RESOLUTION NO. 2006-68
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
GILROY AMENDING THE CITY OF GILROY CONFLICT OF
INTEREST CODE TO ADD POSITIONS AND CHANGE THE
TITLES OF CERTAIN PERSONS SUBJECT TO THE CODE.
WHEREAS, the Political Reform Act, Government Code section 81000 et seq., requires
state and local agencies to adopt and promulgate conflict of interest codes, and the City of Gilroy
("City") is an agency subject to said statute; and
WHEREAS, the City has adopted the terms of2 Cal. Code of Regs. section 18730, and any
amendments thereto, taken with appendices prepared and adopted by the City, as the Conflict of
Interest Code ofthe City; and
WHEREAS, due to reorganization, the City has added the positions of Assistant City
Administrator, Assistant Finance Director, Assistant City Attorney, Budget Analyst, Development
Center Manager, Fire Marshal, Information Technology Director, and Plan Check Engineer; and
WHEREAS, due to reorganization, the City has eliminated the positions of Administrative
Service Director and Deputy Director of Community Development; and
WHEREAS, the City has eliminated the position of City Treasurer from its list of
designated employees because that position is governed by California Government Code section
87200; and
WHEREAS, it is the intent of the City to modify Appendix I of Res. 2004-88 to reflect
these changes;
NOW, THEREFORE, BE IT RESOLVED THAT:
Appendix I to Res. 2004-88 regarding the City's Conflict of Interest Code, designating the
employees who shall be subject to the City's Conflict of Interest Code, shall be deleted in its

entirety and replaced with Appendix I as set forth in Exhibit 1, attached hereto and incorporated
herein by this reference.

DISCLOSURE CATEGORIES
Category 1
A designated employee in this category must report all investments, interests in real property
owned in the City of Gilroy, income and business entities in which he or she is a director, officer,
partner, trustee, employee or holds any position of management.
1 Consultants are included in the list of designated employees and shall make disclosures pursuant to Category I subject to the
following limitation: The City Administrator may determine in writing that a particular consultant, although a "designated
position," is hired to perform a range of duties that is limited in scope and thus is not required to fully comply with these
disclosure requirements. The appropriate interests to be disclosed, if any, shall be determined by the City Administrator in
conjunction with the City Attorney. Such determination shall include a description of the duties of the consultant and, based
upon that description, a statement of the extent of disclosure requirements. The City Administrator's determination shall be in
writing, is a public record, and shall be retained for public inspection in the same manner and location as this Conflict ofInterest
Code. All agreements with a consultant, whether or not such consultant is required to file a disclosure statement in accordance
with this resolution, shall contain a certification by the consultant that no conflict of interest exists in connection with the
contract being entered into between the consultant and the City.

Resolution No. 2006-68 is an original resolution, or true and correct copy of a city resolution,
duly adopted by the Council of the City of Gilroy at a regular meeting of said Council held on the
2nd day of October, 2006, at which meeting a quorum was present.
