Resolution 2010-53 RESOLUTION NO. 2010-53 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF GILROY APPROVING A/S-PUD 10-04, AN APPLICATION FOR ARCHITECTURAL AND SITE APPROVAL OF A 26 UNIT APARTMENT PROJECT LOCATED AT 9389 MONTEREY ROAD, APN 790-07-028 WHEREAS, South County Housing Corporation submitted application A/S/PUD 10-04, requesting architectural and site approval of a Planned Unit Development to construct 26 apartment units on approximately 1.75 acres located at 9389 Monterey Road, APN 790-07-028; and WHEREAS, in 2003, a Conditional Use Permit and Architectural and Site approval were approved to allow development of a 140-bed homeless shelter on the subject site and which included the 60 existing apartment units and 13 single-family dwellings to the west; and WHEREAS, pursuant to the California Environmental Quality Act (CEQA), the City finds that the project has environmental clearance through the reuse of the Initial Study and Mitigated Negative Declaration ("MND") adopted for the larger project approved on this site in 2003 described above. The mitigation measures in the MND will apply to the proposed project; and WHEREAS, the Planning Commission reviewed said application including the Staff Report dated September 2,2010 ("Staff Report") at a du1y noticed public meeting on September 2, 2010, and recommended approval of AHE 10-02 to the City Council with some adjustments to the conditions; and WHEREAS, the City Council reviewed the application for an RDO Affordable Housing Exemption, the Staff Report and a Supplemental Staff Report dated September 20, 2010, and all documents relating thereto and took oral and written testimony at its duly noticed public meeting of September 20,2010; and WHEREAS, the City Council determined that the conditions of approval set forth in the Staff Report and recommended by the Planning Commission should apply to the Project; and -1- Resolution No. 2010-53 WHEREAS, the location and custodian of the documents or other materials which constitute the record of proceedings upon which this Project approval is based, is the office of the City Clerk. NOW, THEREFORE, BE IT RESOLVED THAT: SECTION I The City Council hereby adopts the findings as required by Zoning Ordinance Section 50.55 based upon substantial evidence in the entire record as summarized below: 1. The Project conforms to the Gilroy General Plan in terms of general location and standards of development as it meets the High Density Residential requirements. 2. This Project will provide the type of development which will fill a specific need of the surrounding area. The proposed apartments for very low income, formerly homeless, individuals fills a specific housing need identified in the City General Plan Housing Element. 3. The Project does not require urban services beyond those that are currently available at the Project site. 4. This Project does not require any exceptions from the Zoning Ordinance. The project design incorporates a well-designed site plan with the building oriented to Monterey Road, and providing outdoor use areas that exceed those typically found in high density residential projects. 5. The Project is an economical and efficient use of the property because it provides an appropriate use of land that is zoned for high density residential development. 6. The Project provides landscaping and open space over and above what is typically required for a multi-family development. 7. The proposed apartment project utilizes aesthetic design principles to create an attractive building, and the design of the landscaping and outdoor use areas will blend with the character of the surrounding neighborhood. -2- Resolution No. 2010-53 IDUNG0\829345.1 nn,,~..n nA"7n""On 8. The Project will not create traffic congestion, noise, odor or other adverse effects on surrounding areas. 9. The Project provides appropriate access, parking, landscaping, trash areas and storage as required by the Zoning Ordinance. SECTION II Application A/S-PUD 10-04 hereby is approved subject to the conditions of approval set forth in Exhibit "A" attached hereto and entitled "Gilroy Sobrato Apartments AlS 10-04 Final Conditions of Approval," and to the MND and Mitigated Monitoring Program attached hereto as Exhibit "B." SECTION III This Resolution shall be in full force and effect only if, and on the same date, that Resolution No. 2010-52 approving AHE 10-02 granting an Affordable Housing Exemption takes effect. Otherwise, this application shall be deemed denied. The project shall conform to the plans prepared by Dahlin Group Architecture and Planning, dated June 4, 2010. 2. The project shall incorporate all mitigation measures included in the Negative Declaration/Mitigation Monitoring Program (see Attachment 1), to the satisfaction of the Community Development Director and the City Engineer. 3. Prior to issuance of a Building Permit, the project shall demonstrate conformance to the requirements of the RDO Affordable Housing Exemption Procedure. 4. The landscaping plans shall specify Bloodgood or Columbia varieties of sycamore trees instead of London Planetree. 