Resolution 2006-46 RESOLUTION NO. 2006-46 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF GILROY APPROVING TM 05-03, A TENTATIVE MAP TO SUBDIVIDE APPROXIMATELY 12.84 ACRES INTO 78 RESIDENTIAL AND COMMERCIAL PARCELS (THE CANNERY PROJECT) LOCATED AT III LEWIS STREET, APNS 841-04-026 AND -027 WHEREAS, South County Community Builders submitted TM 05-03 requesting a tentative map to subdivide an approximately 12.84-acre site zoned CD (Cannery District) into seventy-eight (78) residential and commercial parcels (The Cannery Project) located at 111 Lewis Street, APNs 841-04-026 and -027; and WHEREAS, the Planning Commission held a duly noticed public hearing on May 4, 2006, at which time the Planning Commission considered the public testimony, the staff report dated April 27, 2006 ("Staff Report"), and all other documentation related to application TM 05- 03, and recommended that the City Council approve the mitigated Negative Declaration prepared for the Project pursuant to the California Environmental Quality Act ("CEQA"), and approve this application; and WHEREAS, the City Council held a duly noticed public hearing on May 15, 2006, at which time the City Council considered the public testimony, the Staff Report, a follow-up staff report dated May 9, 2006, and all other documentation related to application TM 05-03 and continued said application; and WHEREAS, the City Council at its continued public hearing on June 5, 2006, considered the public testimony, the Staff Report, follow-up staff reports dated May 9, 2006, and May 30, 2006 ("Follow-up Reports"), and all other documentation related to application TM 05-03; and \GBO\695091.1 060606-04706089 -1- Resolution No. 2006-46 WHEREAS, pursuant to CEQA, the City Council on June 5, 2006, adopted the mitigated Negative Declaration for this project, finding that the Negative Declaration was completed in compliance with CEQA, that it reflects the independent judgment of the City, and that there is no substantial evidence in the entire record that the Project as mitigated will have a significant effect on the environment; and WHEREAS, the City Council determined that the conditions of approval set forth in the Staff Report, recommended by the Planning Commission, and set forth in the Follow-Up Reports should be incorporated into the Project; and WHEREAS, the location and custodian of the documents or other materials which constitute the record of proceedings upon which this Project approval is based is the office of the City Clerk. NOW, THEREFORE, BE IT RESOLVED THAT: A. The City Council hereby finds as follows: 1. The Project conforms to the land use designation for the property on the City's General Plan map and is consistent with the intent of the goals and policies of the General Plan. 2. The Project is consistent with the City's Zoning Ordinance and Subdivisions and Land Development Code, and the State Subdivision Map Act. 3. Public utilities and infrastructure improvements needed to serve the Project are in close proximity. 4. The Project is consistent with surrounding development. 5. There is no substantial evidence in the entire record that the Proj ect as mitigated will have a significant effect on the environment. \GBO\695091.1 060606-04706089 -2- Resolution No. 2006-46 6. There are no facts to support the findings requiring denial of the proposed tentative map pursuant to California Government Code section 66474. B. Tentative Map TM 05-03 should be and hereby is approved, subject to the "Tentative Map Conditions" attached hereto as Exhibit A and incorporated herein by this reference, and subject to the Negative Declaration dated November 21, 2005 and adopted by the City Council on June 5, 2006, the mitigation measures incorporated therein, and the Mitigation Monitoring Program, attached hereto as Exhibit B and incorporated herein by this reference. Division (contact Gregg Polubinsky 408-846-0440) These conditions are subject to the review and approval ofthe Planning Division. 1. MITIGATION MEASURES #l through #20 contained within the Negative Declaration dated November 21,2005 for the Gilroy Cannery Mixed Use Development, shall be applied to the approval of this Tentative Map in order to reduce and/or eliminate all potential significant impacts to a level of insignificance, as required under the California Environmental Quality Act (CEQA). 2. Subdivider shall defend, indemnify, and hold harmless the City, its City Council, Planning Commission, agents, officers, and employees from any claim, action, or proceeding against the City or its City Council, Planning Commission, agents, officers, and employees to attack, set aside, void, or annul an approval of the City, City Council, Planning Commission, or other board, advisory agency, or legislative body concerning this subdivision. City will promptly notify the subdivider of any claim, action, or proceeding against it, and will cooperate fully in the defense. This condition is imposed pursuant to California Government Code Section 66474.9. 3. Vector based e-files will be required prior to Final Map approval, readable by AutoCAD (IGES, DXF, DWG), containing lot and street layout and all City utilities. These files will be used to update the City's GIS system. 4. The ten foot Public Access Easement (P AE) along the western edge of Miller Slough will be revised to 15 feet wide (to accommodate 12 foot pavement section and 18 inch shoulders) and changed so that it continues in a northerly and like manner to the northern project boundary and then terminates. 5. All boundary fencing along the railroad right-of-way shall be visually open fencing. 6. Sheet 3 - Show enlarged detail of diversion islands at intersection. 7. Sheets 5, 7 - Bulb-outs shall be designed to accommodate a street. 8. Sheet 14 - Provide traffic control plan for all improvements in the public right-of-way. 9. Sheet 14 - Install streetlights 80 feet on center based on S treetscape Design standards. 10. Sheet 14 - Streetscape design standards are street trees spaced at 40 feet on Center. 11. Street trees shall be approved by the City Engineer. 12. Parallel parking dimensions are subject to further review when improvement plans are submitted. 13. All new roadways shall have a minimum 0.5% slope. In areas of existing roadways where a .5% cannot be maintained, additional drainage inlets shall be installed. The number and location is subject to the approval of the City Engineer. 14. All utilities shall be placed underground including existing overhead utilities on Lewis Street, per City of Gilroy Ordinance. 15. Transitions from Public to Private shall be clean with a concrete band and signage at the transition point. 16. Curb extensions shall have a minimum radius that will accommodate a sweeper truck. 17. Access design for pedestrian bridge is subject to the City Engineer's approval. 