Resolution 2012-10 RESOLUTION NO. 2012 - 10 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF GILROY OPPOSING UNNACCEPTABLE REQUIREMENTS CONTAINED IN THE METROPOLITAN TRANSPORTATION COMMISSION'S ONE BAY AREA GRANT (OBAG) PROGRAM DRAFT DOCUMENT WHEREAS, the Metropolitan Transportation Commission (MTC) is developing Federal flexible funding programming criteria for fiscal years 2013 through 2015; and WHEREAS, the MTC is starting to incorporate policy concepts that are under discussion for their new Regional Transportation Plan/Sustainable Community Strategy called T2040; and WHEREAS, MTC's proposal for program 2013-2015 Federal Surface Transportation Program (STP) and Congestion Mitigation and Air Quality (CMAQ) funds is called the One Bay Area Grant (OBAG) Program. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF GILROY that it has reviewed the draft One Bay Area Grant (OBAG) program document and finds that certain requirements are completely unacceptable to the City of Gilroy and should be removed in their entirety from the draft OBAG program document. Specifically, the City Council of the City of Gilroy requests removal of the following proposed requirements in the OBAG draft program document: 1. Requirement that a General Plan Housing Element meeting 2007-2014 Regional Housing Needs Assessment (RHNA) be prepared and approved by the State Housing and Community Development Department (HCD) by July 2013. 2. Requirement that a General Plan Circulation update to include "Complete Streets" be prepared and approved by July 2013. 3. Requirement that 70% of all funds Federal funds be spent in Priority Development Areas (PDA) in Santa Clara County including the "South County" rural section. 1 RESOLUTION NO. 2012-10 4. Map of the PDAs for the MTC region which excludes the recognition of the cities of Gilroy and Morgan Hill and south Santa Clara County in the PDA program. BE IT FURTHER RESOLVED that the City Council of the City of Gilroy hereby directs the City Administrator to transmit this Resolution and a letter of opposition regarding the One Bay Area Grant Program as it is currently drafted to the MTC with a copy to the Valley Transportation Authority.