5. Show all switch gear and transformers proposed for this location, if any. Switch gear and transformers must be placed underground unless you receive a specific exemption from the Engineering Division. All switch gear and transformers that are permitted above ground must be screened via a screen wall and landscaping. Provide a detail showing how you will treat the transformers and switch gear (if any). 6. Standard Zoning Code Section 50.45 Conditions A. Landscaping: Landscaping plans including specifications for an irrigation system shall be approved by the Planning Director in accordance with the adopted Consolidated Landscaping Policy, prior to issuance of a building permit. The landscaping shall be continuously maintained in an orderly, live, healthy, and relatively weed-free condition, in accordance with the adopted Consolidated Landscaping Policy and the approved specific landscape plan. B. Trash Enclosures: All trash enclosures shall consist of visually solid fences and gates, six (6) feet in height, in accordance with the adopted City of Gilroy standard trash enclosure design plan, or a similar design approved by the Planning Director. All trash enclosures shall be located in accordance with the approved site plan and the Uniform Fire Code. C. Exterior Lighting: No unobstructed beam of exterior lighting shall be directed outward from the site toward any residential use or public right-of-way. D. Mechanical Appurtenances: Mechanical equipment to be located on the roof of a a. building shall be screened by an architectural feature of the building such that it cannot be seen from ground level at the far side of the adjacent public right-of-way, whenever possible. E. Outdoor Storage: All outdoor storage and loading areas must be screened from public view with a combination of landscaping, solid fencing and building design and orientation. 7. The applicant shall meet with a Subcommittee of the Planning Commission to finalize the material and color of the roof. The Subcommittee recommendation shall be forwarded to the City Council. If the Subcommittee is unable to finalize its recommendation prior to the City Council hearing, the Subcommittee will transmit the recommendation to the Community Development Director for inclusion in the final project plans, prior to issuance of a Building Permit. 8. The Police Department shall have a permanent role in providing input to the project operators in the screening process to select residents for the project. Enaineerina Division The following comments, if not already completed, shall be incorporated in the project plan set prior to submittal of a Building Permit. DEVELOPMENT REVIEW COMMENTS (GRADING. DRAINAGE AND UTILITIES) General 1. Site plan shall be prepared by California-registered Civil Engineer and shall include license number and stamped plans (seal) when civil work is required. 2. Architectural and civil plans must match. 3. Provide information on existing site conditions and proposed site improvements (Le. surface improvements, building location, etc.); label and identify improvements. 4. Clearly distinguish between existing conditions and proposed improvements. 5. Reference City Standard Detail drawings on plans. 6. How is roof runoff collected? 7. Please provide updated topo. 8. See plans for additional red line comments. 9. Add following note to improvement (civil) plan title sheet above City Engineer's signature block: GENERAL APPROVAL NOTE Approval of these plans does not release the developer from correction of mistakes, errors, or omissions contained therein. If, during the course of construction, the public interest requires a modification or a departure from the City specification or the approved plans, the City shall have the authority to require such modifications or departure and specify the manner in which the same is to be made. Easements 1. Clearly identify and dimension easements and indicate if existing or proposed; if none, indicate so. 2. Provide separate drawing for existing and proposed easements. Provide documentation for existing easements. 3. Cross access easements required for all lots; identify and dimension on plans. 4. Check necessity for drainage, line-of-sight, landscape, construction, etc. easements and show, identify, and dimension on plans. 5. Dimension width of easements. 6. Easement dedication required. Permits 1. Applicant shall be required to obtain a City of Gilroy encroachment permit for all work (i.e. sidewalk, curb, gutter, driveway, roadway, alley, etc.) in City rioht of way, including alleys. UTILITIES: WATER, SEWER, STORM DRAIN General 1. How will new sewer be maintained? Provide either separate lateral to main or maintenance agreement. Storm Drain 2. Show and identify how and where site is being drained. 3. Site drainage overland flow shall flow to street. 4. Show elevations at property corners and all adjacent properties (public and/or private). 5. Show top of grade elevations for finish floor elevation of each structure. 