C ~ !.2. 480 AN ORDINANCE OF THE CITY OF GILROY REGULATING TRAFFIC UPON THE PUBLIC STREETS AND REPEALING ORDINANCES NOS. 229, 238 252, 268, 283, 291, 292, 322, 328t 330, 343, 345, 355, 357, 359, 363, 424, 426, 435, 455 and 459 AND ALL OTHER CRDINANCES AND m RTS OF ORDINANCES IN CONFLICT THEREWITH 0 The Jlayor and Common Council of the City of Gilroy do ordain as follows: ARTICLE I DEFINITIONS Section 1. Definitions of Words and Phrases. (a) The fOllowing words and phrases when used in this ordinance shall for the purpose of this ordinance have the meanings respectively ascribed to them in this article. (b) Whenever any words or phrases used in this ordinance are not defined herein, but are now defined in the Vehicle Code of this state, such definitions are incorporated herein and shall be deemed to apply to such words and phrases used herein as though set forth herein in full. Section 2. Central Traffic District. All streets and por- tions of streets within the area described as follows: All that area bounded by the East line of Konterey Street on the East and by the West line of Monterey Street on the West and on the North by the Easterly extension of the Southerly boundry line of Second street and on the South by the South line of Seventh Street. Section 3. Holidays. I. holiday is any day designated as such in Section 10 of the Political Code of the State of California; provided, however, that Saturday afternoon shall not be considered a holiday for the purpose of this ordinance. Section 4. Loadin~ Zone. The space adjacent to a curb reserved for the exclusive use or vehicles during the loading or unloading of passengers or materials. Section 5. otticial Time Standardo Whenever certain h0urs are named her.in, they shall mean standard time or daylight saving time as may be in current use in this city. Section 6. Parkwayo That portion of a street other than a roadway or a sidewalk. Section 10. Passenger Loadin~ Zone. When required means complete cessation of movement. (b) ,tOD or Stand. When prohibited menas any stopping or standing of a vehicle, whether occupied or not, except when necessary to avoid conflict with other traffic or in compliance with t12 directi0ns of a police officer of official traffic control device. Section 15. Traffic. Pedestrians, ridden or herded animals, vehicles, street cars and other conveyances either singly or together while using any street for purposes of travel. ARTICLE II ENFORCEKENT AND OBEDIENCE TO TRAFFIC REGULATIONS Section 16. Authority 9f Police and Fire DeDartment 9ffJcials. (a) It shall be the duty of the officers of the police department or such officers as are assigned by tt~ chief of police to enforce allstr et traffic laws of this city and all of the state vehicle laws applicable to street traffic in this city. (b) Officers of tm police department or such officers as are assigned by the chief of police are hereby authorized to direct all traffic by voice, hand or signal in conformance with traffic laws, provided that in the event of a fire orother emergency or to expedite traffic or to safeguard pedes'trians, officers of the police department may direct traffic as conditions may require, notwithstanding the provisions of the traffic laws. (c) Officers of the fire department, when at the scene of a fire, may direct or assist the police in directing traffic thereat or in the immediate vicinity. Section 17. Reauired Obedience To +raff1c Ordinance. It is a misdemeanor for any person to do any act forbidden or fail to pertorm any act required in this ordinance. Section 18. Oqedience to Police and Fire DeDa~tment,. Qfficia1s. No person shall wilfully fail or refuse to comply with any lawful order of a police officer of fire department official when directing traffic. << Section 19. Persons otmr tmn Qff~cials Shall not Direct, T~affic. No person other than an officer of the police department or a person deputized by the chief of police or person authorized by law shall direct or attempt to direct ~raffic by voice, hand or other Signal (except that persons may operate when and as herein provided any mechanical pushbutton signal erected by order of tm chief administrative officer. Section 20. Public Employees to Obey Traffic Re~lations. The provisions of this ordinance shall apply to the driver of any vehicle owned by or used in the service of the United States Gov- ernment, this state, any county or city and it shall be unlawfUl tor any said driver to violate any of the provisions of this ordinance except as otherwi$e permitted in this ordinance or by state statute. Section 21. i~emDtions to Certain Vehicles.