Ordinance 461 "... ,...... t~) iff (j ORDINANCE --------- NO. 461 1) AN ORDINANCE OF THE CITY OF GJLROY VACATING AND ABANDONING CERTAIN STREETS AND ALLEYS IN THE JORDAN SCHOOL AREA IN THE CITY OF GJLROY. . . . . . . . . . . THE COUNCIL OF THE CITY OF GILROY having on the 5th day of April, 1948, duly passed and adopted Ordinance 457 whereby it declared its intention to proceed under the street Vacation Act of 1941 and vacate certain streets and alleys in the Jordan School area of Gilroy and reserve certain right of ways and permanent easements for the City of Gilroy; and, such Ordinance having been published in the Gilroy Evening Dispatch on the 7th day of April, 1948; and the City Clerk of the City of Gilroy having caused notices of the passing of said Ordinance to be published in a newspaper of general circulation in the manner and form required by law; and the said streets and alleys having been posted in the manner and form required by law; and no objections to said proposed vacation of said streets and alleys having been filed at the hearing held by said council on the 4th day of May, 1948, at 8:30 P.M. o'clock at the City Hall at Gilroy, California: THE MAYOR AND COMMON COUNCIL OF THE CITY OF GILROY DO ORDAIN AS FOLLOWS: SECTION I. The following described streets and alleys within the said city are hereby vacated and abandoned: a. All of Dowdy Street (75 feet wide) between the Southerly line of First Street and the Northerly line of Third street. b. All of Second Street (80 feet wide) between the Easterly line of Carmel Street and the projection Northerly of the Westerly line of the alley in Block 4 North, Range 5 West; and the Southerly 30.00 feet of Second street between the Westerly line of Hanna Street and said projected alley line. c. All of the alley (20 feet wide) in Block 4 North, Range 5 West. d. All of the alley (20 feet wide) in Block 4 North, Range 6 West. 1&1 _1- "'4.....__ f /1::'- .r~} , ~-",l ( e. All of the alley (20 feet wide) in Block 5 North, Range 6 West. Section II. The City of Gilroy reserves and excepts l J therefrom a permanent easement to enter upon at any time, or from time to time, and pursuant to existing franchises or renewals r ) J I " thereof, or otherwise, to construct, maintain, operate, replace, remove, and renew all existing, or future utilities, as may be required over, on, across, or under the alley in Block 4 North Range 5 West, and Second Street, as the same are hereinabove described. Section III. This Ordinance shall take effect and be \ \- in force from and after thirty (30) days from its passage and subject to the condition that during this period of time the Gilroy School District pay to the City of Gilroy the sum of One Thousand Dollars ($1,000.00) for such vacation and abandonment of the ! - ~ I hereinabove described streets and alleys.
