Resolution 2008-13 RESOLUTION NO. 2008-13 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF GILROY APPROVING TM 07-09, A TENTATIVE MAP TO CREATE 86 INDUSTRIAL STORAGE LOTS, AND ONE COMMON AREA LOT, ON APPROXIMATELY 3 ACRES LOCATED AT 6805 SILACCIWAY, APN 841-70-024 WHEREAS, PSC Development LLC submitted application TM 07-09 requesting a tentative map to subdivide a three (3) acre site into 86 industrial storage lots and one common area lot ("the Proj ect"), located at 6805 Silacci Way, APN 841-70-024 ; and WHEREAS, the Planning Commission held a duly noticed public hearing on March 6, 2008, at which time the Planning Commission considered the public testimony, the staff report dated February 7, 2008 ("Staff Report"), and all other documentation related to application TM 07-09, and recommended that the City Council approve said application; and WHEREAS, the City Council held a duly noticed public hearing on April 7, 2008, and considered the public testimony, the Staff Report, the supplemental staff report dated March 7, 2008, and all other documentation related to application TM 07-09; and WHEREAS, California Environmental Quality Act Guidelines Section 15332 ("CEQA"), provides a categorical exemption that applies to this application in that it is an in-fill development project; and WHEREAS, the location and custodian of the documents or other materials which constitute the record of proceedings upon which this Project approval is based is the office of the City Clerk. Public utilities and infrastructure improvements needed to serve the Project are in close proximity to the Project site. 2. The proposed Project is consistent with the City's General Plan and the land use designation for the property on the General Plan map (General Industrial). 3. The proposed Project is consistent with the City's Zoning Ordinance and Subdivision and Land Development Code, and with the State Subdivision Map Act. 4. The Project is consistent with the surrounding development. 5. This Project is categorically exempt from environmental review under CEQA as an infill development pursuant to CEQA Guideline 15332. 6. There are no facts to support the findings requiring denial of the proposed tentative map pursuant to California Government Code section 66474. C. Tentative Map TM 07-09 should be and hereby is approved, subject to the conditions of approval set forth in as Exhibit "A" attached hereto and entitled "TM 07-09 FINAL CONDITIONS OF APPROVAL." Planning has attached 13 conditions to this staff report dated January 9, 2008. 1. Sub-divider shall defend, indemnify, and hold harmless the City, its City Council, Planning Commission, agents, officers, and employees from any claim, action, or proceeding against the City or its City Council, Planning Commission, agents, officers, and employees to attack, set aside, void, or annul an approval of the City, City Council, Planning Commission, or other board, advisory agency, or legislative body concerning this subdivision. City will promptly notify the sub-divider of any claim, action, or proceeding against it, and will cooperate fully in the defense. This condition is imposed pursuant to California Government Code Section 66474.9. 2. Prior to Final Map approval a copy ofthe conditions, covenants and restrictions for the project must be reviewed by City Staff for comment. 3. Prior to Final Map approval a list of all services and facilities to be furnished to individual owners and a statement of all fees and other conditions applicable to the use of such services and facilities must be reviewed by City Staff for comment. 4. Design: The structures shall utilize creative, aesthetic design principles to create attractive buildings and open space to blend with the character ofthe surrounding area. 5. Building Colors: Building colors and materials shall be compatible with the natural landscape and must be detailed on building plans prior to the issuance of a building permit. 6. Signage: All plans must be in accordance with the signage requirements as described in Section 37 ofthe Zoning Ordinance. 7. Fencing: All fencing must comply with Section 34 of the Zoning Ordinance to ensure appropriate setbacks, height and material use. 8. Space: There will be adequate access, parking, landscaping, trash areas and storage, as necessary. 9. Irrigation System: A plan for a comprehensive irrigation system in accordance with Gilroy's adopted Consolidated Landscape Policy shall be provided to Planning staff, prior to the issuance of a building permit. 10. Landscaping: Landscaping plans shall be developed in accordance with Gilroy's adopted Consolidated Landscape Policy and provided to Planning staff, prior to the issuance of a building permit. The landscaping shall be continuously maintained in an orderly, live, healthy, and relatively weed-free condition, and the approved specific landscape plan. 11. Exterior Lighting: No unobstructed beam of exterior lighting shall be directed outward from the site toward any residential use or public right-of-way. 12. Mechanical Appurtenances: Mechanical equipment to be located on the roof of the building shall be screened by an architectural feature of the building, such that it cannot be seen from the ground level at the far side of the adjacent public right-of-way, whenever possible. 