(a) The pro- -2- I I , glJ%" visions of this ordinance regulating the operation, parking and standing of vehicles shall not apply to any vehicle of tbe police or fire department, any public ambulance or any public utijlity vehicle or any ,private ambulance, when such public utility vehicle or private ambulance has qualified as an authorized emergency vehicle, when any vehicle mentioned in this section is operated in the manner specified in the Vehicle Code in response to an emergency call. (b) The foregoing exemptions shall not, however, protect the driver of any such vehicle from the consequences of his wilful disregard of the safety of others. (c) 1he provisions of this ordinance regulating the parking or standing of vehicles shall not apply to any vehicle of a city department or public utility while necessarily in use for construction or repair work or any vehicle owned by the United States while in use for the collection, transportation or delivery of United States Kail. Section 22. Report of Damage to Certain Property. (a) The driver of a vehicle or the person. in charge of any animal involved in any accident resulting in damage to any property publicly owned or owned by a public utility, including but not lia1ted to any fire hydrant, ornamental lighting post, telephone pOle, electric light or power pole, or resulting in damage to any ornamental shade tree, traffic control device or other property of a like nature located in or along any street, shall within twenty-four (24) hours after such accident make a written report of such accident to the police department of this city. (b) Every such report shall state the time when and the place where the accident took place, the name and address of the person owning and of the person driving or in charge of such vehicle or animal, the license number of every such vehicle, and shall 'briefly describe tm property damaged in such accident. (c) A driver involved in an accident shall not be subject to the requirements or penalties of this section if and during the time such driver is physically incapable of making a report, but in such event said driver shall make a report as required in subdivision (a) within 24 hours after regaining ability to make such report. ARTICLE III TRAFFIC CONTROL DEVICES Section 23. When Traffic Co~trol Devices Recuired for Enforcement Purposes. No provision of the Vehicle Code or of this ordinance for which signs are required shall be enforced against an alleged violator unless appropriate signs are in place and SUfficiently legible to be seen by an ordinarily observant person, giving notice ~f such provisions of the traffic laws. Section 24. Obedience to Traffic Control Devices. The driver of any vehicle shall obey the instructions of any official traffic control device applicable thereof placed in accordance with the traffic ordinances of this city unless otherwise directed by a police officer subject to the exceptions granted the driver of an authorized emergency vehicle when responding to emergency calls. Section 25. Traffic Control Devices--Hours of Operation. The official traffic signals shall be in operation or be in effect except in those cases where different hours or days are specified in this ordinance, from the hnur of o'clock a.m. to 10:30 o'clock po.. and at other hours said devices shall be operated as blinkers. -3- r ~77 Section 26. Authority to Inst~ll Traffic Control Dev~ges. (a) The Chief Administrative Officer shall have the exclusive power and duty to place and maintain or cause to be placed and maintained official traffic control devices when and as required under the traffic ordinances of this city to make effective the provisions of said ordinances. (b) Whenever the Vehicle Code of this state requires for the effectiveness of any provision thereof that traffic control devices be installed to give notice to tm public of the application of such law the Chief Administrative Officer is hereby authorized to install the necessary devices subject to any limitations or restrictions set forth in the law applicable thereto. (c) The Chief Administrative Officer may also place and maintain such additional traffic control devices as he may deem necessary to regulate traffic or to guide or warn traffic, but he shall make such determination only upon the basis of traffic eng- ineering principles and traffic investigations