6. Storm runoff shall not exceed predevelopment rate. 7. Applicant shall submit storm calculations for sizing pipes and on-site detention and provide description of runoff. Trash Pad/Enclosure 1. Identify and dimension trash pad/enclosure. 2. Provide and show concrete curb-side trash pad; dimension area 3. Concrete curb-side trash pad shall be a minimum 4 feet deep (from back of curb) x 6 feet wide. 4. Trash pick-up shall occur on-site. 5. Detail and dimension trash enclosure approach. 6. No utilities shall be located along enclosure frontage. Curb Ramps 1. Show curb ramps and identify if existing or proposed. 2. Provide typical detail for all proposed curb ramps (if not per City Standards). Other 1. Applicant shall pay applicable fees. 2. Applicant shall post applicable bonds. 3. Applicant shall execute a Property Improvement Agreement. 4. Applicant shall prepare and file a final map showing easements and dedications. Roadwav F rontaoe 1. Any damaged curb, gutter, sidewalk, and driveway approaches to remain along project frontage shall be replaced with current City standards and conform to existing adjacent properties. Information for Use by the Applicant for Preparation of Improvement Plans and Building Permit Applications. This information is not part of the proiect conditions of approval Engineering 1. Grade transition from streets to driveways shall not exceed 2 percent. 2. Grading, erosion control, and drainage plans are required and shall be subject to the review and approval of the Engineering Division prior to building permit issuance. 3. Site preparation and fill construction shall be conducted under the observation of, and tested by, a licensed soils or geotechnical engineer. A report shall be filed with the City of Gilroy stating that all site preparation and fill construction meets the requirements of the geotechnical investigation. This shall be subject to review and approval by the Engineering Division. 4. The foundation design, based on soils tests, shall be reviewed and approved by the Community Development Department. 5. All retaining walls shall be masonry and shall be a modular system, subject to the review and approval of the Planning, Building, and Engineering Divisions. 6. A sewer backflow preventer may be required, subject to the review and approval of the Engineering Division. 7. A storm flow dissipater may be required, subject to the review and approval of the Engineering Division. 8. Any work in the public right-of-way shall require a signing and striping plan prepared by a licensed, professional engineer with experience in preparing sign and striping plans. Plans shall be overlaid on an existing, current aerial. Where proposed improvements are an extension of an existing street and/or "conform" to existing, adjacent improvements, signing and striping plans shall encompass the minimum areas indicated in the City's current policy. 9. Any work in the public right-of-way shall require a traffic control plan prepared by a licensed, professional engineer with experience in traffic control preparation. Plans shall be prepared in accordance with the requirements of the latest edition of the California Manual on Uniform Traffic Control Devices. 1 O.lnfrastructure shall be in place prior to the issuance of building permit. 11. Replace and/or repair any damaged curb, gutter, and/or sidewalk. 12.AII overhead utility facilities within newly constructed public streets shall be placed underground. 13. New and existing utility lines, appurtenances, and associated equipment, including but not limited to electrical transmission, street lighting, and cable television shall be required to be placed underground. 14. Lot size and easements are to correspond with the tract map and shall be shown on the plans. 15. Any retaining wall in excess of 48 inches tall (from the bottom of the footing to the top of the wall or supporting a surcharge) will need to have a building permit and engineering calculations (submitted to the Building Department). 16. Water pressure reducing valve or backflow preventer may be required. 17. No utility boxes are allowed to be constructed in the sidewalk without prior written approved by the City Engineer. 18. Show pavement design section. 19.AII utilities to, through, and on the site shall be constructed underground, in accordance with Municipal Code Section 21.120. 20.AII improvements are to be done per City of Gilroy Standards. 21.AII grading operations and soil compaction activities shall be per the approved soils report and shall meet with the approval of the City Engineer. Grading plans shall show the grades of all adjacent properties. 22. Certification of grades and compaction required prior to paving (add to general notes on Title Sheet of plans). 23. Certification of improvements on site plans required prior to Building final. 24. City check prints must be returned with revisions. 