13. Archeological Remains: All building plans shall include a note as follows: "If archeological resources or human remains are discovered during construction, work shall be halted within 50 meters (150 feet) of the find until it can be evaluated by a qualified professional archeologist. If the find is determined to be significant, appropriate mitigation measures shall be formulated and implemented." Engineering have attached 44 conditions to this staff report dated January 29,2008. Attached plans are deemed complete with the following conditions of approval: a. Driveways on grading/civil plan shall match driveway on architectural plan, incorporating a 5-foot sidewalk behind approach per current City Standards b. Add to "Notes": Entrance gate key pad shall be located such that a vehicle does not block and encroach on sidewalk 1. As part of the first submittal for Final Map, the developer shall submit vector based electronic files readable by AutoCAD. 2. A SWPPP and an Erosion Control Plan is required for all development over 1 acre. 3. Certification of improvements on site plans is required prior to Building final (add to general notes on Title sheet of plans). 4. Certification offire flow test is required prior to final permit (add to general notes on Title sheet of plans). 5. Certification of grades and compaction is required prior to building permit final. This statement must be added as a general note to the Grading and Drainage Plan. 6. Certification is required by the design engineer of the design and construction for all retaining walls shown on the improvement plans prior to final acceptance ofthe subdivision. 7. All retaining walls must be constructed of permanent materials such as concrete or masonry, and shall be of a modular design; wood shall not be permitted. 8. All Traffic Control Plans shall be prepared by a licensed professional engineer with experience in Traffic Control Design. 9. A Traffic Control Plan shall be provided in the Improvement Plans set for all work within the public right-of- way. 10. All temporary roads or detours shall have temporary asphalt paving unless otherwise approved by the City Engineer in writing. 11. Full frontage improvements are required for all new development. All streets must show sidewalks on both sides. 12. All work is to be done in compliance with the City of Gilroy Specifications Standards and Design Criteria and is subject to all laws of this community by reference. 13. Street improvements and the design of all storm drainage, sewer and water lines, and all street sections and widths shall be in accordance with City Standards and shall follow the most current Master plan for streets and each utility. The developer shall provide full street, curb, gutter, sidewalk and electrolier improvements. 14. All grading operations and soil compaction activities shall be per the approved soils report and shall meet with the approval of the City Engineer. Grading plans shall show the grades of all adjacent properties. 15. Ifthe project has excess fill or cut that will be off-hauled to a site or on-hauled from a site within the city limits of Gilroy, an additional permit is required. This statement must be added as a general note to the Grading and Drainage Plan. 16. A minimum of one exterior monument shall be set. Additional monuments can be required by the City Engineer or City Surveyor as deemed necessary. 17. Location of monuments shall be tied out prior to work. Any City monument damaged, displaced or destroyed shall be replaced at the developer's sole expense. 18. New and existing utility lines to, through and on the site, and appurtenances and associated equipment, including, but not limited to, electrical transmission, street lighting, cable television and telephone shall be required to be placed underground. 19. A Final Map with all required dedications shall be filed with a copy transmitted to the City. 20. The developer shall submit an estimate of the probable cost of developer-installed off-site improvements with the Final map submittal. TM 07-09 4 3/7/08 21. The developer shall submit fees and bonds and enter into an improvement agreement prior to Final Map recordation. 