and in accordance with such standards, limitations and rules as may be set forth in the traffic ordinances of this city or as may be determined by ordinance or resolution of the legislative body of this city. ARTICLE IV TURNING MOVEMENTS Section 27. D t Places wh r . made by the driver of any vehicle upon the intersection at Third and Monterey Streets or upon the intersection at Seventh and Monterey Streets or at any place on Monterey Street between said intersectionso The Chief Administrative Officer is hereby authorized to determine additional intersections and areas in which drivers of vehicles shall not make a "Uff turn; proper signs shall be placed at such intersections where the making of a "Un turn is prohibited. Section 28. Obedience to ~o-tur~ signs. Whenever authorized signs are erected indicating that no rig t or left or "UN turn is permitted, no driver of a vehicle shall disobey the directions of any such signo ARTICLE V ONE-WAY STREETS AND ALLEYS Section 29. the Chief Administrative Officer to St~n Qn.-Way Streets a~d Alle~s. Whenever any ordinance or resolution of this city designates anyone-way street or alley, the Chief Administrative Officer shall place and maintain signs giving notice thereof, and no such regulations shall be effective unless such signs are in place. Signs indicating the direction of lawful traffic movement shall be placed at every intersection where movement of traffic in the opposite direction is prohibited. AR'fICLE VI SPECIAL STOPS REQUIRED Section 30. ~he Chief Administr,tive O~tic.r ~o Erect Ston Signs. Whenever any ordinance or resolution of t is city deSignates and describes any street or portion thereof as a through street, or any intersection at wHCh vehicles are required to stop at Qne or more entrances thereto, or any railroad grade crossing at which vehicles are required to stop, the Chief Administrative Officer shall erect and maintain stop signs as follows: ...4. I ~~ A stop sign shall be erected on each and every street at its intersection with such through street or portion thereof so desig- nated and at those entrances to other intersections where a stop is required. Every such sign shall conform with- and shall be placed as provided in Section 471 of the Vehicle Code. Section 31. Stop at Throu~h Street or Stop Si~no (a) Those streets and parts of streets described in Section 70 hereof are hereby declared to be through streets for the purposes of this sectiono (b) The provisions of this section shall also apply at one or more entrances to the intersections as such entrances and intersections are described in Section 71 hereof. (c) When stop signs are erected as herein provided at tlB entrance to any intersection or at any railway grade crossing, ever7 driver of a vehicle shall stop as required by the Vehicle Code. , Section 32. Emer2in2 from A~leY or Private Driveway. The driver of a vehicle emerging fro. an alley, driveway or building, shall stop such vehicle immediately prior to driving onto a sidewalk or into the sidewalk area extending across any alleyway. ARTICLE VII MISCELLANEOUS DRIVING RULES Section 33. Driving Throu2h Funeral Processions. No driver of a vehicle shall drive between vehicles comprising a funeral procession while they are in motion and when the vehicles in such processions are conspicuously so designated. Section 34. Clin~in2 to Movin2 Vehicles. Any person riding upon any vicycle, motorcycle, coaster, roller skates or any toy vehicle shall not attach the same or himself to any moving vehicle upon any roadway. Section 35. V,hicles Shall Not be Driven o~ the Sidewalk. The driver of a vehicle shall not drive within any sidewalk area or any ~rkway except at a permanent or temporary driveway. Section 360 lew Pavement. No person shall ride or drive any animal or any vehicle over or across any newly made pavement of freshly painted marking in any street when a barrier or sign is in place w'~ning persons not to drive over or across such pavement or marking, or when a sign is in place stating that the street or any portion thereot is closed. ARTICLE VIII PEDESTRIANS Section 37. The Chi,! Administrative Officer to Est~pli,h Crosswalks. (a) Crosswalks shall be established and maintained in the following locations: 1. Across Second Street at it s Westerly approach to Monterey Street. 2. Across Monterey Street from Odd Fellows Avenue. 3. Across Monterey Street immediately Worth of each of the following intersections: Third and Monterey, Fourth and Monterey, and Fifth and Monterey. 