25.AII previous Engineering Division review comments shall apply unless otherwise specified in writing. Additional comments may be added at any time due to incomplete plans, plan changes and mistakes, errors or omissions. TRAFFIC & TRANSPORTATION SIGNAGE AND STRIPING 1. Signing and striping plans shall be prepared in accordance with latest edition of the California Manual on Uniform Traffic Control Devices (CA MUTeD. 2. Plans shall be prepared by a California-licensed Professional Engineer with experience in preparing signing and striping. 3. Place all "Notes" on signing and striping plan (see below for required notes). 4. Provide paving plan and signing and striping plan. 5. Submit striping and signage plan overlaid on existing, current aerial. 6. Show proposed striping and how it conforms to existing striping, signing, and other traffic control devices in the area. 7. At a minimum, signing and striping plans shall encompass the areas indicated below 8. Identify all symbols in a legend. 9. Identify all striping and signs; provide key for striping and sign designations. 10. Show signing and striping key/legend/details on all sheets. 11. Identify and dimension travel lanes, tapers, transitions, etc. 12. Indicate designation and spacing of signs, as applicable. 13. Address removal of existing and/or conflicting signage, striping, markings, etc. 14. Identify all existing striping and signage to be removed. 15. Show and identify existing driveways. Design Plan Notes -)nclude the following notes: 1. Remove all existing striping conflicting with striping to be constructed. 2. All existing markings, striping, etc. to remain shall be refreshed 3. All existing signs to remain shall be replaced with new signs 4. Initial striping and marking installation shall be paint for City to test a minimum of 30 days. If modifications are necessary, changes shall be paint. Only after final approval by the City shall thermoplastic be installed. 5. Red curb and blue markers shall be installed at fire hydrants per City standards. TRAFFIC CONTROL PLAN Traffic control plans shall meet the minimum requirements outlined below. General 1. Submit a construction traffic control plan for all work in the public right of way or public use easement. 2. Traffic control plans shall be prepared in accordance with latest edition of the California Manual on Uniform Traffic Control Devices (CA MUTCD). 3. Plans shall be prepared by a California-licensed Professional Engineer with experience in preparing traffic control plans. 4. Traffic control plan shall be designed to address specific site/project conditions. Examples, samples, or "typical" drawings are not allowed. 5. Improvement plans must be approved by the City before traffic control plan can be approved. 6. Place all "Notes" on traffic control plan (see below for required notes). 7. Applicant shall include traffic control plan when submitting for building permit. Traffic Plan 1. Identify north point and scale. 2. Identify/shade construction area(s). 3. Identify area(s) where parking will be prohibited. 4. Identify all symbols in a legend. 5. Identify all signs and striping; provide key for sign and striping designations 6. Show signing and striping key/legend/details on all sheets. 7. Construction signs shall be black on orange (not black on yellow or black on pink) 8. Indicate sign designation and spacing. 9. Indicate type and spacing of delineators, where applicable. 10. Specify type(s) of barricade(s) to be used, where applicable. 11 . Identify and dimension travel lanes. 12. Show, identify, and provide/maintain access to existing driveways, cross streets, alleys, etc. 13. Provide pedestrian detour for sidewalk closures. 14. Pedestrian barricade required for sidewalk/pedestrian detour. Detail/dimension layout and provide the following: a. Temporary/asphalt berm or curblwheel stops (painted white). b. Supplementary delineators (specify spacing). c. K-rail. 15. Provide flashing arrow board. 16. Depending on duration of work, recommend temporary striping instead of delineators. Desion Plan Notes - Include the following notes: 1. Specify working days and hours. 2. Construction signs shall be black on orange (not black on yellow or black on pink). 3. Access to all private properties shall be maintained at all times during construction. 4. Temporary traffic control signs shall not block fire hydrants and/or driveways at all times. 5. All traffic control devices (signs, channelizers, etc.) shall be retroreflective and/or illuminated during nighttime traffic control. 6. All existing roadway signs conflicting with traffic control plan shall be covered for duration of work and uncovered when roadway is reopened. 7. For signalized intersections, all active travel lanes shall have temporary or permanent detection. All permanent detection shall be installed within 48 hours of end of temporary traffic control. 8. Contractor shall post temporary "No Parking," "No Stopping," and/or "Tow Away" signs along roadway frontage, where applicable, a minimum three (3) working days prior to commencement of work. Signs shall state days and hours when restrictions apply. 9. Contractor shall display on its barricades company name and 24-hour emergency telephone number in case of emergency callouts. 