22. In the event it is necessary to acquire offsite easements or street right-of-way, the owner shall enter into an agreement with the City prior to Final Map approval agreeing to pay all condemnation costs, for dedication of all required easements or street right-of-way. This agreement shall be recorded and require the owner to deposit all condemnation costs with the City within 21 days of Final Map approval. The owner shall agree to provide an initial cash deposit as determined by the City. 23. Prior to Final Map approval and approval of the Improvement Plans, the following items will need to be completed: a. The developer shall provide joint trench composite plans for the underground electrical, gas, telephone, cable television, and communication conduits and cables including the size, location and details of all trenches, locations of building utility service stubs and meters and placements or arrangements of junction structures as a part ofthe Improvement Plan submittals for the project. A licensed Civil or Electrical Engineer shall sign the composite drawings and/or utility improvement plans. (All dry utilities shall be placed underground.) b. A note shall be placed on the plans which states that the composite plan agrees with City Codes and Standards and that no underground utility conflict exists. c. "Will Serve Letters" from each utility company for the subdivision shall be supplied to the City. d. The City will collect the plan check and inspection fee for the utility underground work. 24. A current Title Report shall be submitted for review to the City prior to Final map approval. 25. Prior to any construction of the dry utilities in the field, the following will need to be supplied to the City: a. A professional engineer-signed and PG&E-approved original electric plan. b. A letter from the design Electrical or Civil Engineer that states the electrical plan conforms to City Codes and Standards, and to the approved subdivision improvement plans. 26. All lots shall drain to the street for storm drainage unless otherwise approved by the City Engineer. 27. Improvement plans are required for all on-site and off-site improvements. 28. Submit a Hazardous Material clearance for any underground tank removal from the appropriate agency. 29. A Storm Water Pollution Prevention Plan shall be filed with the Regional Water Quality Control Board with a copy to the City. An Erosion Control Plan and Waste Discharger Identification shall be submitted to the City. 30. The developer shall negotiate right-of-way with Pacific Gas and Electric and other utilities subject to the review and approval by the Engineering Division and the utility companies. 31. Storm and sewer lines in private streets shall be privately maintained unless approved by the City Engineer in writing. 32. If any portion of the project is located in a special flood hazard area as shown on the most current flood insurance rate map, a flood zone study is required. Should the City Engineer determine a LOMR (letter of map revision) is required, no permits will be issued until a CLOMR (conditional letter of map revision) is completed. No permits will be finaled until the LOMR is complete. Any flood conditions imposed on this project by the National Flood Insurance Program or the City of Gilroy will be enforced by the City of Gilroy. 33. Ifany portion of the project is located in a special flood hazard area, provide the following statement in a bold box with minimum V4-inch text on the front sheet of the plan set: "This project is located in a Flood Zone. A Conditional Elevation Certificate is required prior to the foundation pour and an Elevation Certificate with pictures of each of the four building elevations is required prior to final inspection." 34. If any portion of the project contains recycled water facilities as shown in the South County Recycled Water Master Plan, the facilities shall be installed at sole expense ofthe developer prior to final or occupancy of the first building. 35. If creating a Homeowners Association, Conditions, Covenants and Restrictions and/or property owner's Maintenance Agreement, the document shall be approved by the Planning Division prior to the map being released for recordation. 36. The City shall be notified at least two (2) working days prior to the start of any construction work and at that time the contractor shall provide a project schedule and a 24-hour emergency telephone number list. TM 07-09 5 3/7/08 37. All work shown on the improvement plans shall be inspected. Uninspected work shall be removed as deemed appropriate by the City Engineer. 38. Once the tentative map is approved, the developer shall submit an 8-1/2 X II-inch site plan to the Engineering Division to assign addressing which shows the following: tract name and number, lot number, street names, property lines, right-of-way lines, north arrow and curb cuts for driveway. 39. Reimbursement is required for any frontage infrastructure including but not limited to curb, gutter, sidewalk, storm, sewer, and water, constructed by others that benefits this development. 40. The permanent street name sign shall be installed immediately after the curb and gutter construction is complete. 41. The developer/contractor shall make accessible any or all City utilities as directed by the City Engineer. 