Swale" and Caltrans Standards.
2. Parking
a. Residential Angle Parking
i. Angle parking In residential areas shall be allowed only on private streets and is
subject to the private street standard.
b, Commercial Angle Parking
I. Commercial angle parking shall be allowed only through the Master Plan or Specific
Plan Process.
c. Industrial
L On- street parking shall not be allowed in industrial areas.
4. Street Standards
a. Schools
i. School streets shall be the same standard as a collector with a 10 -foot monolithic
sidewalk along the school frontage. Tree well cutouts shall only be at the back of
sidewalk on the school side.
b. Public Facilities
i. Public facilities street standard shall be determined through the Master Plan, Specific
Plan, or Planned Unit Development (PUD) Process.
5. Street Lighting
a. Streetlight vendor shall be Holophane or an approved equal.
b. Streetlights shall be the same as those Downtown with spacing and use of dual or single
lamps varying based on location.
c. Cobra streetlights shall be used on wide streets such as arterials.
6. Traffic Calming
a. Traffic calming shall comply with Engineering Division Policy on "Trafflc Calming."
7. Median Landscape /Hardscape
a. Median landscaping /hardscaping shall comply with Engineering Division Policy on
"Land scaped /Hardscaped Medians,"
a. Public Use Easement (PUE) Maintenance
a. PUE maintenance shall comply with the Consolidated Landscape Plan, the Street Tree
Ordinance, and the Maintenance and Repair of the Public Use Area Ordinance.

• No raised or depressed obstructions are allowed in the travel way that
could slow fire apparatus response
• Adequate turning radius shall be provided for fire apparatus
• Design should allow for the use of street sweepers

Median Landscapefflardscape Guidelines

1. 'Medians less than six =feet wide (face of curb to, face of curb) should -not .be planted. Use
a decorative hardseape treatment.
2. ,Medians six- feet'and greater in width shall be landscaped in accordance with these
guidelines and subject to the approval of the City Engineer
3. Trees should not be installed in medians less than. ten feet wide (face of curb to faee'of
curb.
4. Trees used in medians should be upright growing. Allow for 17' vertical clearance over
travel lanes.
5. Keep planting simple. Rely on a few species planted in blocks, masses, or sweeps.
6. Landscaping should be designed to minimize long term maintenance liabilities.
7. Planted medians should incorporate an eighteen inch concrete band around the perimeter
of medians.
8. Hardscape (including 18" concrete band) should be treated as a design element.
Consideration should be given to using color and pattern to define corridors and districts
( commercial/ residential/industrial/downtown etc).
9, Incorporate root barriers where trees are planted.
I O.Design for ultimate size of plants (do not rely on pruning to keep plants in bounds). Use
set -back and spacing based on ultimate size.
11.Preserve visibility sight lines. Allow for traffic signs and underground utilities
12. Where feasible median should complement adjacent right of way design.
13.Plant selection should be appropriate for climate and soils. Allow for increased heat load
from pavement, and also wind tunnel effects. The majority of the planting should be of
low water use species.
14. Water meter, backflow .devices and controllers should be installed at the right curb, not in
the median. If there is not room for a service vehicle to park at these utilities (including
allowance for entry and exit, and access to tool boxes), install a turn out.
15,Plants listed as noxious weeds by the California Department of Food and Agriculture
shall not be used, Plants listed by the California Invasive Plant Council may be
considered for use depending upon species and site conditions, subject to approval of the

Engineered Vegetated Swale Guidelines
Proposal
• No longitudinal location of dry utilities, sewer or watei lines in the engineered
vegetated Swale.
• Engineered design to minimize scour and maximize infiltration (refer to the
Caltrans publication "Guide to Phytoremediation of Highway Runoff," November
2001).
• Fine Fescues and Sedge are the vegetation of choice subject to approval of the
City Engineer
• Swale is maintained by the Homeowners/Property Owners Association per the
following guidelines:
Immediate removal of obstructions of the inlet or outlet
devices by trash and debris.
➢ Repair areas of poor plant health or areas of low plant
density (depending on condition, either fertilize with
organic slow - release fertilizer [only when conditions
prevent release of fertilizer in runoff] and irrigate prior to
rainy season or clip short; reseed, sod, or plug plant; and
irrigate for 60 -90 days prior to likely first rain event).
Prevention of excessive erosion or sedimentation in the
Swale (correct grade and replant per above).
➢ Continuously check condition of the underdrain (standing
water or evidence of standing water indicates a need for
cleaning).
Check stability of the side slopes.
Remove weed growth in energy dissipators (pull or cut to
remove; do not use herbicides; when growth is severe,
replace landscaping fabric and rock).
➢ Repair any signs of vandalism
NOTE: These maintenance guidelines are not complete,
refer to the Caltrans publication "Guide to
Phytoremediation of Highway Runoff' (November 2001).
