Resolution 2007-79 RESOLUTION NO. 2007-79 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF GILROY AUTHORIZING THE CITY ADMINISTRATOR TO SUBMIT AN APPLICATION TO THE CALIFORNIA STATE DEPARTMENT OF HOUSING AND COMMUNITY DEVELOPMENT FOR FUNDING UNDER THE "BEGIN" PROGRAM AND TO EXECUTE ALL DOCUMENTS AND MAKE SUCH BUDGET AMENDMENTS AS NECESSARY TO PARTICIPATE IN SUCH PROGRAM WHEREAS, the City of Gilroy wishes to apply for and receive an allocation of funds through the Building Equity and Growth in Neighborhoods ("BEGIN") program, as more fully discussed in the related staff memorandum, dated October 5, 2007; and WHEREAS, the California Department of Housing and Community Development (hereinafter referred to as "HCD") has issued a Notice of Funding Availability ("NOFA") for the BEGIN program established by Chapter 14.5, Sections 50860 through 50866 of Part 2 of Division 31 of the Health and Safety Code (the "statute"); and WHEREAS, pursuant to the statute, HCD is authorized to approve funding allocations utilizing monies made available by the State Legislature to the BEGIN program, subject to the terms and conditions of the statute and the BEGIN Program Guidelines adopted as amended by HCD on OS/21/07; and WHEREAS, the City of Gilroy wishes to submit an application to obtain from HCD an allocation of BEGIN funds for the Alexander Place Project located at 211 Lewis Street in Gilroy, California in the amount of$510,000; and WHEREAS, the City of Gilroy additionally wishes to submit an application to obtain from HCD an allocation of BEGIN funds for the Mira Flores Project located at 9130-9160 Kern Avenue in Gilroy, California in the amount of $1,500,000. NOW THEREFORE, BE IT RESOLVED THAT: 1. The City Administrator is hereby authorized and directed to execute and submit an application to HCD to participate in the BEGIN program in response to the NOF A issued on June 21, 2007 which will request a funding allocation for down payment assistance in the amount of $30,000 per household for seventeen (17) moderate income households in the Alexander Place Development located at 211 Lewis Street in the City of Gilroy in Santa Clara County, California; and 2. The City Administrator is hereby authorized and directed to execute and submit an application to HCD to participate in the BEGIN program in response to the NOFA issued on June 21, 2007 which application will request a funding allocation for down payment assistance in the amount of $30,000 per household for twenty (20) low income households IVPAPP1740043.2 100807-04706012 Resolution No. 2007-79 and thirty (30) moderate income households in the Mira Flores Development located at 9130- 91690 Kern Avenue in the City of Gilroy in Santa Clara County, California; and 3. In addition to the application, the City Administrator is hereby authorized to execute in the name of the City of Gilroy (subject to review and approval by the City Attorney), the application, the Standard Agreement, and all other documents required by HCD for participation in the BEGIN program, and any amendments thereto.