18. At a minimum an addition Drainage Inlet shall be provided at the northerly project frontage on Forest Street. EXHIBIT A 2 4/27/06 19. A SWPPP and an Erosion Control Plan is required for all development over 1 acre. 20. Certification of improvement on site plans is required prior to Building final (add to general notes on Title sheet of plans). 21. Certification of fire flow test is required prior to final permit (add to general notes on Title sheet of plans). 22. Certification of grades and compaction is required prior to building permit final. This statement must be added as a general note to the Grading and Drainage Plan. 23. Certification is required by the design engineer of the design and construction for all retaining walls shown on the improvement plans prior to final acceptance of the subdivision. 24. All retaining walls must be constricted of permanent materials such as concrete or masonry, and shall be of a modular design; wood shall not be permitted. 25. All Traffic Control Plans shall be prepared by a licensed professional engineer with experience in Traffic Control Design. 26. A Traffic Control Plan shall be provided in the Improvement Plans set for all work within the public right-of-way. 27. All temporary roads or detours shall have temporary asphalt paving unless otherwise approved by the City Engineer in writing. 28. Full frontage improvements are required for all new development. All streets must show sidewalks on both sides. 29. All work is to be done in compliance with the City of Gilroy Specifications Standards and Design Criteria and is subject to all laws of this community by reference. 30. Street improvements and the design of all storm drainage, sewer and water lines, and all street sections and widths shall be in accordance with City Standards and shall follow the most current Master plan for streets and each utility. The developer shall provide full street, curb, gutter, sidewalk and electrolier improvements. 31. All grading operations and soil compaction activities shall be per the approved soils report and shall meet with the approval of the City Engineer. Grading plans shall show the grades of all adjacent properties. 32. If the project has excess fill or cut that will be off-hauled to a site or on-hauled from a site within the city limits of Gilroy, an additional permit is required. This statement must be added as a general note to the Grading and Drainage Plan. 33. A minimum of one exterior monument shall be set. Additional monuments can be required by the City Engineer or City Surveyor as deemed necessary. 34. Location of monuments shall be tied out prior to work. Any City monument damaged, displaced or destroyed shall be replaced at the developer's sole expense. 35. New and existing utility lines to, through and on the site, and appurtenances and associated equipment, including, but not limited to, electrical transmission, street lighting, cable television and telephone shall be required to be placed underground. 36. A Final Map with all required dedications shall be filed with a copy transmitted to the City. 37. The developer shall submit an estimate of the probable cost of developer-installed off-site improvements with the Final map submittal. 38. The developer shall submit fees and bonds and enter into an improvement agreement prior to Final Map recordation. EXHIBIT A 3 4/27/06 39. In the event it is necessary to acquire offsite easements or street right-of-way, the owner shall enter into an agreement with the City prior to Final Map approval agreeing to pay all condemnation costs, for dedication of all required easements or street right-of-way. This agreement shall be recorded and require the owner to deposit all condemnation costs with the City within 21 days of Final Map approval. The owner shall agree to provide an initial cash deposit as determined by the City. 40. Prior to Final Map approval and approval of the Improvement Plans, the following items will need to be completed: a. The developer shall provide joint trench composite plans for the underground electrical, gas, telephone, cable television, and communication conduits and cables including the size, location and details of all trenches, locations of building utility service stubs and meters and placements or arrangements of junction structures as a part of the Improvement Plan submittals for the project. A licensed Civil or Electrical Engineer shall sign the composite drawings and/or utility improvement plans. (All dry utilities shall be placed underground.) b. A note shall be placed on the plans which states that the composite plan agrees with City Codes and Standards and that no underground utility conflict exists. c. "Will Serve Letters" from each utility company for the subdivision shall be supplied to the City. d. The City will collect the plan check and inspection fee for the utility underground work. 41. A current Title Report shall be submitted for review to the City prior to Final map approval. 42. Prior to any construction ofthe dry utilities in the field, the following will need to be supplied to the City: a. A professional engineer-signed and PG&E-approved original electric plan. b. A letter from the design Electrical or Civil Engineer that states the electrical plan conforms to City Codes and Standards, and to the approved subdivision improvement plans. 43. All lots shall drain to the street for storm drainage. 44. Improvement plans are required for all on-site and off-site improvements. 45. Submit a Hazardous Material clearance for any underground tank removal from the appropriate agency. 46. A Storm Water Pollution Prevention Plan shall be filed with the Regional Water Quality Control Board with a copy to the City. An Erosion Control Plan and Waste Discharger Identification shall be submitted to the City. 47. The developer shall negotiate right-of-way with Pacific Gas and Electric and other utilities subject to the review and approval by the Engineering Division and the utility companies. 48. Storm and sewer lines in private streets shall be privately maintained unless approved by the City Engineer in writing. 49. If any portion of the project is located in a special flood hazard area as shown on the most current flood insurance rate map; a flood zone study is required. Should the City Engineer determine a LOMR (letter of map revision) is required, no permits will be issued until a CLOMR (conditional letter of map revision) is completed. No permits will be finaled until the LOMR is complete. Any flood conditions imposed on this project by the National Flood Insurance Program or the City of Gilroy will be enforced by the City of Gilroy. EXHIBIT A 4 4/27/06 50. If any portion of the project is located in a special flood hazard area, provide the following statement in a bold box with minimum J;4 inch text on the front sheet of the plan set: "This project is located in a Flood Zone. A Conditional Elevation Certificate is required prior to the foundation pour and an Elevation Certificate with pictures of each of the four building elevations is required prior to final inspection". 