Resolution 2008-54 RESOLUTION NO. 2008-54 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF GILROY ACCEPTING THE SANTA CLARA COUNTY REGISTRAR OF VOTERS' CANVASS OF THE SPECIAL MUNICIPAL ELECTION HELD ON NOVEMBER 4, 2008 AND DECLARING RESULT OF SUCH ELECTION HELD IN THE CITY OF GILROY WHEREAS, by order of this City Council a special municipal election was held and conducted in the City of Gilroy on Tuesday, the 4th day of November, 2008; and WHEREAS, notice of said special municipal election was duly and legally given; voting precincts were properly established; election officers were appointed and election supplies furnished; and in all respects the election was held and conducted and the votes cast thereat received and canvassed, and the returns thereof made, determined and declared in time, form and manner as required by the Charter of said City as amended and the general laws of the State providing for and regulating municipal elections in said City; and WHEREAS, the Registrar of Voters did conduct the canvass of the returns of said special municipal election and did count the absentee ballots cast thereat, pursuant to direction and order of the City Council of said City; and WHEREAS, said canvass was duly completed and the results thereof were certified by the Registrar of Voters and submitted to this Council. NOW, THEREFORE, BE IT RESOLVED, as follows: 1. Said special municipal election was held and conducted in the City of Gilroy, County of Santa Clara, State of California on Tuesday, November 4, 2008 in the time and in the form and manner as required by law. - 1 - RESOLUTION NO. 2008-54 2. That there were established twenty four (24) voting precincts for the purpose of holding said special municipal election consisting of either regular election precincts established for holding state or county elections, or a consolidation of some or all of such precincts, as follows: CONSOLIDATED PRECINCT NO. 3951, comprising state and county precinct designated Precinct Number 3951 as established by the Santa Clara County Board of Supervisors. CONSOLIDATED PRECINCT NO. 3952, comprising state and county precinct designated Precinct Number 3952 as established by the Santa Clara County Board of Supervisors. CONSOLIDATED PRECINCT NO. 3953, comprising state and county precinct designated Precinct Number 3953 as established by the Santa Clara County Board of Supervisors. CONSOLIDATED PRECINCT NO. 3954 comprising state and county precinct designated Precinct Number 3954 as established by the Santa Clara County Board of Supervisors. CONSOLIDATED PRECINCT NO. 3955, comprising state and county precinct designated Precinct Number 3955 as established by the Santa Clara County Board of Supervisors. CONSOLIDATED PRECINCT NO. 3957, comprising state and county precinct designated Precinct Number 3957 as established by the Santa Clara County Board of - 2 - RESOLUTION NO. 2008-54 Supervisors. CONSOLIDATED PRECINCT NO. 3974, comprising state and county precinct designated Precinct Number 3974 as established by the Santa Clara County Board of Supervisors. CONSOLIDATED PRECINCT NO. 3978, comprising state and county precinct designated Precinct Number 3978 as established by the Santa Clara County Board of Supervisors. CONSOLIDATED PRECINCT NO. 3980, comprising state and county precinct designated Precinct Number 3980 as established by the Santa Clara County Board of Supervisors. CONSOLIDATED PRECINCT NO. 3981, comprising state and county precinct designated Precinct Number 3981 as established by the Santa Clara County Board of Supervisors. CONSOLIDATED PRECINCT NO. 3982, comprising state and county precinct designated Precinct Number 3982 as established by the Santa Clara County Board of - 4- RESOLUTION NO. 2008-54 Supervisors. CONSOLIDATED PRECINCT NO. 3983, comprising state and county precinct designated Precinct Number 3983 as established by the Santa Clara County Board of Supervisors. CONSOLIDATED PRECINCT NO. 3984, comprising state and county precinct designated Precinct Number 3984 as established by the Santa Clara County Board of Supervisors. CONSOLIDATED PRECINCT NO. 3987, comprising state and county precinct designated Precinct Number 3987 as established by the Santa Clara County Board of Supervisors. CONSOLIDATED PRECINCT NO. 3988, comprising state and county precinct designated Precinct Number 3988 as established by the Santa Clara County Board of Supervisors. 3. The canvass of the returns of the votes cast and the counting of absentee ballots cast in said City for the two (2) ballot measures was duly held by the Registrar of Voters in accordance with the order of the Council and in accordance with law, and said Registrar of Voters has executed a certificate certifying to the results of such canvass, which certificate is hereto attached as Exhibit "A" and by this reference is made a part hereof. Said certificate has been examined and is hereby approved and adopted by this Council as the official canvass of said municipal election. 4. The whole number of votes cast in said City of Gilroy at said municipal election was - 5 - RESOLUTION NO. 2008-54 15,693 (including 8,921 absentee votes). 5. The canvass of the returns of the votes cast and the counting of absentee ballots cast in said City for Measure E and Measure F was duly held by the Registrar of Voters in accordance with the order of the Council and in accordance with law and said Registrar of Voters has executed a certificate certifying to the results of such canvass, which certificate is hereto attached as Exhibit "A" and by this reference is made a part hereof. Said certificate has been examined and is hereby approved and adopted by this City Council as the official canvass of said municipal election. 6. The measures voted upon, the number of votes received in favor of and against said measures in each of said precincts and by absentee votes, together with the whole number of votes which the measures received in the entire city, are shown on said Exhibit "A", hereto attached. 7. At said municipal election certain measures passed: E. In order to consolidate with the countywide elections and to help reduce the City's election costs, shall the Charter Section 1400 be amended to provide that the City's general municipal election shall be held in each even-numbered year commencing with the year 2010 and extending the existing Council terms by one year? F. GILROY LIBRARY EARTHQUAKE SAFETY MEASURE. "To replace the overcrowded, outdated Gilroy Library building, with a larger Library that meets current earthquake safety standards, located near public transit, City Hall and the Senior Center; provide services for a growing population; accommodate double the number of library books/materials; shall the City of Gilroy issue 37 million dollars in general obligation bonds at legal interest rates, subject to independent audit and citizens oversight with no money for administrators' salaries?" - 6- RESOLUTION NO. 2008-54 8. The City Clerk is hereby instructed to enter this resolution in full in the minutes of this Council as a statement of the result of said special municipal election. COUNTY OF SANTA CLARA ) I, Jesse Durazo, Registrar of Voters of the County of Santa Clara, State of California, hereby declare: 1.
