RESOLUTION NO. 2009-44
A JOINT RESOLUTION OF THE CITY COUNCILS OF
THE CITIES OF GILROY AND MORGAN HILL IN
SUPPORT OF AN ALTERNATE ALIGNMENT FOR HIGH
SPEED TRAIN (HST) WITH GILROY AS THE
PREFERRED STATION LOCATION AND US IDGHWAY
101 THROUGH MORGAN IDLL AS THE PREFERRED
HST ALIGNMENT IN SOUTH SANTA CLARA COUNTY
WHEREAS, the California High-Speed Rail Authority (Authority) and the Federal
Railroad Administration (FRA) completed a Final Program Environmental Impact
Report/Environmental Impact Statement (EIR/EIS) in July 2008 to identify a preferred corridor
for the Bay Area to Central Valley section of the HST System; and
WHEREAS, as part of the HST Alternatives selected for further analysis, the Authority
and FRA defined a corridor between San Francisco and San Jose along the San Francisco
Peninsula and between San Jose and the Central Valley through Pacheco Pass; and
WHEREAS, the Authority has identified a preferred corridor between San Jose and
Gilroy on or adjacent to the Union Pacific Railroad right-of-way with Gilroy as a preferred
station location; and
WHEREAS, the Cities of Gilroy and Morgan Hill jointly support an alternate alignment
for HST using the Highway 101 corridor; and
WHEREAS, the Authority and FRA will prepare a project EIR/EIS that examines site-
specific impacts of alignments, station locations and HST operations between San Jose and
Merced, that identified specific mitigation measures, as necessary.
NOW, THEREFORE, THE CITY COUNCILS OF THE CITIES OF GILROY
AND MORGAN IDLL DO HEREBY RESOLVE AS FOLLOWS:
SECTION 1. The Cities of Gilroy and Morgan Hill oppose the preferred HST corridor on or
adjacent to the Union Pacific Railroad (UPRR) right-of-way through Downtown
Morgan Hill. The existing UPRR rail corridor is constrained in several areas by
existing development and the elevated/graded separated HST tracks and parallel
security fencing will have an adverse effect by creating a barrier or divide within
our communities. The Authority should consider alternate alignments using the
Highway 101 corridor.

SECTION 2. The Cities of Gilroy and Morgan Hill support the Gilroy station location
alternatives as the preferred station location for High Speed Train. The Gilroy
station alternatives provide better connectivity, travel times, closer access and
lower costs to the Santa Cruz, Monterey/Carmel, and Salinas markets. While
preferring the Gilroy Caltrain station, ultimately, the station location itself should
not dictate the alignment through South County.
SECTION 3. The Cities find the Gilroy station to be consistent with the above goals, but desire
HST design alternatives compatible with an ultimate Highway 1 01 corridor north
of Gilroy regardless of whether the station is located in downtown Gilroy or at an
alternative site in Gilroy.
SECTION 4. Should the Gilroy station location prove infeasible due to right-of-way constraints
or other insurmountable design constraints, then the two cities support
consideration of a Morgan Hill location for the HST station.