4. Across Monterey Street immediately South of its intersection thereof with Lewis Street. -~ J-?/ 5. Across Monterey Street immediately South of tm inter- section thereof with Martin Street. ,6. across Monterey Street immediately North or its intersection with First Street. 7. Across Monterey Street imBediately South of its inter- section with Casey Lane. 8. Across all approaches at the intersection of Sixth and Monterey Streeto 9. Across Third, Fourth, Fifth and Seventh Streets immediately West of the intersection of each or the said streets with Monterey Street. 10. Across Seventh Street, Old Gilroy Street, Martin Street Lewis Street and Odd Fellows Avenue immediately East of the intersection of each or said streets with Monterey Street. 11. Across Second Street on the Eastern approach to Hanna Street. 12. Across Hanna Street on the Southern approach to Second Stree' 13. Across all approaches at the intersection of Hanna and Firth Streets. 14. Across all approaches at the intersection or Hanna and Third Streets. 15. Across Fourth Street on the Eastern and Western approaches to Hanna Street. 16. 19. Across all appraoches at the intersection of Fourth and Bigelberry Streets. Across all approaches at the intersection of Firth and Eigelberry Streets. Across all approaches at tm intersection or Sixth and Eige1berry Streets. Across all appraoches at the intersection of Sixth and Railroad Street~ Across the Northern approach on Maple Street at the inter- section with Old Gilroy Street. 17. 18. 20. 21. (b) Crosswalks shall be established and maintained at Other intersections and places as determined by the Chief Administrative Officer. (c) Stop Bars shall be painted in accordance with the speciric- ations outlined in the "Manuel for Standard Traffic Striping and Highway Signs in Cities" published by the California Division of Highways, at all locations where stop signs are installed and where no crosswalks are painted. -6- r ~~ (d) School crossing markings shall be established and maintained in tront of the "Jordan" School on Hanna Street, and on Third Street opposite the "S$verance- Public school. , Section 380 When Pedestrians Must Use Crosswalk~. No pedestrian shall cross a roadway at any place otlBr ~7 a route at right angles to the curb or by the shortest route to the opposite curb except in a marked crosswalk. Section 40. Standing in Roadways. No person shall stand in any roadway or in a crosswalk if such action interferes with the lawful movement of traffic. This section shall not apply to any public otficer or employee, or employee of a public utility when necessarily upon a street in line of duty. ARTICLE IX STOPPING, STANDING AND PARKING Section 41. Application of Re~lations. (a) The provisions or this ordinance prohibiting the stopping, standing or palking or a vehicle shall apply at all times or at those times herein specified, except when it is necessary to stop a vehicle to avoid conflict with other traffic or in com pliance with the directions ot a police otficer or other official trafficoontrol device. (b) The provisions of this ordinance imposing a time limit on standing or parking shall not relieve any person fro. the duty to observe other and more restrictive provisions of the state Vehicle Code or the ordinances of this city, prohibiting or limiting the standing or parking of vehicles in specified places or at specified timeso Section ~2. Standing in Parkways Prohibited. No person shall stop, stand or park a vehicle within any parkway. Section 43. Use ot ~t~eets for Stora~e of Ve~fc*es Proh~bitedo (a) 10 person who owns or has possession, custody or control of a~ vehicles shall park such vehicle upon any street or alley for more than a consecutive period otl~O hours. (b) In the event a vehicle is parked or left standing upon a street in excess of a consecutive period ofl~O hours, any member of tffi police department authorized by the chiet of police may remove said vehicle from the street in the manner and subject to the requirements of Sections 58, and 58501 of the Vehicle Code. Section 44. Parking for Certain Purposes Prohibited. No person shall park any vehicle upon any roadway within the Central Traffic District or Business District for the principal purpose of: 1. Displaying such vehicle for sale. 2. WaShing, greasing, or repairing such vehicle except repairs necessitated by an emergency. Section 4,. Parking on Roadways. In the event a highway includes two or more separate roadways