A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
GILROY APPROVING GP A 06-02, A REQUEST TO AMEND
THE HECKER PASS SPECIFIC PLAN ON APPROXIMATELY
423 ACRES IN THE AREA NORTH AND SOUTH OF HECKER
P ASS HIGHWAY AND WEST OF SANTA TERESA

WHEREAS, the applicants, referred to collectively as the Hecker Pass Property Owners,
submitted application GP A 06-02 requesting certain amendments to the Hecker Pass Specific
Plan which was adopted by the City Council on January 18, 2005 by Resolution No. 2005-03, for
approximately 423 acres in the area north and south of Hecker Pass Highway and west of Santa
Teresa Boulevard, APNs 810-20-015, 004-009, 011-013; 810-21-001, 003-005, 007; 783-04-
011,018; 783-03-002,003,070;783-02-004,009,010,020,026,030-033;and
WHEREAS, the requested amendments are referred to herein as "the Project," and are
specifically set forth in Exhibit "A" attached hereto; and
WHEREAS, the Planning Commission held a duly noticed public hearing on December
7, 2006, at which time the Planning Commission considered the public testimony, the staff report
dated November 28, 2006 ("Staff Report"), and all other documentation related to application
GP A 06-02, and recommended that the City Council adopt the Negative Declaration for the
Project and approve said application; and
WHEREAS, the City Council held a duly noticed public hearing on December 18,2006,
at which time the City Council considered the public testimony, the Staff Report, a supplemental

staff report dated December 12, 2006, and all other documentation related to application
GPA 06-02; and
WHEREAS, pursuant to the California Environmental Quality Act ("CEQA"), the City
Council, following its public hearing on December 18, 2006, considered the proposed Negative
Declaration together with any comments received during the public review process and adopted
the Negative Declaration, attached hereto as Exhibit "B," finding that the Negative Declaration
was completed in compliance with CEQA, that the Negative Declaration reflects the independent
judgment of the City, and that there is no substantial evidence in the entire record that the Project
as mitigated will have a significant effect on the environment; and
WHEREAS, the location and custodian of the documents or other materials which
constitute the record of proceedings upon which this project approval is based is the office of the
City Clerk.
NOW, THEREFORE, BE IT RESOLVED THAT:
A. The City Council hereby finds as follows:
1. The proposed amendments are generally consistent with the intent of the
goals and policies of the City's General Plan document, in particular Policies 1.07
(Hecker Pass), 1.10 (Gateways), and 6.01 (Scenic Highways), as more fully
discussed in the Staff Report.
2. The proposed amendments are generally consistent with the intent of the
goals and policies ofthe Hecker Pass Specific Plan.
3. The proposed amendments are in the public interest because they will limit
the removal of deodar cedar trees along the Hecker Pass corridor and improve the

chance that the State will designate Highway 152 as a Scenic Highway.
B. The City Council hereby adopts the Mitigation Monitoring Program for this Project,
attached hereto as Exhibit "c."
C. Based on the findings in subsection A above, the City Council hereby approves
application GP A 06-02 requesting certain amendments to the Hecker Pass Specific Plan as set
forth in Exhibit "A," subject to the mitigation measures set forth in the Negative Declaration
(Exhibit "B") and the Mitigation Monitoring Program (Exhibit "C").
D. This Resolution shall be in full force and effect thirty (30) days after the date of
its adoption.

The applicants request the following changes to the text and figures of the Hecker Pass Specific
Plan. Changes are intended to eliminate wording regarding the east intersection or mention of two
new intersections, and clarify wording regarding unit transfers.

The Residential Cluster land use designation is designed to allow for a diverse mix of residential
unit types, similar to the City of Gilroy's Neighborhood District land use designation. By
establishing a "target mix" ofIot types, the Specific Plan ensures that numerous housing types are
provided. Lot types have been generally described as falling into three lot type or typical lot size
categories: Typically 2500-3500 SF Lots, Typically 3500-6000 SF Lots, and Typically greater
than 6000 SF Lots. Individual lot sizes within each category may vary according to Policy 3-18.
By providing a bulk of the residential units in the mid-range ofIot types (typically 3500-6000 SF
Lots) and requiring a certain percentage of smaller lot types (typically 2500-3500 SF Lots), the
Specific Plan provides greater affordability than would occur if the site were developed with only
large lot residential units such as typically found in rural development. The Specific Plan also
allows for units to be transferred among Residential Clusters. so long as the total in any cluster

An initial study of this project was undertaken and prepared for the purpose of ascertaining
whether this project might have a significant effect on the environment. A copy of this study is
attached. The initial study was prepared to supplement the EIR prepared for the Hecker Pass
Specific Plan.
Findines & Reasons:
The initial study identified potentially significant effects on the environment. However, this
project has been mitigated (see Mitigation Measures below which avoid or mitigate the effects)
to a point where no significant effects will occur. On the basis ofthe whole record, there is no
substantial evidence the project will have a significant effect on the environment. The following
reasons will support these findings:
~ The elimination ofthe eastern access from the specific plan reduces construction impacts.
~ The only mitigations required are revisions to measures existing and previously adopted
in the specific plan.
~ A mitigation monitoring and reporting program have been prepared.
~ The proposed project is consistent with the adopted goals and policies of the General
Plan ofthe City of Gilroy, as well as the Hecker Pass Specific Plan.
~ City staff independently reviewed the Initial Study, and this Negative Declaration reflects
the independent judgment of the City of Gilroy.
~ With the application of the following Mitigation Measures the proposed project will not
have any significant impacts on the environment.
~ The Gilroy Planning Division is the custodian of the documents and other material that
constitute the record of proceedings upon which this decision is based.

