RESOLUTION NO. 2006-39
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF GILROY
APPROVING AMENDED AND RESTATED POLICIES AND PROCEDURES
FOR LAND-SECURED FINANCINGS
RESOLVED by the City Council (the "Council") of the City of Gilroy (the "City"),
County of Santa Clara, State of California, that:
1. Goals and Policies. Under the Mello-Roos Community Facilities Act of 1982,
as amended, being sections 53311 and following of the California Government Code (the "Act"),
and prior to the institution of any proceedings thereunder, this Council must adopt goals and
policies as provided in the Act.
This Council previously approved "Policies and Procedures for Land-Secured
Financings" by Resolution No. 2000-73 adopted on November 17, 2000 (the "Goals and
Policies"). The Council wishes to amend and restate the Goals and Policies for the purpose of
incorporating the "Appraisal Standards for Land-Secured Financings" adopted by the California
Debt and Investment Advisory Commission in July 2004.
2. Approval. The "Amended and Restated Policies and Procedures for Land-
Secured Financings" on file with the City Clerk are hereby found to meet the requirements of the
Act and are hereby adopted by this Council for this City for purposes of compliance with the Act,
subject to further amendment by this Council as may be required from time to time.
3. Effective Date. This resolution and the Goals and Policies shall be effective
from and after the date of the adoption of this resolution by this Council.