10. Contractor shall furnish, erect, and maintain barricades, lights, signs, flagmen, fencing, and other safety measures to give adequate protection to the public at all times. Contractor shall provide access to all areas in the vicinity of the encroachment and shall provide necessary temporary sidewalk and warning signs. 11. The parking of any construction-related vehicles or storage of any material is not allowed on a public street or sidewalk unless approved in advance by the City Engineer. 12.Any traffic striping, pavement markings, pavement surface, etc. damaged or destroyed by Contractor's work shall be replaced by Contractor to the satisfaction of the City Engineer at Contractor's sole expense. 13. Contractor shall notify all private property owners in writing a minimum three (3) working days prior to any construction that may affect access. Notice shall contain a) Company Name b) Contact Name c) Company and/or Contact Phone Number 14. Contractor shall notify City of Gilroy Engineering Division in writing a minimum five (5) working days prior to beginning of work. Fire Department The following conditions shall be included as notes on the cover page of the construction drawings submitted for building permit. 1. All buildings shall be provided with fire sprinklers conforming to NFPA 13R and all concealed spaces protected. Riser shall be inside and shall provide a bell on the exterior and one horn on the interior. Separate plans and permit are required. 2. The FDC/DDCA /PIV shall be shown on a Fire Main Plan. A separate plans & permit are required for the Fire Underground to be submitted at the time of building plans submittal. 3. A fire extinguisher shall be mounted in a box such that there is one for every 75 ft travel distance from the kitchen of each unit or provide one in each unit. 4. The building address will be illuminated and visible from the street. Each unit shall be given a suite number. The suite # shall be shall illuminated and be clearly visible from the street and/or direction of approach. 5. Egress Windows shall be provided on all sleeping rooms. A room that does not have a clearly defined use as a kitchen, closet, dining room, living/family room or study shall be considered a bedroom. Studies/libraries with closets shall be treated as bedrooms. Storage rooms that are provided with windows, and electrical outlets and are greater than 50 square feet may also be considered bedrooms if attached to a dwelling unit. 6. Driveway Gates to more than two dwelling units shall be electronically opening and shall be provided with a police and fire KNOX key over-ride. 7. Red curbing shall be required where parking spaces are not designated and there is more than 10ft of curb area where parking is not allowed. Accessibility signs shall be provided at every primary public entrance and at every major junction along or leading to an accessible route of travel and at building entrance that are accessible per CBC, section 111 0A.2. 36. All primary entrances and required exit doors to building and facilities shall be accessible to people with disabilities per CBC, section 1117.A.2. 37. All elevators shall be accessible per CBC sections 1124A and 3002.4a. 38. All entrances' vertical clearances within parking structures shall have a minimum of 8 feet 2 inches where required for persons with disabilities per CBC section 11 09.A.8.1. 39. Public use and common-use areas shall be accessible per CBC, section 11 02A.4 40. Roofing material shall be per 2007 CBC, Sect 1507 41. City of Gilroy of Gilroy Ordinance # 2007-24 amending the 2007 CMC & CPC. Tubing shall be at least Type K for condensate return lines and Type L for steam condenser cooling water lines, underground water lines, and above ground water lines. "Type M copper shall not be used" - Provide this note on plans. a) Water piping shall not be installed in or under a concrete floor slab within a building without prior approval of the Administrative Authority. When approved, such piping shall be installed as follows: Piping installation in or under a concrete floor slab will be installed within a chase or conduit for easy replacement, to the satisfaction of the Administrative Authority. b) Upon completion of a section or the entire hot and cold water supply system, it shall be tested and proved tight under a water pressure not less than 100 psi. The water used for tests shall be obtained from portable source of supply. A fifty (50) pound per square inch, air pressure may be substituted for the water test. In either method of test, the piping shall withstand the test without leaking for a period of not less than fifteen (15) minutes. c) Rat-proofing as per 2007 CPC Section 313.12. Provide note on plans. 1) Plastic and copper piping penetrating a framing members to within one (1) inch of the exposed framing shall be protected by steel nail plates not less than (18 gauge) designed and installed so that no opening is greater than one-half (1/2) inch in the least dimension. 