ORDINANCE N O. 460 AN ORDINANCE OF THE CITY OF GILROY VACATlliG AND ABANDONING CERTAIN STREET AND ALLEY IN THE SO-CALLED "GURRIES TRACT" AREA IN THE CITY OF GILROY. ................. THE COUNCIL OF THE CITY OF GILROY having on the 5th day of April, 1948, duly passed and adopted Ordinance 458 whereby it declared its intention to proceed under the Street Vacation Act of 1941 and vacate a certain street and alley in the so-called "Gurries Tract" area of Gilroy and reserve a certain right of way for the Pacific Telephone and Telegraph Company; and, such Ordinance having been published in the Gilroy Evening Dispatch on the 7th day of April, 1948; and the City Clerk of the City of Gilroy having caused notices of the passing of said Ordinance to be published in a newspaper of general circulation in the manner and form required by law; and the said street and alley having been posted in the manner and form required by law; and no objection to said proposed vacation of said street end alley having been filed at the hearing held by said council on the 4th day of May, 1948, at 8:30 P.M. o'clock at the City Hall at Gilroy, California: THE MAYOR AND COMMON COTIN CIL OF THE CITY OF GJLROY DO ORDAIN AS FOLLOWS: SECTION I. The following described street and alley wi thin the said city are hereby vacated and abandoned: a. All of Gurries Drive lying between the Easterly line of Church Street and the Easterly line of Tract 232, according to the Map of said Tract on file with the City Clerk of the City of Gilroy. b. All of the 20 foot wide alley lying between the Northerly line of First Street and Gurries Drive, and between Lot 1 in Tract 232 and the Easterly boundary of Tract 232, according to the Map of said Tract on file with the City Clerm of the City of Gilroy. ~(oo -1- .. o ./. ... ~ .' -~ f'~"~ ..\.~ \';;';,.. 1: ~. e 'lI.? . SBCTION II. The vacation and abandonment of that street and alley in tne "Gurrie s Tract" area hereinabove described shall in no way affect the right of way over said street and alley now held by the Pacific Telephone and Telegraph Compeny as set forth in the right of way agreement now of record with the Recorder of Santa Clara County. SECTION III. This Ordinance shall take effect and be in force from and after the date of its passage. ADOPTED AND PASSED this ..!Qn. day of by the following votes.
