RESOLUTION NO. 2009-11
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF GILROY
REQUESTING THAT THE PUBLIC EMPLOYEE RETIREMENT SYSTEM
BOARD OF DIRECTORS APPROVE THE EXTENSION OF TEMPORARY
SERVICE FOR DAVID BISCHOFF, INTERIM PLANNING MANAGER,
PURSUANT TO GOVERNMENT CODE SECTION 21221(H).
The City Council of the City of Gilroy hereby resolves as follows:
WHEREAS, the City of Gilroy includes a Planning Division as a component of the
delivery of Community Development services; and,
WHEREAS, the former Planning Manager retired and the former Community
Development Director accepted a position with another agency and the City of Gilroy has not
filled the vacant position; and,
WHEREAS, David Bischoff has the knowledge and expertise necessary to fulfill the
requirements of the position predicated on his past employment history as a tenured Community
Development Director; and
WHEREAS, David Bischoff, a retired PERS employee, has provided approximately 900
hours of specialized planning work for the cities of Morgan Hill and Gilroy during the current
fiscal year beginning his part-time, temporary employment with the City of Gilroy on February
19, 2009; and
WHEREAS, the vacancy in the Planning Division of the Community Development
Department will necessitate the continuance of the temporary, part-time employment beyond the
maximum number of hours authorized in anyone fiscal year as set forth in Government Code
Section 21222(h).
NOW THEREFORE BE IT RESOLVED, by the City Council of the City of Gilroy
that a request is made of the Public Employees Retirement System Board of Directors that David
Bischoff receive approval to extend his temporary employment as Interim Planning Manager
beyond the maximum limit of 960 hours yet not to exceed a total of one year.