2) Strainer plates on drain inlets shall be designed and installed so that no opening is greater than one-half (1/2) inch in the least dimension. 3) Meter boxes shall be constructed in such a manner that rats cannot enter a building by following the service pipes from the box into the building. 4) In or on buildings where openings have been made in walls, floors, or ceilings for the passage of pipes, such openings shall be closed and protected by the installation of approved metal collars securely fastened to the adjoining structure. 5) Tub waste openings in framed construction to crawl spaces at or below the first floor shall be protected by the installation of approved metal collars or metal screen securely fastened to the adjoining structure with no opening greater than one-half (1/2) inch in the least dimension. 42. Storm Drain (onsite): a) Clarify method of on-site drainage. b) Specify material used for all storm drains. Size of storm drains shall comply with chapter 11, CPC. c) Show location of roof drain, leader, and vertical rainwater piping. Clarify how they are connected to storm drain system, unless otherwise approved in writing. d) Provide note on plans: Roof drains/leaders shall be provide with cleanouts as per 2007 CPC Section1101.12 43. Sanitary Sewer onsite (SS): a) Specify material and size used, sanitary sewer shall comply with 2007 CPC Chapter 7. b) Provide calculation to verify sanitary sewer size shown is adequate. 44. Show location of all existing overhead utility lines. Onsite-Provide Title 24 outdoor lighting calculation for exterior lighting. Provide specification and structural calculation for light poles. 45. Tempered glass is required at stair enclosures less than 5' foot. 46. Submit complete Mechanical, Electrical, and Plumbing (MEP) design for all buildings and site. 47. Mechanical fan required in Master Bath at tub. 1203.4.2.1, CBC. 48. Air-conditioning equipment shall be installed in accordance with the manufacturer's instructions as per 2007 CMC Section 903.3903.4 Provide setback requirements from windows and structure on plans. 49. Number of required plumbing fixtures shall comply with CPC Table 4-1. 50. Landing at required means of egress door shall not exceed 0.75". Section 1008.1.6, CBC. Please give this information to the architect, designer, engineer, contractor, and anyone else on your project team so they may have the proper information for your project. State the plan and calculation sheets reviewed. k) Erosion Control - The applicant shall submit an Interim Erosion and Sediment Control Plan. This can be Incorporated on the Grading Plan and shall include the following information: 1) Maximum surface runoff from the site as calculated using the method approved by the Building Official. 2) A delineation and brief description of the surface runoff and erosion control measure to be implemented including but on limited to types and methods of applying mulches to be used. 3) A delineation and brief description of vegetative measures to be taken, included but not limited to, seeding methods, the type, location and extent of existing and undisturbed vegetation types, and a schedule for maintenance and upkeep. 4) Where an applicant does not plan to construct permanent improvements on the site, or plans to leave portions of the site graded but unimproved, applicant must: I) Submit an Interim Plan designed to control runoff and erosion on the site for the period of time during which the site or portions thereof, remain unimproved and submit a request for the release after the completion of grading. FIRE PROTECTION -Regardless of area or occupancy separation walls, an automatic fire sprinkler system shall be required for the following: 1) Any new commercial, industrial, or residential building 1,000 square feet or greater. 2) Additions to existing buildings: this section shall apply to all existing Buildings if the entire building area, including the addition exceeds the area permitted by the current Building Code or this section, then the entire building shall be sprinklered. Exception: Additions of less than 1000 square feet (either one time or cumulative after the adoption of this ordinance, need not be sprinklered unless otherwise required. FEMA Notice This project may be in a flood zone and must meet the City of Gilroy "Floodplain Management Ordinance" #98-16. If your project is located within the flood zone, provide this information on the Title Sheet. SPECIAL INSPECTIONS - In addition to the inspections by UAC Sec. 305 & 306, the owner or the engineer or architect of record acting as the owner's agent shall employ one or more special inspectors who shall provide special inspections when required by CBC 1704 (2007CBC). 