AN ORDINANCE TO CONTROL THE INSTALLATION OF CURB, GUTTER, SIDF..'WALK1 AND MISCILaNEOUS CONCRETE WORK WITHIN THE PUBLIC STREETS uR THOROUGHFARES OF THE CITY OF GILROY. , THE COMMON COUNCIL OF THE CITY OF GILROY DO ORDAIN AS FOLLOWS: Section 1. Definition,. a. The term Engineer as used within the terms of this ordinance is defined as being the officially appointed engineer of the City of Gilroy or his authorized representative. ~ b. The term Inspeotor .a amn1 wi thin the terms of this ordinance is defined as being the officially authorized building inspector of the City of Gilroy or other inspector duly authorized to inspect works coming within the scope of this ordinance. c. The term Standard Specifications as used within this ordinance is defined as being the current Standard Specifi- cations of the state of California Department of Public Works, Division of Highways. Section 2. Permits and Purchase Orders. 11 r Before the installation of any curb, gutter, sidewalk, or miscellaneous concrete work within the public streets or thoroughfares of the City of Gilroy, the Property Owner or his duly authorized contractor must obtain a purchase order from the City Purchasing ~ent for the establishment of Grade and Line Stakes by the City Engineer. The purchase order will constitute the permit to do the work. Section 3. Establishment of Lines and Grades. The purchase order shall be presented to the City Engineer who will establish the necessary line and grade points and instruct the owner or contractor in their proper usage. If, without any fault of the City of Gilroy or the Engineer, a resetting of the grade stakes and line points is necessary, a fee of fifteen ($l5.00) dollars shall be paid to the City Purohasing Agent before a second or subsequent purchase order will be issued. Section 5. Plans and Material,s. All work covered by this ordinance will be constructed in accordance with plans furnished by the City Engineer, of Class "A" concrete as defined by the Standard Specifications. Curb, gutter, and sidewalk will be constructed in conformance with Sections 43 and 44 of the Standard Specifications. Deviations from these Standards will not be made without the specific approval of the Engineer. The Engineer may approve Creek Run material for concrete for certain classes of work where the source and handling of the material is approved by him. The minimum strength requirement for any concrete installed within the scope of this ordinance shall be 2000 lbs. per square inch after 28 days when tested in a laboratory designated by the Engineer. Samples for testing will be taken by the Engineer or Inspector at such times as deemed necessary by the Engineer to control the quality of the work. Concrete failing to meet the strength requirement shall be removed upon order of the Engineer. Section 6. Eguipment. Mixing equipment must be approved by the Engineero Section 7. Inspection and Authoritx. The Engineer must approve in writing the alignment and grade of forms and the proper -2- " J d..~7 \',-< depth of excavation before any concrete may be poured. The City Inspector must be notified and be present when the concrete is poured. In the event of controversy, the deci- sion of the Engineer shall be final. In the absence of the Inspector, the City Engineer or his representative shall be present. Section 8. Miscellaneous. / ~~ i - erd lut!l!fH". Nothing contained within this ordinance shall be construed as preventing a private property owner from doing his own work in accordance with the requirements of this ordinance. Section 9. This ordinance shall be in full foroe and effect from and after its passage and approval~ ADOPTED AND PASSED this 6th day of - A.