51. If any portion of the project contains recycled water facilities as shown in the South County Recycled Water Master Plan, the facilities shall be installed at sole expense of the developer prior to final or occupancy of the first building. 52. If there is a Homeowners Association in place with this map prior to the map being released for recordation, Conditions, Covenants and Restrictions shall be approved by the Planning Division. 53. The City shall be notified at least two (2) working days prior to the start of any construction work and at that time the contractor shall provide a project schedule and a 24 hour emergency telephone number list. 54. All work shown on the improvement plans shall be inspected. Uninspected work shall be removed as deemed appropriate by the City Engineer. 55. Once the tentative map is approved, the developer shall submit an 8-1/2 X II-inch site plan to the Engineering Division to assign addressing which shows the following: tract name and number, lot number, street names, property lines, right-of-way lines, north arrow and curb cuts for driveway. 56. Reimbursement is required for any frontage infrastructure including but not limited to curb, gutter, sidewalk, storm, sewer, and water, constructed by others that benefits this development. 57. The permanent street name sign shall be installed immediately after the curb and gutter construction is complete. 58. The developer/contractor shall make accessible any or all City utilities as directed by the City Engineer. 59. Additional comments may be added at any time due to incomplete plans, plan changes and mistakes, errors or omissions. 60. Fire Hydrants shall be able to flow 1500 gpm with a 20 psi residual pressure. Street Hydrants shall be spaced every 300 ft, and within 150 ft of any building. Hydrants shall be installed prior to commencement of construction with combustible materials. Fire Hydrant locations shall be approved by the Fire Marshal prior to final map/site improvements. The most remote hydrant shall be flow tested by a qualified person or the Fire Marshal prior to possession by the water department. Flow test shall be submitted to the Fire Marshal. 61. Roadways shall provide a minimum 20 feet of unobstructed travel. Vertical clearance of not less than 15 ft shall be provided. Road widths shall be as follows, or an exception from the Fire Chief obtained. a. Less than 28 ft. no parking on either side b. 28 ft. to less than 36 ft, no parking on one side. c. Over 36 ft parking not restricted. EXHIBIT A 5 4/27/06 62. Where parking is restricted, it shall be posted with signs for No Parking-Fire Lane and curbs shall be painted red. Signage and curb painting shall be maintained in good condition. The parking enforcement plan shall be reviewed and approved by Deputy Fire Marshal prior to the final inspection of the first unit built. The parking enforcement plan shall be provided by the developer for the HOA to follow, and shall be included in the CC&R's. 63. Final map to include a paragraph that reads: "Red curbing and signage shall be maintained by the Home Owners Association. A parking enforcement shall be implemented by the Homeowners Association. " 64. Dead-end streets in excess of 150 ft shall be provided with a turn around that meets the Fire Department Standard. 65. Secondary access shall be provided when 24 or more units served. Secondary access is to provide a second means to the project area as a whole. Secondary Fire access other than a standard roadway to be reviewed and approved Fire Chief. Gated Access Roadways shall be provided with electronic and provided with an Opticom opening system compatible with the Fire Department equipment. 66. Site improvement plans shall provide adequate water connections to support an NFP A 13 D fire sprinkler system for single family dwellings. This condition shall be noted on the final map cover page and site improvement plans shall show the meter size required. 67. Applicant will return to the Street Naming Committee to obtain an approved street name for the street adjacent to the northernmost property boundary. 68. All private streets shall have a minimum travel lane of 11 feet each direction for a total width in section of22 feet. Gilroy Cannery Mixed-Use Development Master Plan 2 11/21/05 Negative Declaration Findine:s & Reasons: The Initial Study identified potentially significant effects on the environment. However, this project has been mitigated (see Mitigation Measures below which avoid or mitigate the effects) to a point where no significant effects will occur. There is no substantial evidence the project may have a significant effect on the environment. The following reasons will support these findings: >> The proposal is a logical component of the existing land use of this area and a logical and necessary redevelopment of a blighted brown fields site. >> Identified adverse impacts are proposed to be mitigated through preparation of special studies and construction of on-site improvements. >> The proposed project is consistent with the adopted goals and policies of the General Plan of the City of Gilroy and the Downtown Specific Plan. >> City staff independently reviewed the Initial Study, and this Negative Declaration reflects the independent judgment of the City of Gilroy. >> With the application of the following Mitigation Measures the proposed project will not have any significant impacts on the environment. Mitigation Measures: Impact: Construction and demolition activities related to the development of the proposed project could result in significant short-term air quality impacts. Gilroy Cannery Mixed-Use Development Master Plan 32 Initial Study City of Gilroy November 2005 I. Mitie:ation and Avoidance Measures: Implementation of the following dust control measures will reduce air quality impacts from demolition on the site to a less than significant level: · Watering should be used to control dust generation during demolition of structures and break- up of pavement. · Cover all trucks hauling demolition debris from the site. · Use dust-proof chutes to load debris into trucks whenever feasible. BAAQMD has prepared a list of construction dust control measures that will reduce construction impacts to a less than significant level. The following construction practices would be implemented during all phases of construction on the project site: · Water all active construction areas at least twice daily. · Water or cover all stockpiles of debris, soil, sand, or other materials that can be blown by the wind. · Cover all trucks hauling soil, sand, and other loose materials or require all trucks to maintain at least two feet of freeboard. · Pave, apply water three times daily, or apply (non-toxic) soil stabilizers on all unpaved parking areas and staging areas at construction sites. Gilroy Cannery Mixed-Use Development Master Plan 3 11/21/05 Negative Declaration · Sweep daily (preferably with water sweepers) all paved access road, parking areas and staging areas at construction sites. · Sweep streets daily (preferably with water sweepers) ifvisible soil material is carried onto adjacent public streets. · Hydroseed or apply non-toxic soil stabilizers to inactive construction areas. · Enclose, cover, water twice daily or apply non-toxic soil binders to exposed stockpiles (dirt, sand, etc.). · Install sandbags or other erosion control measures to prevent silt runoff to public roadways. · Replant vegetation in disturbed areas as quickly as possible. Impact: The loss of a maternity colony for any bat species, regardless of the species' status, would constitute a significant impact. 