RESOLUTION NO. 2010-14
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF GILROY
LISTING PERMISSIBLE CARDROOM GAMES, AND AUTHORIZING
THE PLAY OF NO BUST 21sT CENTRURY BLACKJACK 5.1 AND THE
ADDITION OF THREE GAMING TABLES FOR A TRIAL PERIOD OF
SIX MONTHS
WHEREAS, Gilroy City Code section 16.6-1 regulates cardrooms in the City of Gilroy
as established by ordinance of the City Council; and
WHEREAS, section 16.6-1(q) entitled "Permitted Games" authorizes the City Council to
adopt by resolution a list of permissible games that cardrooms may allow to be played on their
premises; and
WHEREAS, no game may be played in any cardroom unless it is listed as a permissible
game; and
WHEREAS, an owner of a cardroom requested that the City of Gilroy add "No Bust 21 st
Century Blackjack 5.1" as a permitted game after an analysis was received from the State Bureau
of Gaming Control that it is a permissible game under State law; however, it was not a permitted
game under the City of Gilroy cardroom regulations at that time; and
WHEREAS, thereafter, the City Council directed the Chief of Police to research whether
there were negative local effects of including No Bust 21 st Century Blackjack 5.1 to the approved
list of permitted games and the addition of (3) three gaming tables. Staff issued a report that
concluded it was anticipated there should be minimal negative impacts on the City of Gilroy
associated with the play of the game and the additional gaming tables; and
WHEREAS, on December 7, 2009, the City Council voted to approve a (6) six month
trial period for the play of the game and the additional gaming tables, which actions required the
amendment of the Gilroy City Code cardroom regulations; and
WHEREAS, after the required review and receiving comments from the State Bureau of
Gaming Control on the proposed regulations, the City Council on May 3, 2010 adopted
Ordinance No. 2010-08 which Ordinance permits and describes certain rules of play for No Bust
21 st Century Blackjack 5.1 and approves the trial period to begin upon the effective date of said
Ordinance to allow this game and the three additional gaming tables; and

WHEREAS, the Chief of Police will monitor the cardrooms for any adverse impacts
during the trial period, and report back to the City Council no later than the end of the trial
period. After consideration of the recommendation and findings of the Chief of Police, pursuant
to section 16.1(q) (2) and (3), the City Council may accept the report, resulting in either the
added game and additional gaming tables continuing to be permitted, or resulting in the game's
ban and removal of the additional gaming tables.
NOW, THEREFORE, BE IT RESOLVED that:
Section I
1. This Resolution supersedes Resolution 2009-28, and lists all permissible
cardroom games within the City of Gilroy.
2. All games permitted shall be played in strict conformance with the rules of play
approved by the Chief of Police.
3. The City Council hereby approves this Resolution 2010-14, adding No Bust 21st
Century Blackjack 5.1 to the list of permissible games for a trial period of no more than (6) six
months, and reaffirming the permissible card games stated below pursuant to section 16.6-1 (q).
I. Low Ball
2. Stud Hi
3. Hi Draw Poker
4. Hold 'Em Poker
5. Pan (Panguingue)
6. Razz (Seven Stud/Lo Poker)
7. Draw Poker - Jack's Back
8. No Bust 21st Century Blackjack 5.1, subject to:
a. $100 initial bet limit, with a limit of (1) one split hand; and
b. Original player may not bet on backline; and
c. Other rules described in section 16.1 (q)(1) of the Gilroy City Code, and
any and all rules established by the Chief of Police.

d. The trial period of six months for this game begins upon the effective date
of Ordinance No. 2010-08, said date anticipated to be June 2, 2010.
Section II
This Resolution shall take effect if and only if, and on the same date, that Ordinance
2010-08 becomes effective. If Ordinance 2010-08 does not take effect, then this Resolution shall
become null and void without any further action of the City Council.
