Resolution 2008-57 RESOLUTION NO. 2008-57 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF GILROY ESTABLISHING THE MURRAY-LAS ANIMAS AVENUE OVERLAY COMBINING DISTRICT DESIGN POLICY WHEREAS, on December 10, 2008, the City Council adopted Ordinance No. 2008- , amending the City Zoning Ordinance to establish the Murray-Las Animas Avenue Overlay Combining District, file number Z 08-03; and WHEREAS, the City Council desires to provide direction to those charged with reviewing development proposals in the District on behalf of the City of Gilroy by adopting a design policy; WHEREAS, the Planning Commission held a duly noticed public hearing on November 6, 2008, at which time the Planning Commission considered the public testimony, the staff report dated November 6,2008, and all other documentation related to application Z 08-03 establishing the Murray- Las Animas Avenue Overlay Combining District, including review ofthe proposed Murray- Las Animas Avenue Overlay Combining District Design Policy ("Design Policy"); and WHEREAS, the City Council held a duly noticed public hearing on November 17,2008 and reviewed the matter on December 1, 2008, at which time the City Council considered the public testimony, the staff reports dated November 6 and 7, 2008, and all other documentation related to the application and the proposed Design Policy; and WHEREAS, the location and custodian of the documents or other materials which constitute the record of proceedings upon which this project approval is based is the office ofthe City Clerk; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Gilroy that the Murray-Las Animas Avenue Overlay Combining District Design Policy, attached hereto as -1- ILLEZOTTE1780039.1 120908-04706083 Resolution No. 2008-57 Exhibit "A", is hereby adopted. Statement of Intent: This Policy is Intended to be used as a guideline by City Staff and the Planning Commission in reviewing development proposals in the Murray-Las Animas Avenue Overlay Combining District. Care and flexibility should be exercised in application of this policy to specific development proposals. Policy Area The Murray-Las Animas Avenue Overlay Combining District Design Policy area will pertain to properties located within the rectangular geographic area bounded by: . Cohansey Avenue to the north; · Leavesley Avenue to the south; · Monterey Road to the west; and the · South Valley Freeway (101) to the east. Notification All Architecture and Site Review planning applications submitted in regards to property located within the Murray-Las Animas Avenue Overlay Combining District will be forwarded to the Planning Commission. All property owners and residents within the Murray-Las Animas Avenue Overlay Combining District will be noticed. DeveloDment Review Issues & Concerns City staff will utilize this zoning Overlay and related Policy to soften the impact of industrial buildings fronting Murray Avenue especially when they are across the street from existing residential homes. City staff will facilitate and ensure: · Enhanced landscaping (increased streetscape buffering landscaping); · Front yard setbacks to match homes across the street; . Aesthetically pleasing fencing (same rules as residential); · Appropriate building heights (similar to residential); · Respect of important view sheds; · Attractive architecture (with front facades looking residential with windows & overhangs ); · and building materials {limit the number of metal buildings and encourage multi- material buildings; · Suitable building colors (natural tones with one to three accent colors); · Appropriate number of driveways (minimizing the number of driveways); and the · Incorporation of site considerations (achieving a campus industrial look along Murray Avenue EXHIBIT A I, SHA WNA FREELS, City Clerk of the City of Gilroy, do hereby certify that the attached Resolution No. 2008-57 is an original resolution, or true and correct copy of a city resolution, duly adopted by the Council of the City of Gilroy at a regular meeting of said Council held on the 15th day of December, 2008, at which meeting a quorum was present.