and traffic is restricted to one direction upon any such roadway, no person shall stand or park a vehicle upon the left-hand side of such oneway roadway unless signs are in place permitting such standing or parking. Section 46. An~le Parking Prohibited. There shall be no -7" Jt f__j angle parking of any vehicle upon any of the streets of the City of Gilroy until and unless an ordinance of this City permits the same. Section 47. Parking Prohibited on Narrow Streets. (a) The Chief Administrative Officer is hereby authorized to place signs or markings indicating no parking upon any street of' alley when the width of the roadway does not exceed 20 feet, or upon one side of a street as :i.ndicated by such signs or markings when the width of the roadway does not exceed 30 feet. (b) When official signs or markings prohibiting parking are erected upon narrow streets as authorized herein, no person shall park a vehicle upon any such street in violation of any such sign or marking. Section 48. sto or Parkin Prohibted -- Si ns Requ~red. The Chief Administratlve cer shal appropriate y s gn or mark~e following places and When so signed or marked no person shall stop, stand or park a vehicle in any of said places: 1. At any place within five feet of an intersection in the central traffic district or in any business district except on the approach to a traffic signal, boulevard stop sign, or official electric flashing device 'at the !tn.~ersectio1;1; provided, however,/ that a bus may'stopata designated bus stop. 2. At any place where the Chief Adrninistrati ve Officer deter- mines that it is necessary in order to eliminate unusual traffic hazard. Secticn 49. Unlawful Parking -- feddlers, Vendors. (a) Except as otherwise privided in this section no person shall stand or park any vehicle, wagon or push-cart from which goods, wares, merchandise, fruits, vegetables or foodstuffs are sold, displayed, solicited or offered for sale or bartered or exchanges, or any lunch wagon or eating car or vehicle, on any portion of any street within this city, except that such vehicles, wagons or push-carts may stand or park only at the request of a bona fide purchaser for a period of time not to exceed ten (10) minutes at anyone place. The provisions of this subsection shall not apply to persons delivering such articles upon order of, or by agreement with a customer from a store or other fixed place of business or distribution. (b) No person shall park or stand on any street, any lunch wagon, eating cart or vehicle, or push-cart from which tamales, peanuts, popcorn, candy or other articles of food are sold or offered for sale without first obtaining a written permit to do so from the legislative body which shall designate the specific location in which such cart shall stand. (c) No person shall park or stand any vehicle, or wagon used or intended to be used in the transportation of property for hire on any street while awaiting patronage for such vehicle or wagon without first obtaining a written permit to do so fro," the legislative body which shall designate the specific location where such vehicle may stand 0 (d) vVhenever any permit is granted under the provisions of this section and a particular location to park or stand is specified therein, no person shall park or stand any vehicle, wagon, or push- cart on any location other than as designated in such permit. In the event that the holder of any such permit is convicted in any court of competent jurisdiction for violating any of the provisions of this section, swch permit shall be forthwith revoked by the legislative body, and no permit shall thereafter be issued to such person until six (6) months have elapsed from the date of such revocation. -8- (). f'1 Section 50. Emergency Parking Signs. (a) Whenever the Chief Administrative Officer shall determine that an emergency traffic congestion is likely to result from the holding of public or private assemblages, gatherings or functions, or for other reasons, the Chief Administrative Officer shall have power and authority to order temporary signs to be erected or posted indicating that the operation, parking or standing ot vehicles is prohibited on such streets and alleys as the Chief Administrative Officer shall direct during the time such temporary signs are in place. Such signs shall remain in place only during the existence of such emergency and the Chief Administrative Officer shall cause such signs to be removed promptly thereafter. (b) When