2. Miti2ation Measures: Implementation of the following measures will reduce impacts to special-status bat species to a less than significant level. · A qualified bat biologist will be retained by the project applicant to complete predemolition bat surveys to determine if special-status bat species are present on the site. If no bats are observed to be roosting in these buildings, then no further action would be required and demolition can proceed. Ifbats are found to be roosting on the site, however, the project proponents should exclude bats prior to demolition to ensure no harm or take would occur to any special-status bats as a result of demolition activities. Demolition should occur after 31 August and before 1 March to avoid interfering with an active nursery. If a non-breeding bat hibernaculum is found in the vacant structures to be demolished, the individuals should be safely evicted, under the direction of a qualified bat biologist, through a "partial dismantle" process, whereby the roosting area is opened to allow airflow through and sunlight into the building, making it unsuitable habitat and undesirable for the bats to return to the site. Demolition should then follow no later than the following day (i.e., there should be no less than one night between initial disturbance for airflow and the demolition). This action should allow bats to leave during the night, thus increasing their chances of finding new roosts with a minimum of potential predation during daylight hours. Impact: Removal of existing bridges on the project site may result in an impact to nesting swallows. 3. Miti2ation Measures: If demolition occurs during the nesting season (1 March through 31 July), the following mitigation will reduce impacts to nesting swallows to a less than significant level. A pre- demolition survey for nesting swallows will be completed in all buildings and for all bridges to be destroyed. If swallows are determined to be absent during the nesting season surveys, demolition can proceed without further mitigation. If swallows are determined to be present, then demolition of all structures cannot proceed until it has been determined that all young swallows have fledged. Gilroy Cannery Mixed-Use Development Master Plan 4 11/21/05 Negative Declaration Impact: Construction activities that adversely affect the nesting success of raptors and loggerhead shrike or result in mortality of individual birds would result in a significant impact. 4. Miti2ation Measures: Implementation of the following measures will ensure that raptors (e.g., hawks, falcons, owls, etc.) and loggerhead shrike are not disturbed during the breeding season. · A qualified ornithologist will complete a pre-construction survey for tree-nesting raptors in all trees and for loggerhead shrike in all shrubs occurring within 250 feet of project building envelopes within 30 days of the onset of ground disturbance, if such disturbance will occur during the breeding season (1 February through 31 August). If nesting raptors or loggerhead shrike are detected on the site during the survey, a construction buffer of 250 feet for raptors and 50 feet for loggerhead shrikes will be established around each active nest for the duration of the breeding season or until it has been confirmed that all chicks have fledged. Pre-construction surveys during the non-breeding season are not necessary for tree-nesting raptors or shrikes, as they are expected to abandon their roosts during construction. · A qualified ornithologist will complete pre-construction surveys for burrowing owls onsite within 30 days of the onset of ground disturbance. These surveys will be conducted in a manner consistent with accepted burrowing owl survey protocols. If pre-construction surveys determine that burrowing owls occupy the site during the non-breeding season (1 September through 31 January), then a passive relocation effort (i.e., blocking burrows with one-way doors and leaving them in place for a minimum of three days) may be necessary to ensure that the owl is not harmed or injured during construction. Once it has been determined that owls have vacated the site, the burrows can be collapsed, and ground disturbance can proceed. Ifburrowing owls are detected on the site during the breeding season (1 February through 31 August), a construction buffer of 250 feet will be established around any active owl nests and remain in place for the duration of construction activities or through the end of the breeding season. Impact: Impacts to Miller Slough from site redevelopment, including bridge construction, would result in a significant impact. 5. Miti2ation Measures: Implementation of the following mitigation measures will reduce impacts to Miller Slough to a less than significant level. · Due to ongoing anthropogenic influences resulting in low quality habitat in the slough, the project will mitigate impacts to Miller Slough at a 2: 1 replacement-to-loss ratio for permanent impacts and reseeding in temporarily disturbed areas. The maximum amount of mitigation required for permanent impacts on the site is 0.42 acres. Reseeding will be required in the 0.09 acres that will be temporarily impacted by bridge construction. Gilroy Cannery Mixed-Use Development Master Plan 5 11/21/05 Negative Declaration · Prior to issuance of a building permit for the project, a detailed restoration and monitoring plan, including specific success criteria, will be developed in consultation with a qualified restoration ecologist and submitted to the City of Gilroy Community Development Department Planning Division and all other required permitting agencies. The mitigation area will be monitored in accordance with the plan approved by the permitting agencies. The monitoring plan will include final success criteria, performance criteria, monitoring methods, data analysis, as-built plans, monitoring schedule, contingency/remedial measures, and reporting requirements. · Mitigation for impacts to Miller Slough will occur on-site within the slough. Replacement tree plantings for removed or