Resolution 2007-14 RESOLUTION NO. 2007-14 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF GILROY DECLARING CERTAIN WEEDS GROWING IN THE CITY OF GILROY TO BE A PUBLIC NUISANCE, DESCRIBING WEEDS WHICH CONSTITUTE SUCH NUISANCE, AND PROVIDING FOR GIVING NOTICE OF THE ADOPTION OF THE RESOLUTION BY PUBLICATION THEREOF WHEREAS, certain weeds are growing in the City of Gilroy ("City") upon the various streets, alleys, sidewalks and upon private property, which weeds bear seeds of a wingy or down nature, or which may attain such growth as to become, when dry, a fire menace, or which are otherwise noxious and dangerous; and WHEREAS, certain refuse is accumulating in the City upon public and private property; and WHEREAS, said weeds and refuse constitute a public nuisance. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Gilroy as follows: 1. That such weeds and refuse do now constitute and will continue to constitute a public nuisance, and it is ordered that said public nuisance be abated in the manner provided by Article III of Chapter 12 of the Gilroy City Code. 2. The said nuisance exists upon all of the streets, alleys, sidewalks and private property within said City as shown, described and delineated on the several maps of the property in the City which are recorded in the Office of the County Assessor of the County of Santa Clara, reference in each instance for the description of any particular street, alley or private property being hereby made to the several maps aforesaid, and in the event of there being several subdivision maps on which said lots are shown, reference is hereby made to the latest subdivision -1- IMDOLlNGERI718904.1 022707-04706083 Resolution No. 2007-14 map. 3. That it is ordered that Monday, the 4th day of June, 2007, at the hour of7:00 o'clock p.m. in the Council Chambers of the City Council of the City of Gilroy, 7351 Rosanna Street, Gilroy, California, is hereby fixed as the time and place when objections to the proposed destruction or removal of said weeds and refuse shall be heard and given due consideration. 4. That the Chief of the Fire Department of the City of Gilroy is hereby ordered and directed to cause notice of the adoption of this resolution and notice of said hearing to be given to all of the affected property owners at their stated mailing address on the latest tax assessor's role, and also to be given in the manner and form provided in Sections 12.49 and 12.53 ofthe Gilroy City Code, and to cause said notice to be published in the City of Gilroy, at least ten (10) days prior to said hearing.