signs authorized by the provisions of this section are in place giving notice thereof, no person shall operate, park or stand any vehicle contrary to the directions and provisions of such signs. Section 51. Display of Warning Devices When Commercial !ehiCle Disabled. Every motor truck having an unladen weight of ,000 pounds or more, and every truck tractor irrespective of weight when operated upon any street or highway during the time specified in Section 618 of the Vehicle Code shall beequipped with and carry at least two flares or two red lanterns, or two warning lights or reflectors, which reflectors shall be of a type approved by the Department of California Highway Patrol. When any vehicle above mentioned or any trailer or semi-trailer is disabled upon streets or highways outside of any business or residence district within this City and upon which street or highway there is insufficient street lighting to reveal a vehicle at a distance of 200 feet during any time mentioned in Section 618 of the Vehicle Code, a warning signal of the character indicated above shall be immediately placed at a distance of approximately 100 feet in advance Of, and 100 feet to the rear or such disables vehicle, by the driver thereof. The warning signals herein mentioned shall be displayed continuously during the times mentioned in Section 618 while such vehicle remains disabled upon such street or highway. ARTICLE X STOPPING FOR LOADING OR UNLOADING ONLY Section 52. Authority to istablish Loading Zones. (a) The Chief Administrative Officer is hereby authorized to determine and mark loading zones and passenger loading zones as follows: 1. At any place in the central traffic district or any business district except no loading zones shall be determined or marked in front of any place of business which m s loading and/or unloading facilities through or by means of a rear entrance. 2. Elsewhere in front of the entrance to any place of business or in front of any ball or place used for the purpose of public assembly. (b) In no event shall more than one-half of the total curb length in any block be reserved for loading zone purposes. (c) Loading zones shall be indicated by a yellOW paint line upon the top and side of the curb within such zones. (d) Passenger loading zones shall be indicated by a white line upon the top and side of all curbs within such ZOrBS. Section 53. Parking Regulations. -9- ~f~ authorized, subject*to the provisions and limitations of this ordinance to place,'and when required herein smll place, the following curb markings to indicate parking or standing regulations, and said curb markings shall have the meanings as herein set forth. 1. Red shall mean no stopping, standing or parking at any time except as permitted by the Vehicle Code, and except that a bus may stop in a red zone marked or signed as a bus zone. 2. Yellow shall mean no stopping, standing or parking at any time between 7:00 a.m. and 6:00 p... of any day except Sundays and holidays for any pur po se other than the load ing or unload1 ng of passengers shall not consume more than three (3) minutes nor the loading or unloading of materials more than twenty (20) minutes. 3. White shall mean no stopping, standing or parking for any purpose other than loading or unloading of passengers which shall not exceed three (3) minutes and such restrictions shall apply between 7:00 a.a. and 6:00 p... of any day except ~undays and holidays and except as follows t When such zone is in front of a hotel the restrictions shall apply at all times. When such zone is in front of a theater the restrictions shall apply at all times except when such theater is closedo 4. .reen shall mean no standing or parking for longer than ten (10) minutes at any time between 7100 a.m. and 6:00 p.m. of any day except Sundays and holidays. (b) When the Chief Administrative Officer as directed under this ordinance has caused curb markings to be placed, no person shall stop, stand or park a vehicle adjacent to any such legible curb marking in violation of any of the provisions of this section. Section 54. Effect of Permiss10n to Load or Unloado Per. mission herein granted to stop or stand a vehicle for purposes of loading or unloading of materials shall apply only to com.ercial vehicles and shall not extend beyond the time necessary therefor, and in no event for more than twenty (20) minutes. (b) The loading or unloading of materials shall apply only to commercial deliveries, also the delivery or pickup of