impacted trees could occur along the east bank of the channel on the property's west side and along the north bank near the Forest Street bridge. Reseeding will occur anywhere within the slough not impacted by the construction of the bridge. · In the event the plans for a bridge over Miller Slough are eliminated, all impacts to the slough would be avoided and the proposed mitigation would not be required. Impact: The proposed project will remove 22 significant trees from the project site. 6. Miti2ation Measures: Conformance with the City's Landscaping Policy and implementation of the Tree Protection Zone, as described below, and the following mitigation measures will reduce impacts to trees from development to a less than significant level and maintain and improve retained trees' health and vitality: Tree Protection Zone · A Tree Protection Zone (TPZ) shall be established around trees to be retained on the project site. For design purposes, the TPZ shall be defined at the edge of the dripline. No grading, excavation, construction, or storage of materials shall occur within that zone. · No underground services, including utilities, sub-drains, water, or sewer shall be placed in the TPZ. · Any herbicides placed under paving materials must be safe for use around trees and labeled for that use. · Irrigation systems must be designed so that no trenching shall occur within the TPZ. Pre-construction · The construction superintendent shall meet with a Certified Arborist before beginning work to discuss work procedures and tree protection. · Fence all trees to be retained to completely enclose the TPZ prior to demolition, grubbing, or grading, Fences shall be six feet chain link or equivalent as approved by a certified arborist. Fences are to remain until all grading and construction is completed. · Prune trees to be preserved to clean the crown and to provide clearance. All pruning shall be completed by a Certified Arborist or Tree Worker and adhere to the Best Gilroy Cannery Mixed-Use Development Master Plan 6 11/21/05 Negative Declaration Management Practices for Pruning of the International Society of Arboriculture. During construction · No grading, construction, demolition, or other work shall occur within the TPZ. Any modifications must be approved and monitored by a Certified Arborist. · Any root pruning required for construction purposes shall receive the prior approval of, and be supervised by, a Certified Arborist. · Supplemental irrigation shall be applied as determined by a Certified Arborist. · If injury should occur to any tree during construction, it should be evaluated as soon as possible by a Certified Arborist so that appropriate treatments can be applied. · No excess soil, chemicals, debris, equipment, or other materials shall be dumped or stored within the TPZ. · Any additional tree pruning needed for clearance during construction must be performed by a Certified Arborist and not by construction personnel. Tree Replacement Ratios · Significant trees removed shall be replaced on the site with 15 gallon or larger tree specimens, at the City's standard replacement ratio of3:1 (3 replacement for 1 removed), or a project- specific ratio to be determined by the City, whichever is greater. · Trees removed that do not meet the City's significant tree criteria shall be replaced on the site with 15 gallon or larger tree specimens, at a ratio to be determined by the City. Impact: The deposition of pollutants and sediments in sensitive wetland habitats would result in a significant impact. 7. Mitigation Measures: Implementation of the following mitigation measures will reduce construction impacts to water quality in seasonal drainages, reservoirs, and downstream waters from the proposed project to a less than significant level. · The applicant must comply with the provisions of the City's grading permit, including standard erosion control measures that employ best management practices (BMPs). · The project involves grading large tracts of land and therefore will comply with provisions of the General Construction permit from the Regional Water Quality Control Board. Impact: Although the project is not likely to encounter buried cultural resources, it will be required to adhere to standard measures required by the City of Gilroy for projects with earth-moving activities. 8. Mitie:ation and Avoidance Measures: Implementation of the following measures would reduce the impacts of a buried cultural resources find to a less than significant level. · If archaeological resources or human remains are discovered during construction, work shall be halted within 50 meters (165 feet) of the find until a qualified professional archaeologist can evaluate it. If the find is determined to be significant, appropriate mitigation measures shall be formulated and implemented (Gilroy General Plan Policy 5.07). Gilroy Cannery Mixed-Use Development Master Plan 7 11/21/05 Negative Declaration · If human remains are found during construction, there shall be no further excavation or disturbance of the site or any nearby area reasonably suspected to overlie adjacent human remains until the coroner of Santa Clara County is contacted to determine that no investigation of the cause of death is required. If the coroner determines the remains to be Native American the coroner shall contact the Native American Heritage Commission within 24 hours. The Native American Heritage Commission shall identify the person or persons it believes to be the most likely descendent (MLD) of the deceased Native American. The MLD may then make recommendations to the landowner or the person responsible for the excavation work, for means of treating or disposing of, with appropriate dignity, the human remains and associated grave goods as provided in Public Resources Code Section 5097.98. The landowner or his authorized representative shall rebury the Native American human remains and associated grave goods with appropriate dignity on the property in a location not subject to further disturbance if: a) the Native American Heritage Commission is unable to identify a MLD or the MLD failed to make a recommendation within 24 hours after being notified by the commission; b) the descendent identified fails to make a recommendation; or c) the landowner or his authorized representative rejects the recommendation of the descendent, and the mediation by the Native American Heritage Commission fails to provide measures acceptable to the landowner. Impact: Expansive soils present on the site could stress and damage the foundations and slabs of the proposed buildings for the site. 9. Miti2ation Measures: The project proposes to implement the following measures to reduce the impacts ofthe project to a less than significant level: · The effects of soil expansion and contraction on the below grade garage floor slabs will be reduced by casting the concrete over a layer of nonexpansive