T -1 (Specific plan mitigation measure 18)
Applicants for projects within the specific plan area shall be responsible for improving Hecker
Pass Highway immediately west of Santa Teresa Boulevard to include a second westbound travel
lane. The second westbound travel lane on Hecker Pass Highway, and the appropriate lane-drop
taper consistent with Caltrans' Standards, should extend as far as possible beyond (west of)
Santa Teresa Boulevard as can be accommodated within the existing public right-of-way, with
the design subject to approval by the City Engineer in his/her reasonable discretion. Applicants
shall coordinate with the City of Gilroy Engineering Division to design and implement the
widening project. Removal of deodar cedar trees along the highway must be avoided wherever
possible and improvements must be consistent with State scenic highway guidelines. Traffic
signal modifications should be made to the intersection of Santa Teresa Boulevard and First
Street/Hecker Pass Highway to add vehicle detection for the second eastbound through lane.
T -2 (Specific plan mitigation measure 19)
Applicants for projects within the specific plan area shall be responsible for shoulder
improvements to Hecker Pass Highway, per Caltrans' standards, between Santa Teresa
Boulevard and the easterly limits of the planned Caltrans Uvas Creek Bridge Improvement
project. Applicants shall coordinate with the City of Gilroy Engineering Division to design and
implement the shoulder improvements. Removal of deodar cedar trees along the highway must
be avoided wherever possible and improvements must be consistent with State scenic highway
guidelines.

MITIGATION MONITORING PROGRAM
Hecker Pass Specific Plan Amendment
Mitigation Monitoring Program
Introduction
CEQA Guidelines section 15097 requires public agencies to adopt reporting or monitoring
programs when they approve projects subject to an environmental impact report or a negative
declaration that includes mitigation measures to avoid significant adverse enyironmental effects.
The reporting or monitoring program is to be designed to ensure compliance with conditions of
project approyal during project implementation in order to avoid significant adverse
environmental effects.
The law was passed in response to historic non-implementation of mitigation measures
presented in environmental documents and subsequently adopted as conditions of project
approval. In addition, monitoring ensures that mitigation measures are implemented and
thereby proyides a mechanism to eyaluate the effectiveness of the mitigation measures.
A definitiye set of project conditions would include enough detailed information and
enforcement procedures to ensure the measure's compliance. This monitoring program is
designed to provide a mechanism to ensure that mitigation measures and subsequent conditions
of project approyal are implemented.
Monitoring Program
The basis for this monitoring program is the mItigation measures included in the project
mitigated negatiye declaration. These mitigation measures are designed to eliminate or reduce
significant adverse environmental effects to less than significant levels. These mitigation
measures become conditions of project approyal, which the project proponent is required to
complete during and after implementation of the proposed project.
The attached checklist is proposed for monitoring the implementation of the mItigation
measures. This monitoring checklist contains all appropriate mitigation measures in the
environmental impact report.
Monitoring Program Procedures
The City of Gilroy shall use the attached monitoring checklist for the proposed project. The
monitoring program should be implemented as follows:
1. The Gilroy Community Development Department should be responsible for
coordination of the monitoring program, including the monitoring checklist. The
Community Deyelopment Department should be responsible for completing the
monitoring checklist and distributing the checklist to the responsible individuals or
agencies for their use in monitoring the mitigation measures.
2. Each responsible individual or agency will then be responsible for determining whether
the mitigation measures contained in the monitoring checklist have been complied with.

agency should submit a copy of the monitoring checklist to the Community
Development Department to be placed in the project ftle. If the mitigation measure has
not been complied with, the monitoring checklist should not be returned to the
Community Deyelopment Department.
3. The Gilroy Community Deyelopment Department will reyiew the checklist to ensure
that appropriate mitigation measures and additional conditions of project approval
included in the monitoring checklist have been complied with at the appropriate time,
e.g. prior to issuance of a use permit, etc. Compliance with mitigation measures is
required for project approyals.
4. If a responsible individual or agency determines that a non-compliance has occurred, a
written notice should be delivered by certified mail to the project proponent within 10
days, with a copy to the Community Development Department, describing the non-
compliance and requiring compliance within a specified period of time. If non-
compliance still exists at the expiration of the specified period of time, construction may
be halted and fines may be imposed at the discretion of the City of Gilroy.

improvements to Hecker Pass Highway, per Caltrans' standards, between Santa Teresa
Boulevard and the easterly limits of the planned Caltrans Uvas Creek Bridge Improvement
project. Applicants shall coordinate with the City of Gilroy Engineering Diyision to design and
implement the shoulder improyements. Remoyal of deodar cedar trees along the highway must
be avoided wherever possible and improvements must be consistent with State scenic highway
guidelines.