express and parcel post paCkages and United States mailo (c) Within the total time limits above specified the provisions of this section shall be enforced so as to accommodate necessary and reasonable loading or unloading but without permitting abuse of the privileges hereby granted. Section 55. Standin<< for Loadin~ or Unloadin~ OnlY. No person shall stop, stand or park a vehicle in any yellOW loading zone for any purpose other than loading or unloading passengers or material for such time as is permitted in Section 54. Section 57. Bus Zones to be Estab~ish~d~ (a) ~he Chief Administrative Officer is hereby authorized to establish bus zones opposite curb space for the loading and unloading of buses of common -10- B-r~ carriers of passengers and to determine the location thereof subject to the directives and limitations set forth herein. (b) Thw word "bus" as used in this sectirn shall mean any motor bus, motor coach, trackless trolley coach, orpassenger stage used as a common carrier of passengers. (c) No bus zone shall exceed 80 feet in length, except when satisfactory evidence has been presented to the Chief Adminis. trative Officer showing the necessity therefor, the Chief Administrative Officer may extend bus zones not to exceed a total length of 125 feet. (d) Bus zones shall normally be established on the far side of an intersecUon. ARTICLE XI STOPPING, STANDING OR PARKING RESTRICTED OR PROHIBITED ON CERTAIN STREETS. Section 58. Parking Time Limited in Central Traffic District When authorized signs are in place giving notice thereof no person shall stop, stand or park any vehicle ~thin the central traffic distric1 between the hours of 7:00 a._ and 6:00 ~.m. of any day except Sundays and holidays for a period of time longer than one (1) houro Section 59. Additional rarkin~ Time Restrictionso When authorized signs are in place giving notice thereof no person shall stop, stand or park any vehicle on Sixth Street between Eigelberry Street and the entrance to the alleys extending throulh Block 1 North Range 1 West Block 1 ~outh Range 1 West of the City of Gilroy between the hours or 7:00 a.a and 6:00 p.m. of any day except S~nday and holidays for a period of time longer than ten (10) minutes. Section 61. Cet.in Vehicles Proh~~ited in Central Traff1~ ~strict6 (a) No person shall operate any freight vehicle more than 8t reet in width, with load, or any freight vehicle so loaded that any part of its load extends more than twenty (20) feet to the fron or rear of said vehicle in the Central Traffic District between the hours of 7:00 a... and 6:00 pom. of any day. ..11- ~f'7 Section 63. Advertisin~ Vehicles. No person shall operate or drive any vehicle used for advertising purposes or any advertising v vehicle ,equipped with a sounaamplifying or loud-speaker device upon any street or alley at any time within the central traffic districto Section 64. Truck Routes. (a) Whenever any ordinance of this city designates and describes any street or portion thereof as a street the use of which is permitted by any vehicle exceeding a maximum gross weight limit of three tons, the Chief Administrative Officer is hereby authorized to designate such street or streets by appropriate signs as "Truck Traffic Routes" for the movement of vehicles exceeding a maximum gross weight limit of three tons. (b) When any such truck traffic route or routes are established and designated by appropriate signs the operator of any vehicle exceed~ ing a maximum gross weight limit of three tons shall drive on such route or routes and none other except when necessary to traverse another street or streets to a destination for the purpose of loading or unloading, but then only by such deviation from the nearest truck route as is reasonab~y necessar7. The provisions of this section shall not apply to passenger buses under the jurisdiction of the Public Utilities Commission. Section 65. Horse-Drawn Vehicles. No person shall drive any animal-drawn vehicle into or within the central traffic district between the hours of 4:30 p.m. and 6:00 p.m. of any day. Section 66. Commercial Vehicles ProhlQited From Usin~ Cer~ain Streets. (a) Whenever any ordinance of this city designates and describes any street or portion thereof as a street the use of which 1s prohibited by any commercial vehicle, the Chief Administrative Officer shall erect and maintain appropriate signs on those streets affected by such ordinance. ~ ~ ARTICLE XIII TRAINS Section 67. Boarding or 41i~htin~ from Vehicle. No person shall board or alight from any vehicle which such vehicle is in motion. Section 68. Trains Not to Block Streets. 