material or by treating sub grade soils with lime. · Buildings constructed at-grade will be supported by post-tensioned slabs designed to resist the effects of soil expansion and contraction. These slabs will also be designed to resist differential settlement. Impact: The project site is located in a region subject to strong seismic ground shaking, which can adversely affect structures and expose people to safety hazards; however, there is no danger from fault rupture on the site. 10. Miti2ation and Avoidance Measures: The project includes the following mitigation and avoidance measures to reduce seismic impacts to a less than significant level: · At a minimum, structures on the site will be designed to resist seismic ground shaking in accordance with Seismic Zone 4 building criteria as described in the Uniform Building Code. Gilroy Cannery Mixed-Use Development Master Plan 8 11/21/05 Negative Declaration Project Specific Mitigation Measures The project proposes to include the following measures during development, which would reduce potential soils and geology impacts to a less than significant level: · The documented water well, groundwater monitoring wells to be decommissioned, and other wells that may be encountered during construction on the site will be abandoned in accordance with the requirements of the Santa Clara Valley Water District (SCVWD). Abandoned wells will be left at a minimum of five feet below the proposed finish grade. · If the use of pier foundations or other soil improvement techniques are used on the site, a project specific geotechnical report will be required. · Following site preparation and removal or abandonment of existing utilities and wells, the soil should be overexcavated and replaced as compacted fill where buildings or other on- grade improvements are planned. · Soil will be overexcavated to a minimum depth of four feet below existing grade or four feet below the proposed finish grade, whichever is deeper, in areas to receive ongrade structures. The overexcavated areas will extend a minimum of five feet beyond the proposed foundation perimeters and three feet beyond the edges of exterior concrete flatwork adjacent to the building. · The project will adhere to the recommendations of the preliminary geotechnical report prepared for the proposed project. At the time of final site design, a designlevel geotechnical investigation will be completed to develop specific design criteria for the proposed project. All geotechnical studies will be submitted to the City of Gilroy Building, Life, and Environmental Safety Department. Impact: Concentrations of pesticides, metals, and polyaromatic hydrocarbons have been identified throughout the site and, for purposes of disposal, may be classified by the State of California as hazardous waste. 11. Miti2ation Measures: The following mitigation measure will reduce impacts from the disposal of hazardous materials from the site: · If soil will be exported from the site, analytical testing and waste characterization will be conducted prior to off-site disposal at a landfill permitted to accept the type of contamination and concentrations present in the soil. Impact: The project site contains levels of total petroleum hydrocarbons as gasoline and benzene that contribute to soil vapor concentrations exceeding human health screening criteria, which may result in hazardous materials impacts to future users of the site. Gilroy Cannery Mixed-Use Development Master Plan 9 11/21/05 Negative Declaration 12. Miti2ation Measures: The following measures are included in the project to reduce or avoid hazards associated with existing soil and groundwater contamination on the site: · The City of Gilroy Fire Department (CGFD) approved the Remedial Action Plan for the site on July 1,2005. The selected remediation system will use soil vapor extraction combined with air sparging. Air sparging is the injection of ambient air or oxygen through wells to promote biodegradation of organic compounds in groundwater. The system will initially be designed to address the area where higher TPHg and benzene concentrations are identified. Prior to commencement of construction and startup of the treatment system, the remediation project will require a City of Gilroy Building Permit; electrical, plumbing, and building plan review and inspection; hazardous materials and fire prevention plan review and inspection by the CGFD; BAAQMD, Authority to Construct and Permit to Operate; and well permits from SCVWD. · Cleanup and remediation of the site will be required to meet all federal, state, and local regulations. The underground storage tank which was previously abandoned in place on the site will be removed according to the City of Gilroy Fire Department standards prior to development. · As the buildings and concrete are demolished, a qualified hazardous materials consultant will observe underlying soils for staining or other indications of a potential release of contaminants. If suspect areas are identified, soil samples would be collected and analyzed for the potential presence of site contamination, and remediation will be completed, as appropriate. · Air and health impacts from the removal of contaminated soil will be avoided through dust control, proper handling, and health and safety measures to be used during remediation. A Work Plan and Health and Safety Plan will be prepared for the site by a qualified hazardous materials consultant and submitted to the overseeing regulatory authority for approval. · In the event additional areas of contamination are discovered, the CGFD will provide oversight of remediation activities as the local Certified Unified Program Agency. The following measures are included in the proposed project to reduce or avoid hazards associated with demolition of existing buildings on the site: · All demolition activities will be undertaken according to Cal/OSHA and EP A standards to protect workers and off-site occupants from exposure to asbestos, lead based paint, and other hazardous materials. If friable asbestos-containing materials or materials containing more than one percent asbestos are present, the materials will be handled by a registered asbestos abatement contractor in accordance with the regulations and notification requirements of the Bay Area Air Quality Management District (BAAQMD). Impact: The proposed redevelopment of the project site could result in new sources of pollutants in runoff and significant water quality impacts during the construction and postconstruction period. Gilroy Cannery Mixed-Use Development Master Plan 10 11/21/05 Negative Declaration 13. Miti2ation Measures: The following mitigation measures are proposed as part ofthe project to reduce water quality impacts from the project: Construction Impacts · The following erosion and sediment control measures, based upon Best Management Practices recommended by the Regional