RESOLUTION NO. 2008-21
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF GILROY IN SUPPORT
OF ASSEMBLY BILL 2173
WHEREAS, public school districts are obligated to provide school facilities to the over
6 million students in California that attend public K-12 schools; and
WHEREAS, the State of California bestowed upon school districts mechanisms to
raise the local necessary capital outlay funds to address their student housing needs; and
WHEREAS, the assessment of developer fees is one of the mechanisms school
districts are authorized to use to raise local funds; and
WHEREAS, development in local communities create need for new schools to address a
growing student population; and
WHEREAS, the State of California and public school districts aim to provide adequate
neighborhood schools to avoid unnecessary bussing and safety hazards related to travel to and
from schools; and
WHEREAS, AB 2173 (Caballero) enables school districts to better address capital outlay
needs by allowing them to consider all costs associated with design and construction of new
schools in their local communities; and
WHEREAS, AB 2173 (Caballero) seeks to equalize the generation of local developer
fees with the State pupil grant funding for new schools.
NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of
Gilroy strongly supports Assembly Bill 2173 and Assembly Member Anna Caballero's
efforts to help California school districts meet their obligations to provide safe, adequate
schools for our students and our community.