42. Additional comments may be added at any time due to incomplete plans, plan changes and mistakes, errors or omISSIOns. Buildin2. BLES has attached 21 building conditions to this staff report dated January 22, 2008. The Building Division has performed a cursory review of preliminary plans submitted to the Planning Division for the application noted above. The plans will require compliance with the following informational items and conditions of approval at the time of building permit submittal: 1. DESIGN PROFESSIONAL -This project will require a State of California registered design professional to design, stamp and wet sign the construction plans. Provide a statement on the coversheet of the building plan review submittal plans stating the following: a. "I hereby acknowledge that my building plan review submittal documents are in conformance with the Arch and Site approval. 1 understand that if my submittal is different from my arch and site approval, it will take longer to review my building plan review and additional fees may apply." b. Owners of mineral rights, easements, right-of-ways, and other nonpossessory interests do not need to sign the condominium plan. Further, in the event a conversion. . Prior to permit issuance: Submit a plot plan clearly showing the location and the portion of building or the buildings to be demolished, a complete application for Demolition, a Bay Area Air Quality Management District "J" number, and obtain approval from the Building Official for the scope of work. As- Built Plans Commercial & Indnstrial Condo Projects must be submitted in digital format before Certificate of Occupancy. 6. SOILS REPORT - A soils report shall be submitted containing design recommendations for footings, retaining walls, and make provisions for anticipated differential settlement. 7. FEMA- This project may be in a flood zone and must meet the City of Gilroy "Floodplain Management Ordinance" #98-16. 8. FOUNDATIONS - All mitigation measures and design recommendations identified in the soils report approved by the Building Official MUST be reviewed by the soils engineer of record for conformance. Structural foundation design plans must also be reviewed by the soils Engineer of record for conformance to recommendations contained within the soils report. 9. FOUNDATION INSPECTIONS - Prior to requesting a Building Department fonndation inspection, the soils engineer shall inspect and approve the mitigation measures and the foundation excavations. The soils engineer shall submit documentation to the Building Division, which verifies compliance with the recommendations specified in the soils report. 10. SPECIAL INSPECTIONS - In addition to the inspections by CBC Sec. 108, the owner or the engineer or architect of record acting as the owner's agent shall employ one or more special inspectors who shall provide special inspections when required by CBC section 1701. Please contact the Building Division at the time of plan submittal to obtain an application for special inspections. 11. STRUCTURAL CALCULATIONS - Provide Structural Calculations verifying compliance with all applicable provisions of the adopted State Codes. Prior to request for final inspection, written verification by the engineer of record indicating conformance with the structural design shall be submitted to the Gilroy Building Division. 12. GRADING AND SHORING - A site development permit shall be required for all grading and shoring work. Shoring plans, calculations, etc., must be reviewed and approved by Building Division. 13. NOTICE OF EXCA V A TION-Prior to excavation, adjoining landowners shall be given notice of the date, location, and extent of the excavation in conformity with Section 832 of the Civil Code and copies shall be provided to the Building Official prior to the issuance of the grading permit. 14. EROSION CONTROL - The applicant shall submit an Interim Erosion and Sediment Control Plan. This can be incorporated on the Grading Plan. 15. DUST AND MUD CONTROL MEASURES. Contractors performing grading operations within the City where dry conditions are encountered shall adequately control dust or mud from spreading off-site or into existing structures on-site. Prior to commencement of the grading operations, contractor shall furnish details of proposed dust or mud control measures to the Building Official for approval. Failure to control dust or mud from grading operations shall result in suspension of grading operations until adequate measures are in place to allow continuance. 