RESOLUTION NO. 2007-51
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
GILROY APPROVING AN AMENDMENT TO A1S-PUD 06-46,
ARCHITECTURAL AND SITE APPROVAL OF A PLANNED
UNIT DEVELOPMENT FOR AN 18 PARCEL RESIDENTIAL
SUBDNISION ON APPROXIMATELY 1.07 ACRES AT 341-385
GURRIES DRIVE, APNs 790-35-015, 016 and 017.
WHEREAS, Hanna Square Gilroy Independence/Chris Cote submitted application A1S-
PUD 06-46, requesting architectural and site approval of a Planned Unit Development to create
18 parcels, with 11 town homes and 7 single-family homes, and common open space on
approximately 1.07 acres ("the Project"), located at 341-385 Gurries Drive, northeast corner of
Gurries Drive and Hanna Street, APNs 790-35-015, 016 and 107; and
WHEREAS, the City Council adopted Resolution No. 2007-25 on April 2, 2007
approving said application in conjunction with approving the associated Tentative Map 06-15;
and
WHEREAS, the applicant requested that condition 61 of the architectural and site
approval requiring undergrounding of utility poles in the alleyway at the rear of the project be
reconsidered and deleted; and
WHEREAS, staff reviewed the request and issued a memorandum dated May 29, 2007
from John Brice, attached hereto as Exhibit "A", which agreed with the applicant's request; and
WHEREAS, the City Council held a duly noticed public meeting on June 4, 2007, at
which time the City Council considered the public testimony and the memorandum; and
WHEREAS, the location and custodian of the documents or other materials which
constitute the record of proceedings upon which this project approval is based is the office of the
City Clerk.
NOW, THEREFORE, BE IT RESOLVED THAT:
A. The City Council hereby deletes condition 61 requiring undergrounding of
utility poles in the alleyway at the rear of the proj ect. The final conditions of approval for

A1S-PUD 06-46 are set forth in Exhibit "B" attached hereto and entitled "Architectural &
Site Review (PUD) Conditions dated 6/4/07."
Except for the modification of condition 61 above in Ex. "A" to Resolution No. 2007-25,
that Resolution remains in full force and effect.
