Ordinance 472 .' '-..,.. ./ ~r '-- ,;: cZ- 0 I-~-' ( '. ORDINANCE N o. '72 AN ORDINANCE REGULATING APPARATUS FOR DISPENsING OF INFLAMMABLE LIQUIDS AND GASOLINE TO THE PUBLIC. THE C01n~ON COU~CIL OF THE CITY OF GILROY DO ORDAIN AS FOLLOWS: tt Section 1. DEFINITIONS. For the purpose of this Ordinance certain words and phrases are defined and certain provisions shall be construed as herein set out, unless it shall be apparent from the context that they have a different meaning 0 (a) "INFLAMMABLE LIQUIDS, CLASS I" include all liquids which flash point below 110 degrees Fahrenheit, as determined in a "Saybo1t Electric Open Cup Testero" (b) "INFLAMMABLE LIQUIDS, CLASS II" include all liquids which emit a flammable vapor and with flash point at or above 110 degrees Fahrenheit, as determined in a "Saybolt Electric Open Cup Testero" (c) "GASOLINE" is any product of petroleum or any hydro- carbon liquid with flash point below 100 degrees Fahrenheit, as determined in a "Saybo1t Electric Open Cup Testero" Section 2. DISPENSING OF INFLAMMABLE LIQUIDS AND GASOLINE TO THE PUBLIC. Inflammable liquids, Class I and Class II, or gasoline, as defined in this ordinance, shall be delivered from dispensing devices only by the operators of such devices, their employees or authorized representatives; and, when unattended, all pumps and other facilities for the delivery of inflammable liquids, Class I and Class II, or gasoline, shall be locked or other effective provisions made to prevent public access to supplies of such inflammable liquids or gasolineo cj7L I... j / ~~I ~ ~. , Section 3. APPARATUS FOR DISPENSING GASOLINE AND INFLAMMABLE LIQUIDS. All apparatus for the dispensing of gasoline or inflammable liquids, Class I and Class II, as defined in this ordinance, must have the approval of the National Board of Fire Underwriters. Section 4. ENFORCEMENT. It shall be the duty of the Fire Chief to enforce the provisions of this Ordinance, and to that end he is hereby authorized and empowered to inspect or test any tank truck or any vehicle, apparatus or equipment used for the transportation of inflammable liquid or gasoline at any time or place. Section 50 PENALTY.- Violation of this ordinance shall constitute a misdemeanor and shall be punishable by imprisonment in the City Jail for a period not to exceed thirty days or by a fine not in excess of One Hundred dollars ($lOO.OO) or by both such fine and imprisonment, and it shall consitute a new and separate violation for each day during any portion of which any of the provisions of this ordinance shall be violatedo Section 60 The Common Council hereby declares that the purpose of this ordinance and its adoption, is the prevention of fires, it having been determined by the Council that the dis- pensing of gasoli~ and the other inflammable liquids hereinbefore mentioned by other than operators in attendance constitutes a fire hazard and is detrimental to the public safetyo Section 70 All ordinances and parts of ordinances in conflict herewith are hereby repealed.
