CDA and City Resolution 89-21 . . RESOLUTION NO. 89- 21 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF GILROY AUTHORIZING A JOINT PUBLIC HEARING OF THE COMMUNITY DEVELOPMENT AGENCY OF THE CITY OF GILROY AND THE CITY COUNCIL OF THE CITY OF GILROY WHEREAS, the City Council of the City of Gilroy has been informed by the Community Development Agency of the City of Gilroy (the "Agency") that a Redevelopment Plan and Report thereon for the proposed City of Gilroy Community Redevelopment Project have been prepared. The Report on the Plan includes the Environmental Impact Report for the Project; and WHEREAS, the Agency has submitted copies of the Plan and Report to this Council for its review; and WHEREAS, there is a need for a joint public hearing with the Agency to consider the Plan and Report, and to have interested groups and citizens be heard on the Plan and Report. BE IT NOW THEREFORE RESOLVED: 1. That the City Council of the City of Gilroy approves the convening of a joint public hearing with the Agency on May 22, 1989, at 8 p.m., in the Council Chambers located at 7351 Rosanna Street, Gilroy, California for purposes of considering the aforesaid Redevelopment Plan and Report thereon. 2. That the City Clerk is hereby directed to publish in cooperation with the Agency the, "Legal Notice - Joint Public Hearing" which has been prepared by the Agency staff, a copy of which is attached hereto as Exhibit A and by this reference incoroprated herein, not less than once a week for four successive weeks in The Gilroy Dispatch, a newspaper of general circulation published in Santa Clara County. 3. That the City Council of the City of Gilroy hereby directs the City Clerk to cooperate with the Agency in mailing a copy of the aforesaid Notice to the last known assessee of each parcel of land in the area designated in the aforesaid RESOLUTION NO. 89 - 21 -1- . . Redevelopment Plan, at the assessee's last known address as shown on the last equalized roll of the County of Santa Clara. 4. That the City Council of the City of Gilroy hereby directs the City Clerk to cooperate with the Agency in mailing a copy of the aforesaid Notice to the governing body of each of the taxing agencies which levies taxes upon any property in the project area designated in the proposed Redevelopment Plan. Exhibit A LEGAL NOTICE JOINT PUBLIC HEARING ON THE REDEVELOPMENT PLAN AND FINAL ENVIRONMENTAL IMPACT REPORT FOR THE CITY OF GILROY COMMUNITY REDEVELOPMENT PROJECT NOTICE IS HEREBY GIVEN that the City Council of the City of Gilroy and the Community Development Agency of the City of Gilroy (the "Agency") will hold a joint public hearing on May 22, 1989 at 8:00 p.m. in the City Council Chambers, 7351 Rosanna Street, Gilroy, California. The hearing may be continued from time to time until completed. Any person desiring the opportunity to be heard will be afforded an opportunity to do so. The purpose of the hearing is to consider the proposed City of Gilroy Community Redevelopment Plan for the City of Gilroy Community Redevelopment Project (hereinafter referred to as the "Plan"). The Plan authorizes the undertaking of a redevelopment project within the City of Gilroy Community Redevelopment Project Area (the "Project Area") pursuant to the California Community Redevelopment Law. A further purpose of the hearing is to consider the certification of the Environmental Impact Report (hereinafter referred to as the "EIR"), prepared pursuant to State Law. The Agency proposes to establish the Project Area for the purpose of carrying out activities related to upgrading public facilities and improving the quality of life for residents and the business environment in the Project Area. The Agency's goal is to provide a stable, diversified and strong economic base for the Project Area and the community by, among other things, providing assistance in installing, constructing, or reconstructing streets, utilities, landscaping and other on-site and off-site improvements; encouraging the development of land by private enterprise; rehabilitating existing structures; revitalizing the City's downtown area; and improving and increasing the community's supply of affordable house. The purpose of the Project is to provide the Agency with the financial and legal resources to achieve these objectives. The proposed project will be an undertaking of the Community Development Agency of the City of Gilroy. The Project Area is situated in the City of Gilroy, County of Santa Clara, State of California, and is more particularly described -1- . . in the Legal Description attached hereto as Exhibit A and by this reference incorporated herein. Any and all persons having comments in favor of or objections to the proposed Plan or who wish to substantiate or deny the existence of blighting conditions in the proposed Project Area, or those who wish to challenge the regularity of any prior proceeding or who wish to speak to any issue raised by the EIR may appear at the hearing and show cause why the proposed Plan should or should not be adopted. In addition, at any time not later than the time set forth for the hearing on the Plan, any person may file in writing with the Clerk of the City Council of the City of Gilroy a statement of comments on or objections to the proposed Plan. In accordance with the California Community Redevelopment Law, the Agency has prepared a Report on the Plan and has adopted and made available for public inspection rules to implement operation of preferential treatment for persons who are engaged in a business in the Project Area as well as rules to implement the requirements for participation by owners of project area property in the redevelopment process. Furthermore, the Report on the Plan will be open for discussion at the hearing. The Plan, the Draft EIR, Owner and Business Participation Rules, and the Report on the Plan are now available for inspection in the offices of the Planning Department, 7351 Rosanna Street, Gilroy, California.
