RESOLUTION NO. 2010 -03
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF GILROY
DECLARING CERTAIN BLIGHT CONDITIONS IN THE CITY TO BE
A PUBLIC NUISANCE, DESCRIBING THESE BLIGHT CONDITIONS
WHICH CONSTITUTE SUCH NUISANCE, AND PROVIDING NOTICE
OF THE ADOPTION OF THE RESOLUTION BY PUBLICATION
THEREOF PURSUANT TO GILROY CITY CODE SEC. 5B.20
WHEREAS, garbage, refuse and debris is accumulating, at 1221 Cypress Ct, Gilroy
in violation of Gilroy City Code Section 5C.7; and
WHEREAS, said property owner(s) failed to abate this accumulation of garbage,
refuse and debris in a timely manner; and
WHEREAS, said accumulation of garbage, refuse and debris constitutes property
blight and a public nuisance pursuant to Gilroy City Code Section 5C.3.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Gilroy
as follows:
1. That such accumulation of garbage, refuse and debris does now constitute, and
will continue to constitute, a public nuisance and it is ordered that said property owner(s) shall,
without delay, destroy or remove said nuisance or said nuisance and/or property blight shall be
abated by city authorities.
2. If said nuisance and/or property blight is abated by city authorities as authorized
in City Code Section 5B.23, the costs of such abatement will be assessed upon the lots and lands
from which the nuisance and/or property blight is destroyed or removed. Such costs will
constitute a lien upon such lots or lands until paid and will be collected upon the next tax roll
upon which general municipal taxes are collected.
3. That it is ordered that Monday, the 25th day of January, 2010, at the hour of7:00
o'clock p.m., or as soon thereafter, in the Council Chambers of the City Council at 7351 Rosanna

Street, Gilroy, California is hereby fixed as the time and place when objections to the proposed
removal or abatement by city authorities shall be heard and given due consideration.
4. That the City Administrator of the City of Gilroy is hereby ordered and directed to
cause notice of the adoption of this resolution and notice of hearing to be provided to said
property owner(s) in the manner and form provided in City Code Section 5B.21, at least ten (10)
days prior to said hearing.