16. T -24 ACCESSIBILITY- The developer shall comply with all applicable provisions of Chapter 11 ofthe California Building Code (Title 24) for Disabled Access. . Accessible parking spaces are required to meet the 2001 CBC. . Accessible parking should be located at the shortest route of travel to the accessible entrance. . Provide accessible parking spaces to meet Table 1 I B-6. . Where single spaces are provided, the unloading access aisle must be placed on the passenger side. . One in every eight accessible spaces, but not less that one, shall be designed for van accessibility. . The disabled cannot go behind other parked cars. . Show the slope of the accessible parking space and unloading area. TM 07-09 9 3/7/08 . Provide disabled signage. . All entrances and exterior ground-floor exit doors to buildings shall be made accessible to persons with disabilities. . Distribute the accessible parking near accessible entrances. . Provide an accessible path of travel between accessible parking and the tenant space. . Provide an accessible path of travel to the public right of way including the nearest bus stop. . Any walking surfaces with a slope greater than 1 :20 will be considered a ramp and designed as such. . BUILDING SECURITY - Provide details to show how the conditions of the Building Security Ordinance # 85-17 will be met. . Provide a "PUBLIC SAFETY RADIO SYSTEM" to support the City's Public Safety Communications System in any structure over 10,000 square feet. All Structures shall display a street number in a prominent location on the street side of the structure in such a position, that the number is easily visible to approaching emergency vehicles. . The numerals shall be at least 4 inches in height and shall be of contrasting color to the background to which they are attached. . The numerals and a light source shall be contained within a single weather resistant fixture. . Provide signage at the rear ofthe CommerciallIndustrial structures for building identification. Frames, Jambs, Strikes: . Doorjambs shall have solid backing with no voids between the strike side of the jamb and the frame opening for a vertical distance of 6 inches. . In wood framing, horizontal blocking shall be placed between studs at door lock height for 3 stud spaces at each side of the door opening. . Door stops on wooden jambs for in-swinging doors shall be of one-piece construction with the jamb. Louvered windows: . Shall not be used when portion of the window is 12 feet vertically or 6 feet horizontally from an accessible surface or any adjoining roof, balcony, landing, stair tread, platform or similar structure. . All garage-type wood doors-rolling overhead, solid overhead, swing, sliding, or accordion-shall have panels a minimum 5/16 inch thick with the locking hardware being attached to the supporting framing. All exterior swinging doors shall have the following: . All wood doors shall be solid-core construction with a minimum thickness of 1-3/4 inch or with panels not less than 9/16 inches thick. . Doors shall be equipped with a single cylinder deadbolt lock. The bolt shall have a minimum projection of 1 inch and be constructed to repel cutting attack. The deadbolt shall have a minimum embedment of 3/4- inches into the strike. The cylinder shall have a cylinder guard, a minimum of 5 pin tumblers, and shall be connected to the inner portion of the lock by connecting screws of at least 1/4-inch diameter. . The inactive leaf of double doors shall be equipped with metal flush bolts having a minimum embedment of 5/8 inch into the head and threshold of the door frame. 18. ADDRESS - Provide proper address for proposed project on each page of plans prior to submission of plans for initial building plan check. Provide Assessors Parcel number on title page. 19. CONSTRUCTION RESTRICTIONS -All construction shall be restricted to the following hours: . Weekdays (Monday thru Friday) 7:00 am to 7:00 pm . Saturdays 9:00 am to 7:00 pm . PRE-CONSTRUCTION CONFERENCE - A pre-construction conference shall be held at a time and location agreed upon by the City and applicant for the purpose of review and approval of construction procedures. The Fire Marshall has attached 6 conditions to this staff report dated January 31, 2008. 1. An on-site looped Fire Main shall be installed with a DDC at each driveway. Fire Hydrants shall be spaced every 300 ft. and so that there is a hydrant within 150 feet of buildings or combustible storage. Hydrant location to be reviewed and approved by Fire Prevention. On site Fire Main shall meet the National Fire Protection Association Standard #24. Fire Hydrants shall be flushed and maintained annually. A record of the maintenance shall be sent to the Fire Marshal. 2. Fire hydrant(s) shall be installed so that there is a hydrant within 150 feet of buildings or combustible storage or hazardous operations. Hydrant location to be reviewed and approved by Fire Prevention. 3. Roadways and driveways shall provide a minimum 20 feet of unobstructed travel. Turns shall provide an inside turning radius of32 ft. and outside radius of39 ft. Areas where there is not to parking shall be provided with signage and curb painting. A site plan shall be filed that shows red striping, signage. 4. Storm Drains shall be provided with filter inserts and shall be stenciled for no dumping. Filter inserts shall be maintained annually with reports sent to the Chemical Control Program. 5. Vegetation shall be maintained life and irrigated. Any weeds or dead vegetation shall be removed on a regular basis. 6. The CCR's shall reflect all of the above requirements. A copy shall be filed with the Fire Marshal.