50 person shall operate any train or trains of cars, or permit the same to remain standing, so as to block the movement of traffic upon any street for a period of time longer than five (5) minutes. ARTICLE XIV SCHEDULES OF DESIGNATED STREETS REFERRED TO IN ORDINANCB. Section 69. One-Way Streef@. In accordance with section 29 and when properly signposted, traf io shall move only in the direction indicated upon the following streets or roadways: 1. On the alleys running in a generally North and South direction through Blocks 1 and 2 North and Block 1 South, all in Range 1 West of the City of Gilroy, as shown upon the official map of said City, only South bound traffic shall be permitted. '1 2. Only North bOund traffic shall be permitted on the alleys along the West side of the Southern Pacific Railroad Company's right of way from Old Gilroy Street to Lew is street. 812- C9-- ?' [) Section 70. Through ~treets. The following named streets are hereby designated as "Through streets: '1. Monterey Street (State Highway US 101) from North City Limits to South City Liaits. 2. First Street (State Highway 152) from West City Limits to Monterey Street. 3. Old Gilroy Street (State Highway 152) from East City Limits to Monterey Street. 4. Leavesley Road from East City Limits to Monterey Street. 50 Sixth Street from East City Limits to Monterey Street. 6. Forest Street from Leavesley Road to Old Gilroy Street except for the crossing at Sixth Street. 7. Fifth Street from West City Limits to Monterey Street. 8~ Hanna Street from First Street to Fifth Street except for the crossing at Third Street. (b) In accordance with tlB provisions of section, 31 (a) when signs are erected giving notice thereof drivers of vehicles on streets intersecting through streets as described in subsection (a) shall stop at the entrance or entrances of said intersecting street and/or streets to said through streets except the intersection of Third Street with Hanna Street and the intersection of Sixth Street with Forest Street. In accordance with the provisiol of section3l(~3nd when signs are erected giving notice thereof drivers of vehicles shall stop at t he entrance or entrances of those inter- sections described as follows: 10 On Second Street at its East entrance to Hanna Street to stop West bound traffic on Second Street. 2. At the West and East entrances of Fourth Street to Hanna Street stopping East and West bound traffic on Fourth Street at Hanna Street. ' , 3. On Hanna Street at the North and South entrances to Third Street stopping North bound traffic on the South line of Third Street and South bound traffic on the North line of Third Street. ,~ 4. On both North and South sid. of Fifth Street at Hanna Street stopping North and South bound traffic on Hanna Street at the intersection with Fifth Street. 5. On Fifth Street at it s intersection with Monterey Street stopping East bound traffic. 6. ARTICLE XV PENALTIES AND EFFECT OF ORDINAKCI Section 73. Pena ties. Any person violating any of the provisions of this ordinance s all be guilty of a misdemeanor and upon conviction thereof shall be punished by imprisonment in the city jailor in the~ty jail for not exceeding thirty (30) days, or by a fine of not to exceed one hundred (I 100.00) DOllars, or by both such fine and imprisonment. Section 74. ~ffect of Ordinance. If any section, subsection, sentence, clause or phrase of this ordinance is for any reason held to be unconstitutional, such decision shall not affect the validity of the remaining portions of this ordinance. The legislative body hereby declares that it would have passed this ordinance and each section, sUbsection, sentence, clause and phrase thereof, irrespective of the fact that any one or more sections, subsections, sentences, clauses or phrases be declared unconstitutional. Section 750 ~. Ordinance Numbers 229t 238 252, 268, 283, 291, 292, 322, 328,330, 343, 345, 355, 357, 359, ~63, ~24, ~26, 435, 455 and ~59 are and each of them 1s hereby repealed and all other ordinances or parts of ordinances in conflict with or inconsistent with the provisions of this ordinance are hereby repealed except tmt this repeal shall not affect or prevent the prosecution or punishment of any person for any act done or committed in violation or any ordinance hereby repealed prior to the taking of effect of this ordinance. Section 76.