1) Please contact the Building Division at the time of plan submittal to obtain an Application for Special Inspection 2) Contractor Responsibility - Each contractor responsible for the construction of a main wind- or seismic-force-resisting system, designated seismic system or a wind- or seismic- resisting component listed in the statement of special inspections is required to submit a written statement of responsibility to the building official and the owner prior to the commencement of work on the system or component. The contractor's statement of responsibility shall acknowledge awareness of the special requirements contained in the statement of special inspections and acknowledge that control will be exercised to obtain conformance with the approved construction documents. Add this statement to Plan Title Sheet. STRUCTURAL CALCULATIONS - Provide Structural Calculations verifying compliance with all applicable provisions of the adopted State Codes. Prior to request for final inspection, written verification by the engineer of record indicating conformance with the structural design shall be submitted to the Gilroy Building Division. The design loads and other information pertinent to the structural design required by Sections 1603.1.1 through 1603.1.8, shall be indicated on the construction documents 1603.1 DEFERRED SUBMITTALS - Deferred submittals that are not submitted at the time of the application must have the prior approval of the building official. The registered design professional in responsible charge shall list the deferred submittals on the construction documents for review by the building official. Documents for deferred submittal items shall be reviewed by the registered design professional in responsible charge who shall forward them to the building official with a notation indicating that they have been reviewed and are in general conformance with the design of the building. PRE-MANUFACTURED TRUSSES - This is a deferred item. 1) Submit plan and calculation to project engineer for review and approval. 2) Provide a letter of approval accompanied with truss plan and calculation at time of plan check submittal. 3) Specify TC DL and LL, BC DL and LL on plan. 4) Collector trusses will have uplifts at supports. 5) Clarify mechanical hardware to be used at these locations. CONSTRUCTION INFORMATION Work Schedule (Section J110, Gilroy Ordinance 2007-24): The applicant must submit a masterwork schedule showing the following information: 1) Proposed grading schedule. 2) Proposed conditions of the site on each July 15, August, September 15, and October 15 during which the permit is in effect. 3) Proposed schedule for the installation of all interim erosion and sediment control measures including, but not limited to, the stage of completion of erosion control devices and vegetative measures on each of the dates set forth in Subsection (2); 4) Schedule for construction of final improvements, if any. 5) Schedule for installation of permanent erosion and sediment devices where required. Wet Season Work. (October 15 To April 15) (Section J110, Gilroy Ordinance 2007-24) 1) For commencement of the grading during the wet season, applicant must provide special documentation, as required by Building Official, showing the reasons other than financial, for the need to commence at that time. 2) For continuation of activities, other than installation, maintenance or repair of measures in the Interim of final plans, during the wet season, permittee must apply for and receive, every five (5) working days, special permission to proceed. 3) Building Official shall grant permission under this subsection on the basis of weather forecasts, experience and other pertinent factors, which indicate the activity, may occur without excessive erosion occurring. Dust and Mud Control Measures Contractors performing grading operations within the City where dry conditions are encountered shall adequately control dust or mud from spreading off-site or into existing structures on-site. Prior to commencement of the grading operations, contractor shall furnish details of proposed dust or mud control measures to the Building Official for approval. Failure to control dust or mud from grading operations shall result in suspension of grading operations until adequate measures are in place to allow continuance. Gradina. Shorina and Notice of Excavation - A site development permit shall be required for all grading and shoring work. Shoring plans, calculations, etc., must be reviewed and approved by Building Division. 1) Prior to excavation, adjoining landowners shall be given notice of the date, location, and extent of excavation in conformity with Section 832 of the Civil Code and copies shall be provided to the Building Official prior to issuance of grading permit. Buildina Security Ordinance # 85-17 - Plans shall provide a reference to this ordinance. 1) Except where clear vision panels are installed, all front exterior doors shall be equipped with a wide-angle (180-degree) door viewer, not to be mounted more than fifty-eight (58) inches from the bottom of the door. 2) Refer to the City Ordinance # 85-17 for other provisions that are not on this list. Construction Hours - All construction shall be restricted to the following hours: Weekdays (Monday thru Friday) 7:00 am. to 7:00 pm. Saturday 9:00 am. to 7:00 pm. Sunday and City Holidays - No construction activity allowed.