Water Quality Control Board, are included in the project to reduce potential construction-related water quality impacts. - Stormwater inlet protection consisting of burlap bags filled with drain rock will be installed around storm drain inlets to keep sediment and other debris out of the stormwater drainage system. - All exposed or disturbed soil surfaces will be watered at least twice daily to control dust as necessary. - Earthmoving or other dust-producing activities will be suspended during periods of high winds. - Stockpiles of soil or other materials that can be blown by the wind will be watered or covered. - All trucks hauling soil, sand, and other loose materials will be covered and all trucks will be required to maintain at least two feet of freeboard. - All paved access roads, parking areas, and staging areas adjacent to the construction sites will be swept daily with water sweepers. - Vegetation in disturbed areas will be replanted as quickly as possible. · The project will comply with the NPDES General Construction Activity Stormwater Permit administered by the Regional Water Quality Control Board. Prior to construction grading for the proposed land uses, the applicant will file a "Notice ofIntent" (NOI) to comply with the General Permit and prepare a Stormwater Pollution Prevention Plan (SWPPP) which addresses measures that would be included in the project to minimize and control construction and post-construction runoff. The SWPPP will be submitted to the City of Gilroy Community Development Department. The following measures would be included in the SWPPP: - Preclude non-stormwater discharges to the stormwater system. - Effective, site-specific Best Management Practices for erosion and sediment control during the construction and post-construction periods. - Coverage of soil, equipment, and supplies that could contribute non-visible pollution prior to rainfall events or perform monitoring of runoff. - Perform monitoring of discharges to the stormwater system. · The project will submit a copy of the draft SWPPP to the City of Gilroy Community Development Department for review and approval prior to construction of the project. When the construction phase is complete, a Notice of Termination (NOT) for the General Permit for Construction will be filed with the Regional Water Quality Control Board and the City of Gilroy Community Development Department. The NOT will document that all elements of the SWPPP have been executed, construction materials and waste have been properly disposed of, and a post-construction stormwater management plan is in place as described in the SWPPP for the site. Gilroy Cannery Mixed-Use Development Master Plan 11 11/21/05 Negative Declaration Post-Construction Impacts The project will include several features to minimize non-point source pollutants from entering Miller Slough and Llagas Creek during the post-construction period. The project proposes to minimize and reduce directly connected impervious areas and non-point source pollutants by using a combination of the following measures as a part of final site design: · discharge stormwater flows from impervious surfaces to landscaped areas; · installation of vegetated swales to allow infiltration of stormwater; · installation of mechanical stormwater treatment devices; · use of landscape species that minimize irrigation, runoff, pesticide, and fertilizer application; and · stormwater catch basins will be stenciled to discourage illegal dumping. The applicant will submit a plan of site design measures that specify these elements prior to issuance of permits. Impact: Due to the close proximity of existing noise sensitive uses, such as residential houses along Forest Street or the Rebekah Children's Home, construction would result in a significant temporary noise impact. 14. Mitie;ation Measures: The project proposes the following mitigation measures to reduce noise impacts from construction to a less than significant level: · Construction activity will be limited to weekdays between 7:00 AM and 7:00 PM and Saturdays and holidays between 9:00 AM and 7:00 PM, with no construction on Sundays; · Noisy stationary equipment will be located away from homes; · Compressors and trucks will be turned off when not in use instead of being allowed to idle; · All construction equipment will be in good working order and the mufflers will be inspected for proper functioning; · Sound walls will be constructed prior to developing the project site; and · The project applicant will designate a construction noise coordinator. This coordinator will be available to respond to complaints from neighbors and take appropriate measures to reduce noise, where possible. Impact: Noise levels exceed the City's outdoor noise standards at the open spaces adjacent to Miller Slough and the railroad tracks. IS. Miti2ation Measures: The following mitigation measures would reduce the impacts of noise on outdoor use areas to a less than significant level: · In order to discourage active use of the open space along Miller Slough which would expose users to elevated noise levels, tables and benches will not be located in this area. Gilroy Cannery Mixed-Use Development Master Plan 12 11/21/05 Negative Declaration Impact: Interior ambient noise levels in buildings on the site would exceed the City's acceptable levels for residential and commercial use. 16. Miti2ation Measures: The project proposes the following mitigation measures to reduce interior ambient noise impacts to a less than significant level. · For residential units at the mixed-use building closest to the UPRR, a minimum STC 43 window would be required for all units facing the tracks. The exterior wall construction should be upgraded from the standard single stud wall with three-coat stucco to a staggered stud construction with three-coat stucco exterior and two layers of gypsum board on the interior with batt insulation. This construction should wrap the ends of the building as well. For dwelling units facing away from the tracks, a minimum STC 29 window would be required to meet the City's indoor noise standard. The upgraded exterior fa9ade construction would not be necessary for units facing away from the tracks. · Commercial storefront space directly facing the railroad tracks will require windows with a minimum STC 28 rating, assuming 100 percent ofthe exterior fa9ade is windows, to achieve the City's indoor noise criterion ofLdn 61 dBA. · Residential units east of Cannery Row are located further away from the railroad tracks and are partially shielded by the mixed-use building facing the UPRR. Because of the increased distance, the minimum sound-rated window requirement is STC 34 for all windows having line-of-sight to the railroad tracks. Standard single stud construction with three-coat stucco should be acceptable for the exterior wall assembly. · Residences north of Miller Slough are single-family houses and townhouses that vary in distance to the railroad tracks. The houses closest to the tracks will require a minimum STC 34 window, to meet the City of Gilroy's standard residential interior Ldn of 45 dBA, while the houses furthest away should be able to meet the indoor Ldn noise requirements with standard dual glazed windows in the closed position. · At the time final architectural drawings are available for review, the sound-rated window and construction requirements for all building types and locations throughout the project site will be reevaluated by a qualified acoustical consultant. Impact: Residential and commercial spaces facing the railroad tracks will be exposed to single-event noise that would exceed the City's indoor noise level standards. 