RESOLUTION NO. 2010-45
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
GILROY DISCONTINUING PAYMENT AND REPORTING OF
THE EMPLOYER PAID MEMBER CONTRIBUTION TO
CALPERS FOR GILROY POLICE OFFICERS ASSOCIATION
EMPLOYEES
WHEREAS, the governing body of the City of Gilroy has the authority to amend resolutions,
including Resolution No. 96-72; and
WHEREAS, the governing body of the City of Gilroy has a written labor agreement which
specifically provides that the City of Gilroy will discontinue payment and reporting of the Employer
Paid Member Contributions (EPMC) for Gilroy Police Officers Association employees effective August
1,2010; and
WHEREAS, one of the steps in the procedures to discontinue payment and reporting of the
EPMC pursuant to Government Code Section 20691 (formerly Government Code Sections 20023
(c)( 4)) (pursuant to Government Code Section 20615) is the adoption by the governing body of the City
of Gilroy of a Resolution to discontinue said EPMC;
WHEREAS, the governing body of the City of Gilroy has identified the following conditions for
the purpose of its election to discontinue payment and reporting of EPMC:
. The discontinued benefit shall apply to all employees of the Gilroy Police Officers
Association.
. Gilroy Police Officers Association employees shall pay by salary deduction the 9%
member contribution.
. The effective date of this resolution shall be August 1,2010.
WHEREAS, Resolution 96-72 is amended as set forth above for Gilroy Police Officers
Association employees only;

NOW, THEREFORE, BE IT RESOLVED THAT THE CITY COUNCIL OF THE CITY
OF GILROY hereby elects to discontinue payment and reporting of the Employer Paid Member
Contribution (EPMC), as set forth above for Gilroy Police Officers Association Employees only.
PASSED AND ADOPTED at a Special Meeting of the Gilroy City Council this 26th day of
August, 2010, by the following vote:

attached Resolution No. 2010-45 is an original resolution, or true and correct copy of a city
resolution, duly adopted by the Council of the City of Gilroy at a special meeting of said Council
held on the 26th day of August, 2010, at which meeting a quorum was present.