17. Miti2ation Measures: The project proposes the following measures to reduce the impact from single event noise from trains. · In order to reduce the typical single event noise level of 100 dBA within residential units on the site, 50 percent of the exterior fa9ade was assumed to be windows. These units would be subject to the Lmax goal of 50 dBA for bedrooms. To achieve this goal, STC 53 windows would be required. As with the Ldn analysis, the exterior facade facing the tracks would also need to be upgraded to the staggered stud construction. Windows with sound insulation ratings this high are not common. The highest sound insulation available from Milgard brand windows, for example, is STC 46. The use of STC 46 windows would achieve an indoor Lmax noise level of 57 dBA assuming an exterior noise level of 100 dBA. An interior maximum noise level of 57 dBA could potentially cause sleep disturbance. Gilroy Cannery Mixed-Use Development Master Plan 13 11/21/05 Negative Declaration · Residential units facing away from the railroad tracks receive up to 15 decibels of shielding from the building. The resulting typical train horn noise would be 85 dBA. To achieve the Lmax goal of 50 dBA in bedrooms, STC 37 windows would be required, To achieve the Lmax goal of 55 dBA in other rooms, STC 30 windows would be required. · Some units in the center ofthe project site have a direct line-of-sight to the railroad tracks. The estimated typical noise level from train horns at these units would be 95 dBA. To achieve the Lmax goal of 50 dBA in bedrooms, STC 46 windows would be required. To achieve the Lmax goal of 55 dBA in other rooms, STC 41 windows would be required. · Other residences are set back further from the railroad tracks and are shielded by the mixed- use building nearest the railroad. These units would require STC 37 windows in bedrooms and STC 30 windows in other rooms to meet the single event noise criteria. · The residences north of Miller Slough range in both distance and exposure to the railroad tracks. As such, the STC ratings to achieve the single event noise criteria will also vary. The closest single-family houses are located 200 feet from the railroad tracks and would be typically exposed to 100 dBA from a train horn. To achieve the Lmax goal of 50 dBA in bedrooms, STC 46 windows would be required. To achieve the Lmax goal of 55 dBA in other rooms, STC 41 windows would be required. Impact: The project design would create operational safety hazards at various intersections on the project site. 18. Miti2ation Measures: The following mitigation measures are proposed to reduce the vehicle safety hazards resulting from site design to a less than significant level. · In order to effectively discourage project traffic from using Alexander Street, a wider and/or additional island is necessary. When designed properly, the raised islands would reduce the conflict from left- and right-turning vehicles at the intersection. The project applicant will be required to install at least one island at the intersection of Alexander and Lewis Streets. The number and location of the islands will be determined and designed (in consultation with the City of Gilroy Transportation Engineer) to eliminate safety hazards from conflicting turning movements. · Adequate sight distances will be achieved by providing space for stopped vehicles to pull forward an additional five feet at the intersections on Lewis Street and an additional three feet at the intersections on Forest Street. Bulb outs at the intersections would allow for the sidewalk and limit line to be moved further out into the intersection and improve the sight triangles at the project intersections. Impact: The project would contribute to a cumulative traffic impact at the intersection of Monterey Street and Sixth Street. .. Gilroy Cannery Mixed-Use Development Master Plan 14 11/21/05 Negative Declaration 19. Mitie:ation Measures: One of the following two mitigation measures will be implemented to reduce the project's cumulative impacts at the Monterey Street and Sixth Street intersection. · The project would restripe the east and west approaches (Sixth Street) to include separate left- turn pockets and shared through/right-turn lanes. This improvement would require eliminating curbside parking on Sixth Street near the intersection. Implementation of these improvements would restore intersection operations to LOS C during the PM peak hour. These improvements were not previously identified in the City's Traffic Circulation Master Plan and are not currently included in the City's Traffic Impact Fee Program. · Alternatively, the City may include this intersection in a future adopted Protected Intersections Program, Mello-Roos district, or the Traffic Impact Fee Program. The adoption of such a program by the City of Gilroy would be subject to separate environmental review. If the intersection is included in the program, the project may contribute the required fees for the development in-lieu of the intersection improvements described above. ImDact: The project would contribute to a cumulative traffic impact at the intersection of Murray Avenue and Leavesley Road. 20. Mitie:ation Measures: One of the following two mitigation measures will be implemented to reduce the project's cumulative impacts at the Murray A venue and Leavesley Road intersection. · The project would add a second westbound left-turn pocket on Leavesley Road at Murray A venue to restore the intersection operations to LOS C during the PM peak hour. These improvements were not previously identified in the City's Traffic Circulation Master Plan and are not currently included in the City's Traffic Impact Fee Program. · Alternatively, the City may include this intersection in a future adopted Protected ~tersections Program, Mello-Roos district, or the Traffic Impact Fee Program. The adoption of such a program by the City of Gilroy would be subject to separate environmental review. If the intersection is included in the program, the project may contribute the required fees for the development in-lieu of the intersection improvements described above.
